COUNTER-AFFIDAVIT

I, JASMINE BODLIS, of legal age, Filipino citizen, married

and a resident of 587 Sitio Potat Bagumbayan St., Barangay
Tinago, Cebu City, after having been duly sworn to in
accordance with law do herby depose and say:

1. That I am the same JASMINE BODLIS who is the

accused in the above-entitled case;

2. That I am vehemently denying the allegations of the

private complainant for being a distortion of the
truth and a mere fabrication of an inventive and
malicious mind.

3. That the truth of the matter is as follows:

a. That I know Private Complainant, CONSORCIA

MONDIA Y ABON, for being the common law wife
of my brother Wilfredo Mondia;

b. That I have a house and lot located at Kalunasan,

Cebu City;

c. That sometime in the fourth quarter of the year

2017, my brother Wilfredo and his common-law
wife Consorcia asked permission from me and my
daughter Carolina C. Ronquillo to temporarily

 build a shanty (barung-barong) in the lot
adjacent to mine which belongs to my daughter;

d. That out of our generosity and due to the fact that

Wilfredo is my brother, we permitted Wilfredo and
Consorcia to temporarily build a shanty on the
said lot;

e. That through their insistent prodding, I also

allowed them to tap on my electrical installations
so that they could have electricity in their shanty;

f. That our arrangement was that they would pay

for one-half of my electrical bill;

g. That due to the fact that I am taking care of my

daughter’s children and permanently live in my
declared address, I only go home to my house in
Kalunasan twice a week;

h. That sometime in December 2017, I was surprised

when my electricity bill drastically went up;

i. That I discovered that the Private Complainant,

without my knowledge and permission, allowed
other people to tap on my electrical installation
and collected money from those people,
pocketing the money in the process;

j. That after my discovery, I informed Private

Complainant that I would remove their tap on my
electrical installation if they would continue on
letting other people to use it;

k. That my said act of informing her of my discovery

and giving her warning angered private
complainant and started spreading rumors about
me in the community saying that I have a bad
attitude;

l. That on January 22, 2018, after checking my

January electricity bill and after making sure that
they still allowed other people to use my electrical
installations, I went to their shanty and asked her
why she continued on allowing other people to

 use my electrical installation and why was it that
she was spreading rumors against me;

m. That the Private Complainant refused to talk to

me so I told her that it would be better if I would
just cut their supply of electricity;

n. That I went home to my house and removed the

extension cord connected to my electrical outlet
which was the source of their electricity;

o. That it is not true that on January 22, 2018 I uttered

bad words against the Private Complainant. I did
not threaten her in any way and I do not own a
samurai. Attached herewith and forming part of
this counter-affidavit are affidavits of my witnesses
who are our neighbors in Antipolo City who attest
to the fact that I did not utter bad and threatening
words towards the private complainant, marked
as Annexes “A” and “B” respectively;

p. That I just asked her about her wrong doings and

when she refused to answer, I did what I thought
was right in order to protect my own interests, for I
was obliged to pay a very high electrical bill;

4. That the above-entitled criminal case should be

dismissed for the reason that the same was pursued
only by the private complainant in order to spitefully
harass me and to avenge the outcomes of her own
wrong doings.

5. That I am executing this affidavit to establish the truth

and veracity of the foregoing facts and for the
purpose of refuting the allegations hurled against
me.

PRAYER

WHEREFORE, premises considered, it is respectfully prayed

that the instant criminal complaint be DISMISSED for lack of
merit.

 Further, the respondents respectfully pray for such and
other reliefs as may be deemed just and equitable in the
premises.
