A. Because the owner’s duplicate copy of the parcel of land owned by my

sir.

marked them as Exhibit “F”, to fom part of your judicial affidavit, do you

Q.5. When and how did you lost the said title?
A. That before my father died, he entrusted to me the said title and I kept
the same inside an envelope and then kept it in a wooden aparador in my
residence for safekeeping. Sometime in October 1998 a strong typhoon hit
the town and some of our belongings were carried away by flood when we
evacuated and left our house. When the flood subsided I returned and
check our valuables and I found out that the contents of our wooden
cabinet was tumbled and all its contents were missing, sir.
Q.6. Did you execute an affidavit of loss of the said owner’s duplicate copy
of the said landholding?
A. Yes sir, I have a copy of that same document.
Q.7. I am showing to you a copy of the Affidavit of Loss and marked them

A. I filed this case sir for the purpose of issuance of another title in lieu of
the lost one so that I and my other siblings can partition among ourselves
the parcel of land left by our parents, sir.

A. That the owner’s duplicate certificate of title was entrusted to me by

my late father before he died and I kept it in an envelope. However,
sometime in October 1998 a strong typhoon hit our town and some of our
personal belongings were carried away by flood. When the flood subsided
I returned and check our valuables and I found out that the envelope
containing the said duplicate certificate of title is already missing, sir. (Ang

the surname of my husband, his father has also no middle name and that
it was mentioned that we were married on March 18, 1998 at Naruangan,
Tuao, Cagayan when in fact we were not yet married at that time, sir.

A. My correct first name is MARICEL sir.

A. My father is Juantino Lobindino while my mother is Emilia Garma, sir

A. There was a collision between a passenger jeepney and a motorcycle,

station of Solana, Cagayan because he surrendered there. I got the names
of the passengers of the motorcycle from their relatives at the Saint Paul
Hospital in Tuguegarao City where they were confined, sir.

A. My honest evaluation of the position of the two vehicles as they appear

on the highway is that the jeepney driver is the one at fault, sir.

A. I can say this based from the physical evidence on the highway, the
time the incident happened and the information I gathered from the
passengers of the jeepney, sir.
Q.34. Can you elaborate on this?
A. The place of the incident is clear from traffic and it was almost straight
that you could clearly see vehicles coming from the opposite direction. The
width of the highway could normally accommodate two vehicles coming
from the opposite directions. The jeepney encroached the lane of the
motorcycle. The position of the jeepney was out of line on its intended lane
and its front tires were twisted towards the left. The jeepney is
approaching a curve part of the highway. There were no skid marks on the
lane of the jeepney to indicate that the driver at least engaged his brakes
before the collision. The statements of some of the passengers that the
jeepney has brought them in the market place of Sto. Nino, Cagayan in the
early morning of that day. The time of the collision and that most of them
were asleep when the collision occurred, sir.

A. The front part of the motorcycle was totally damaged while the
jeepney’s left bumper was dented; it has also a missing front light, sir.

A. At the house of Juanito Juaquin.

A. Because he became my fiansador, I deposit the things I make to him.

A. Twice a year.
Q.12. Why only twice a year?
A.Because that is the time I will get the payment of my wares from the
people in the form of palay.

A. Because that place of Juanito has a fertile land and I have many
customers there.

made before the barangay officials, he voluntarily accepted that he did

given him a lot of chances to mend his ways but there was no positive

sa doctors at mga kawani ng ospital tuwing may may kinakailangang
gawin at bayaran. Sa katunayan kami po ng ate ko ang nagbayad at
kumuha ng mga resibo sa ospital at ako ang nagtago nito mula noon
hanggang ngayon.
T.18. At paano mo alam ang mga pigurang binanggit mo kanina na halaga

ng nagastos sa ospital nila Jaylan at Jaybee?
S. Pinagtulungan kasi namin ng ate ko na si Melony Erece na ayusin, ilista

at i- compute ang mga resibo makaraan kaming pagsabihan ng abogado
namin na tulungan namin siyang gawin ito dahil sa marami ito.

S. Dahil sa kapos din si ate pinagtulungan namin na mag-produce ng pera

sa pagbenta ng kalabaw at pagsanla ng lupa. Umutang din kami kay
Ayona Mendoza na isang grains trader sa amin. Tumulong din yung
kapatid ni nanay na si Lilia Dumaua na nagtatrabaho sa Hongkong sa
pamamagitan din ng paghiram sa mga kaibigan at kakilala niya doon.
T.21. Ano ang hinihiling mo ngayon sa husgado dito sa idinulog ninyong

kaso laban sa may- ari at driver ng passenger jeep na nakabangga sa
motor na kung saan namatay ang kapatid mo at nasugatan naman ang

kapatid ko pati sa nasira kong motor at ang mga nagastos ng ate ko at

I, ALBERTO GULATERA, 69 years old age, married, retired teacher,

Filipino and a resident of Maguiling, Piat, Cagayan, under oath, states:

