ORDER
At today’s ARRAIGNMENT, accused Piolo Cruz y Lloyd
assisted by his counsel de parte Atty. AAAAAAA; and after the said
criminal Information was read and translated to him in Pilipino, a
language that he speak and understand, entered a plea of NOT
GUILTY to the criminal information.

Let a plea of Not Guilty be entered into the records.

Thereupon, PRE-TRIAL proceeded. The court notes that

accused is not amenable to enter into plea bargaining. The following
admissions and stipulations were made by the parties:

1. the jurisdiction of this court over the person of the

accused and the place where the alleged offense
was committed;

2. the identity of accused Piolo Cruz y Lloyd; his true

and real name is that appearing in the criminal
information and is the same person who have been
arraigned in this case;

3. that the private complainant Ma. Elena Pascual is a

minor;

4. that the private complainant submitted herself for

physical and medical examination;

5. the qualifications and competence of Dr. Joseph

Palmora, the Medico-Legal Officer who conducted
the physical and medical examination;

 6. the due execution and authenticity of the Final Medico-
Legal Report.

7. that accused was still a minor during the alleged

incident.

Thereafter, the prosecution and the defense manifested that they

are not willing to make any other stipulations and admissions.

The following Exhibits were marked in evidence by the

Prosecution:

Exhibit “A” - Sinumpaang Salaysay of Ma. Elena

Pascual;

“B” - Sinumpaang Salaysay of BBB, mother

of herein private complainant Ma. Elena
Pascual;

“C” - Initial Medico Legal Report;

“D” - Final Medico Legal Report;

“E” - Birth Certificate of Ma. Elena Pascual;

The following Exhibits were marked in evidence by the Defense:

Exhibit “1” - Sinumpaang Salaysay of YYY, mother

of accused Piolo Cruza y Lloyd;

“2” - Sinumpaang Salaysay of ZZZ, father of

accused Piolo Cruz y Lloyd;

“3” - Sinumpaang Salaysay of UUU, Auntie

of accused Piolo Cruz y Lloyd;

Both parties made reservations as to the marking of other

Exhibits not available during the Pre-trial.

Accused when asked in open court whether he affirm and

confirm the stipulations and admissions made by his counsel, he
answered in the affirmative.

The court approves the stipulations and admissions made by

the parties.

Upon receipt of this Arraignment and Pre Trial Order, the parties
are hereby directed to immediately go over the same so that should
they find any error as may be supported by the facts on record, they
may take steps to correct the same within five (5) days from receipt
hereof, thereafter corrections shall no longer be allowed.

Set the initial Presentation of Prosecution Evidence on March 2,

2018 for the presentation of private complainant Ma. Elena Pascual;
March 9, 2018 for BBB, mother of private complainant; and on March
23, 2018 for witness Dr. Joseph Palmero all at exactly 8:30 in the
morning.

The initial Presentation of Defense Evidence is set on April 6,

2018 for the presentation of YYY, mother of accused Piolo Cruz y
Lloyd; on April 13, 2018 for accused Piolo Cruz y Lloyd; and on April
20, 2018 for the presentation of UUU, auntie of Piolo Cruz y Lloyd all
at exactly 8:30 in the morning.

Let proper subpoenas be issued to the aforesaid witnesses.

BBB is further deputized to personally serve the subpoenas to all

the prosecution witnesses and to make a return to the court, this is
aside from the subpoenas to be served by the Process Server of the
court.

The private complainant Ma. Elena Pascual is hereby directed

to appear in the next scheduled hearing and warned that in the event
she fails to appear without any justifiable reason; this court will
consider a provisional dismissal of the case.

 Both parties are hereby directed to be ready with its witnesses.

The trial dates agreed upon by the parties are intransferable in

character and no Motions for Postponement shall be allowed unless
for good reasons.
