RESOLUTION NO. 05-392 ‘A RESOLUTION AUTHORIZING A SEMI-PUBLICUSE PERMIT. TO THE VOLUSIAFLAGLER HOMELESS COALITION TO ESTABLISH A FULL SERVICE RESIDENTIAL FACILITY TO, TREAT, HOUSE AND PROVIDE SERVICES FOR THE HOMELESS AT 316 ~ 330 NORTH STREET; AUTHORIZING MAYOR AND CITY CLERK TO EXECUTE PERMIT DOCUMENT UPON CITY ATTORNEY'S REVIEW AND. APPROVAL; CONDITIONALLY APPROVING THE SITE PLAN ASSOCIATED WITH THE SITE PLAN; WITH AND PROVIDING WHEN THIS RESOLUTION SHALL TAKE EFFECT. WHEREAS, the Volusia/Flagler Homeless Coalition (“Coalition”) curently operates «feeding program for the homeless at 330 North Stret, pursuant to a semi-public use permit, approved by Resolution No. 02-474; and WHEREAS, the Coalition proposes to expand the use of 330 North Street and to ‘occupy 316 North Stret, in order to establish a full service facility to treat, house and provide services forthe homeless; and WHEREAS, the proposed facility would primarily consist of two residential components; and WHEREAS, one component consists of two buildings housing a total of 16 units to bbe used primarily forthe mentally handicapped homeless population, and the second component consists of an intermediate stay shelter to serve up to 94 homeless people, primarily oriented toward the needs of homeless fails; and WHEREAS, the Coalition would full staff both residential facilities in accordance ‘with federal ad state licemsing and grant requirements, and in accordance withthe Semi-Publie Use Permit and site plan submited by the Coalition; and WHEREAS, Development Services staff has reviewed both the site plan and permit and recommends approval ofthe request, subject to resolution of certain outstanding minor technical issues regarding the site pln; and WHEREAS, the Planning Board has reviewed the request and recommends approval of the semi-public use in accordance with Article 4, Section 5 of the Land Development Code «upc. NOW, THEREFORE, BEIT RESOLVED BY THE CITY COMMISSION OF THE CITY OF DAYTONA BEACH, FLORIDA: SECTION 1. In accordance with Anticle 4, Section Sof the LDC, the issuance of a ‘semi-public use permit for the Volusia/Flagler Homeless Coalition to construct and operate a fll service residential facility to treat, house and provide service othe homeless as more fully described in the foregoing recitals, is hereby approved at 316-320 North Street. The property is more particularly described in Exhibit A, attached and incorporated by reference herein. The Mayor and City Clerk are hereby authcrized to execute the permit document, upon City Attorney's review and approval. SECTION 2. The City Commission hereby approves the site plan associated withthe above-referenced semi-public use permit, subject to final staff approval as to outstanding minor ‘technical issues. SECTION 3, ‘The City Commission hs received the report ofthe Planning Board recommending approval ofthe semi-public use request. SECTION 4, A Public Hearing at 7:00 pm., Wednesday, October 19, 2005, in Commission Chambers, City Hall, 301 South Ridgewood Avenue, Daytona Beach, Florida, after notice provide, is deemed to comply wih the LDC. Termsand Conditions. The terms and conditions of this Permit, including all exhibits, shall ‘control the development and uses ofthe Subject Property, as defined below. IL. Description of Development A Tata, 1. General, Tract A consists of approximately 1.53 seres as shown on the Suny forthe Subject Property prepared by J. Matejkaand Associates, ne, revised October 19, 2005, included in Exhibit “A”. At presen, Tract A. contains aone story masonry and metal building, hereinafter referred to asthe “Tract A Building” and shown in Exhibit “A”. 2. Cuneat Uses. The Tract A Building is curently used a listed below. With no corresponding use in the City’s Land Development Code, this use provides the community's homeless population with facilities to wash their clothes five (5) days aeck ©. Shower Facilities. With no corresponding use in the City’s Land Development Code, this use provides access to showers to the community's homeless population five (5) days a week. 4. Hlot Meal Program. With no corresponding use inthe City’s Land Development Code, this use provides the community's homeless ‘population with a hot meal ence a day ©. Food Warehouse and Distibution, Food warehousing functions will continue atthe present level of service, approximately four (4) days a week £ Wellness Center. With no corresponding use in the City's Land Development Code as the use in no way rises to the level of hospital, this use provides health related services tothe community's homeless population thre (3) days per week & Stevan Marchman Center. This use is most closely related to a ‘eeatment facility inthe City's Land Development Code, though the facilities at this location are not at this time residential. The Stewatt Marchman Center wil continue to operate its chemical dependence tweatment facility through 2006, 3. NewPermitted Uses. 4 Permitee shall have the right to expand the Tract A Building as shown on Exhibit“A" and convert the use of the Tract A Building into a comprehensive homeless shelter, referred to herein asthe new STAR Facility”, STAR standing for “Shelter and Teamwork ‘Achieve Results” The STAR Facility will contain twenty two (22) four-bedroom multi-family dwellingunits and three (3)two-bedroom. ‘multifamily units; provided, however, that a maximum of two Ihundeed fifty (250) beds be permitted in the Tract A Building regardless ofthe numberof dwelling units.