Q.2. You are the same Alberto Gulatera who is one of the defendants
named in this case?
A. Yes, sir.
Q.3. In what year did you start to live in the lot subject of this case where
the alleged perpetual road- right- of-way is being claimed by the plaintiffs?
A. In 1958, sir.
Q.4. How old were you at that time?
A.Perhaps I was fourteen years old because I was still in first year high
school at that time, sir.
Q.5. How come you live in that lot starting in 1958?
A. When my father Fernando Gulatera bought the land from Augusto

Moreno he build our family house there, sir.
Q.6. Why is it that this lot was titled in your name in 1992 when you said
earlier that it was your father who bought it from Augusto Moreno?
A. My father subdivided the land into three (3) portions and distributed to
me and my two other brothers, sir. However, in 1970’s when we have our
first child I and my wife bought a portion adjacent to this part where our
family house is from Proceso Zinampan that is located behind the shares
of my two brothers Nemesio and Angel Gulatera, sir.
Q.7. In the plan marked as Exhibit “F”, I am referring to the subdivision

plan of Pedro Aquino, et al. allegedly surveyed on February 13, 1987 but
approved only on July 17, 1992, where was your family house erected in
relation to the Lot 1875-A in the name of Angel Gulatera and Lot 1875-B in
the name of Nemesio Gulatera?
A. That northern portion indicated as Lot 1875-C in that plan of Pedro

Aquino that is adjoining to the land of my brother of Nemesio Gulatera, sir.
Q.8. Who inherited the lot and the family house built by your father?
A. I was the one because I am the youngest, sir.
Q.9. What did you do to the house built by your father?
A. I just improved it, sir.
Q.10. What particular additions did you made?
A. I constructed a sala and additional rooms that are connected to our old
house, sir.
Q.11. What are the structures or improvements that were introduced by

your family on the lot where your family house stands?
A. In 1958 I planted a star apple on the northern portion of the house. In

1972, I also planted a chico tree and then in 1980 I added a pomelo tree
which are aligned to the star apple. I also constructed a septic tank in
1972 aligned to these trees, sir.
Q.12. Are these trees and structures still exists today?
A. Yes and I suppose that the Honorable Court has seen and noted their
presence and condition during the ocular inspection,sir.
Q.13. In relation to the houses of Dimas Pagela and Leonardo Pagela that
were also within Lot 1875 as per the subdivision plan of Pedro Aquino,et
al., which was built earlier, the family house built by your father or their
houses?
A. Our family house was built earlier by about 10 years, more or less, sir,
sir.
Q.14. You mentioned of an ocular inspection, what did the Honorable

Presiding Judge said after he inspected the land where the alleged road-
right-of-way is being claimed by the plaintiffs?
A. The Honorable Presiding Judge noted the presence of a concrete comfort

room, concrete piggery, kiosk made of light materials on the portion of
Dimas Pagela where the doted lines on the subdivision plan was indicated
which is the road-right-of -way claimed by the Pagela’s and he remarked
that there must be no structures on that part of the road-right-of-way,sir.
Q.15. You mean to say that that stretch indicated by the broken lines on
the lot in the name of Dimas Pagela cannot be used even by them as their
own right of way?
A. Yes sir because of the presence of those structures noted by this

Honorable Court during the ocular inspection.
Q.16. Was there an instance in the past when the Pagelas ever used as
their right- of-way that portion with broken lines where you said there
exist some fruit trees and a septic tank?
A. No. That portion has never been used from the time our family started
to stay there in 1958 up to the present, sir.
Q.17. When for the first time did the plaintiffs made a demand to use the
alleged road-right- of-way as indicated in the subdivision plan of Pedro
Aquino?
A. I think in the first week of February 2008, sir.
Q.18. What was your reaction to the request made?
A. I told them that their proposal is difficult to comply with because of the
condition and place of the right of way they are claiming is no longer
feasible and I proposed instead that I will give a replacement for the right
of way on a lot adjacent to the location of the alleged perpetual road-right-
of-way they are claiming , sir.
Q.19. What was their answer to your proposal?
A. They agreed, sir.
Q.20. So what happened after you arrived at an agreement to replace the

