Out of every ten violent cases, usually connected to assault, 8 are dismissed before trial.
That means out of twenty-nine cases filed, twenty-two thousand seventy eight are dismissed
before trial. (ABQjournal) Eighty percent of victims to assault do not get justice. Similarly, two
Alaskan boys mercilessly robbed and beat Tim Whittlesey, a man serving them pizza, until he
was nearly deaf. The boys’ punishment is one year banishment on an Alaskan island and a
possibly five year prison sentence. The island banishment is supposed to heal and change them
for the better, but how much a person has changed is merely an opinion. The boys should be
sentenced to five years in prison following the island banishment to bring Whittlesey his
cases. Meaning that regardless of what Tlingit clan does to the two boys, washington will still
decide on a punishment. This is one of the first times that a decision would be made with regard
of both culture and law. This sudden exception could very easily lead to an expectation from
offenders with cultural backgrounds. The crime that the boys committed was done with
malicious intent as they intentionally waited for Whittlesey and attacked the unarmed man from
behind with a baseball bat. This offense would send the boys to prison by law, the defense
wishes to oppose the law of the state where the crime was committed.

The defense believes it is not right to send the boys to prison because when Columbus
came to America there were no prisons. This does not relate to the problem at hand because

In summary, two Alaskan Native boys savagely beat and rob a man who came to serve
them pizza. They are then banished to a simple one year banishment to an island after causing a
man to lose hearing in one ear. If these boys are not given jail time, is justice served?
