Order of the Minister of Equipment, Housing and
Territorial Development dated 17 April 2007,
defining the constituent documents of the
building permit file, the validity and deadline
extension and its renewal conditions.
The Minister of Equipment, Housing and Territorial
Development,
Having regard to the territorial development and
urbanism code promulgated by law n° 94-122 dated 28
November 1994, as amended and completed by law n°
2003-78 dated 29 December 2003, and amended by law
n° 2005-71 dated 4 August 2005, notably article 71,
Having regard to organic law n° 2004-63 dated 27 July
2004, relating to the private data preservation,
Having regard to decree n° 2005-1991 dated 11 July
2005, relating to the environment impact study and fixing
the categories of units subject to the environment impact
study and the categories of units subject to the
specifications,
Having regard to the order of the Minister of
Equipment, Housing and Territorial Development dated 10
August 1995, fixing the exceptional cases not requiring the
recourse to an architect to draw up the building projects’
architectural plans,

 Having regard to the order of the Minister of Equipment
and Housing dated 19 October 1995, defining the
constituent documents of the building permit file, the
validity and extension deadline and its renewal conditions.
Orders the following :
CHAPTER ONE
The constituent documents of the building permit file
Article one - The building permit file shall include :
a) a request on a plain paper, signed by the petitioner or
his representative,
b) an ownership certificate or a sentence relating to a
petitory matter or an other document attributing the
ownership of the parcel on which it is planned to build,
c) a technical information slip delivered by the
administration, signed by the project architect,
except in the cases not requiring recourse to an
architect to design the building projects architectural
plans as fixed by the above mentioned order of the
Minister of Equipment and Housing dated 10 August
1995,
d) five copies of the building project including the
documents and indications provided for by article 3 of the
order herein,
e) a study relating to the project environment impact, in
accordance with the provisions of the above mentioned
decree n° 2005-1991 dated 11 July 2005,
f) an alignment order when the parcel on which building
is planned, is bordering on the railways public domain or on
one of the components of the water public domain provided
for by article 25 of the territorial development and urbanism
code and delimited in accordance with the regulations in
force,
g) the administrative authorizations relating to the
location of the parcel on which building is planned when
the latter is bordering on a zone subject to special
easements,
h) an official receipt of the income and corporations tax
declaration,
i) a receipt testifying the payment of taxes due on the
real estates subject of the building permit request,
j) a security file approved by the civil defence
departments for the buildings subject to the regime of
preventing and securing from the fire hazards, explosion
and fright in accordance with the regulations in force.
Art. 2 - The building project shall be obligatorily
designed by an architect registered in the architects’ order,
and this, except for the cases provided for by article 68 of
the territorial development and urbanism code.
Art. 3 - The building project established in five copies
includes the following documents :
- a plan locating the estate schematized if necessary on
an extract from the urban development plan of the zone,
- an overall plan on a scale of 1/500 or on a large scale
including the following indications :
* map orientation,
* the limits and size of the parcel of land,

* the site of the buildings intended or existent to be kept
or pulled down as well as their organization and
measurement,
* the indication of the beginning and height of the
neighboring buildings.
c) The plan of the storeys and plans delimiting length
as well as the fronts on a scale of 1/100 or on a large scale.
The plans fix particularly the places where the parking
lots and crossings for the disabled shall be established and
this for the building projects to be used by the public and
those for the collective housing.
These plans must include all the necessary indications
sufficient for allowing judgment of the external appearance
of the intended building, of the utilization of its premises
and the conformity with the distinctive architectural
characteristics of the concerned zone, as specified in the
relevant municipal order particularly concerning the
geometric forms, openings, building materials, decors and
the colors.
A plan of the load structure established by a consultancy
office exercising the profession in conformity with the
regulations in force or by a specialized engineer registered
in the engineers order, and this, in case the construction is :
- intended to be used by the public with a covered area
exceeding 80 m2,
- comprises at least three or more storeys,
- achieved by a property developer whatever the project
characteristics are.
The building project will be limited in cases there is
no need to consult an architect to the following two
documents :
- a sketch including all the indications enabling its
precise location and size,
- a sketch including the building site, the distribution
and the utilization of the premises of which it is formed as
well as the fronts. The sketch relating to the fence building
project must specify accurately the site as well as the front
and height.
Art. 4 - In addition to article 1 of this order, the project
of redevelopment and reaffectation of a protected or
classified property or a property located in a historical
complex, traditional or cultural site, must include two
copies of each of the following documents :
- a site plan of the property
- a global plan on a scale of 1/500 or on a large scale
including the following indications :
* map orientation,
* the limits and size of the parcel of land,
* the site of the buildings intended or existent to be kept
or pulled down as well as their organization and
measurement,
* the indication of the beginning of the neighboring
building and their height.
c) a detailed statement of the storeys on a scale of 1/50,
d) the cross section plans delimiting the sides and fronts
on a scale of 1/50,

 e) a statement of the structures,
f) a statement of all the decor items on a scale of 1/20.
These plans must include all the necessary indications
sufficient for allowing the judgment of the external
appearance of the intended building, of the purpose of its
premises.
The building redevelopments plans established on the
same scale in conformity with the above-mentioned order
must indicate with precision the parts of the building (walls,
partitions, floors…) to be substituted as well as the
openings to be filled or made and any added structural or
decorative element.
CHAPTER II
The validity deadline of the building permit , its
extension and its renewal conditions
Art. 5 - The building permit is delivered by the
president of the commune within the perimeter of the
commune and by the governor of the region in the other
zones, and this, as an order with a copy of the plan relating
to the building project with the expression "favorable
opinion" signed by the president of the building permit
technical commission and by the head of technical
department of the concerned local collectivity.
A copy of the order of the building permit is addressed
to the regional management division of equipment, housing
and territorial development for archiving.
The competent departments of the concerned local
collectivity shall inform the applicant by a registered letter
of acceptance or refusal of his/her request within a week as
from the date of the decision, and invite him, if necessary,
to hand the building permit within one month maximum as
from the date of this opinion, failing that the building
permit is deemed inoperative.
Art. 6 - The building permit is valid for three months as
from the date of informing the applicant of the acceptance.
The validity of the permit is extended for the same
period on a simple request, and this, when the building
project is not modified. This extension request has to come
to the concerned commune or delegation a month ahead of
the expiry of the validity of the order of the building permit,
the extension of which is solicited.
The building permit is renewed with the same forms
and conditions of its procurement, if the building project is
modified.
Art. 7 - The provisions of the order of the Minister of
Equipment and Housing dated 19 October 1995, defining
the constituent documents of the building permit file, the
validity and extension deadline and its renewal conditions.
Art. 8 - The order herein shall be published in the
Official Gazette of the Republic of Tunisia.

The Minister of Equipment, Housing and Territorial
Development,
Having regard to decree n° 74-93 dated 15 February
1974, fixing the attributions of the Ministry of
Equipment as completed by decree n° 92-248 dated 3
February 1992,
Having regard to decree n° 88-1413 dated 22 July 1988,
organizing the Ministry of Equipment and Housing as
amended and completed by decree n° 92-249 dated 3
February 1992,
Having regard to decree 93-1880 dated 13 September
1993, relating to the information and administrative

September 2002, joining the structures under the authority

Orders the following :
Article one - The following two services
mentioned below are added to the list of