road-right- of- way?
A. The plaintiffs caused the preparation of a document to their lawyer
wherein I and Paulito Paulino my seller of a small portion of Lot 1874
signed in order to give portions of our property as replacement of the right
of way they are claiming, sir.
Q.21. I will attach the affidavit of right of way dated February 12, 2008 as
Exhibit “1” of your judicial affidavit to form part of it, do you approve this?
A. Yes, sir.
Q.22. What happened after you and Mr. Paulino signed that document?
A. The plaintiffs cut some fruit trees on the portions of our lands. They also
hired the services of a surveyor who measured the width of the
replacement right of way and thereafter they constructed two parallel
hollow block structures to indicate the road right of way. In fact they are
now using that right of way since then to the present, sir.
Q.23. What then started this case between you for the opening of the
alleged perpetual road-right-of-way when there was a mutual agreement
between you for its replacement that was even reduced into writing?
A. I suppose that Milagros Pagela was offended when I told their worker
named Onad Caole who was incharge of clearing the area to be careful of
cutting the coconut tree without the necessary permit otherwise the
authorities might suspect that I was the one who did it and I will be put in
a bad light, sir.
Q.24. What happened after that incident?
A. My wife went to talk to Atty. Carmelo Villacete so that we will have a

conference with Milagros Pagela before him and advice us on how we can
solve that problem regarding the coconut tree, sir.
Q.25. Did Atty. Villacete accommodate your wife’s request?
A. Yes, we had a conference with Milagros Pagela before Atty. Villacete,

sir.
Q.26. What was the advice of Atty. Villacete, if any?
A. Atty. Villacete told us that there must be a permit from the Philippine
Coconut Authority (PCA) before the coconut tree could be cut, sir.
Q.27. What else happened in that conference?
A. I told Milagros Pagela that she should fix my fence for our security and
peace of mind because the chicken wire that I placed on top of my fence
was removed by them during the construction of the two parallel fences
that represents the road right-of-way, sir.
Q.28. What was the reaction of Milagros Pagela?
A. She promised us in the presence of Atty. Villacete that she will start to
fix the fence on the following morning, sir.

sir.Then a case was filed against us without being referred first to our

Q.32. You mean to say that there was no actual confrontation between you
before the Lupong Tagapamayapa before the filing of this case in court?
A. Yes, because we have not been summoned at all to appear for personal
confrontation, sir.
Q.33. What provoked the Pagelas to immediately file this case to claim the
alleged perpetual road-right-of way, if you know?
A. In the afternoon of May 19, 2008, while I was standing near the kiosk
near my house Milagros Pagela happened to walked by and so I reminded
her why she has not fixed my fence.
Q.34. What was her reaction, if any?
A. She replied that she will not comply with her promise to fix the fence
because she accused me of not agreeing to cut the coconut tree. During our
confrontation she handed to me some documents which according to her
was the approval papers that she got from the PCA.
Q.35. What did you do to those papers she gave you?
A. I scrutinized them and observed that they are just blank forms.
Q.36. What did you say to her upon learning that they are blank forms?
A.I told her that they are useless pieces of paper because they are
unsigned, sir.
Q. 37. And what was her reaction to your remark?
A. She said that according to the PCA once they give those forms they are
good as approved and even belittled my person by saying that I am known
as a teacher but has a hard time to comprehend, sir.
Q. 38.What did you do after Milagros Pagela said those not so flattering
remarks to you?
A. I went to the police station to report the incident, sir.
Q.39. I will attach this excerpts from the police blotter dated May 22, 2008

A. Yes, sir.
Q.40. What happened after that confrontation?
A. We were surprised when we received a summons from the Regional

Trial Court of Tuao, Cagayan, in the third week of May 2008, sir?
Q.41. Are you aware how did this alleged perpetual road-right-of-way
indicated in the subdivision plan of Pedro Aquino came into being?
A. I do not know anything about that because I and my wife were never
consulted much less did we give our approval to it, sir. I came to know of it
only when the Pagelas were claiming in the first week of February 2008,
sir.
Q.42. Can you explain why are you not aware of this perpetual road-right-
of-way?
A. I cannot recall that I and my wife signed any document that we gave
our consent to the establishment of that road-right-of-way, sir. In fact,
when I first saw that subdivision plan of Pedro Aquino, I noticed that he
was the only one who signed the conformity to the subdivision, sir.
Q.43. Do you approve if the excerpts of the police blotter will be attached to
your judicial affidavit?
A. Yes, sir.
Q.44. What did you feel when this case was filed against you considering
that you have already given a road-right-of-way that the Pagelas are now
using?
A. I was ashamed and cannot sleep and eat well too because I felt that
this case was wrongly filed by the Pagelas, sir. I have been a public
servant also for many years and it was my first time that I have ever been
involved in a case and that is what is hard to accept, sir.

A. I will leave that matter to the Honorable Court, sir.
Q.46. It is claimed by the plaintiffs that they cannot make use of the right
of way that you and Mr. Paulino gave as a replacement to the alleged
perpetual road-right-of-way, what can you say to that allegation?
A. That is not true. Our barangay captain and the Municipal Planning and
Development Office of our town have issued their certifications that the
replacement right of way cannot impede people of using this access road,
sir. Moreover, it is their own fault if they have a hard time in negotiating
thru the two parallel hollow blocks that they build. If those structures are
not present they can passed thru that right of way with ease, sir.
