COUNTER AFFIDAVIT

I, Ricky Alfredo y Norman, of legal age, Filipino, and a resident of


Butiyao, Benguet, after having been sworn in accordance with the law hereby
deposes and states that:

1. That I was charged by AAA of the crime of RAPE under


paragraph 1(a) and paragraph 2 Article 266-A of the Revised
Penal Code of the Philippines;

2. That I vehemently deny all the allegations that she has stated
on her complaint – affidavits I.S. No. ____ and I.S. No.
_________;
3. That the accusations of AAA were very impossible to take
place due to the fact that I was in my home address on the
night of April 28, 2001;

4. That the facts of the complaint affidavits were merely


fabricated stories because in the morning of April 28, 2001, I
saw AAA gathering the sayote harvested by my mother and
placing them in a sack and as a result, I shouted at AAA
prompting her to run away with her son and leave the sack of
sayote;

5. That as I started placing the harvested sayote in the sack, I


was only able to fill eight instead of ten sacks of sayote which
my mother harvested;

6. That I went to the shack of AAA and saw them packing the
sayote and saw a sack with the name of my father printed on
it;

7. That I, then, told AAA to go away and leave the place because
what they were doing was wrong;

8. That before leaving the place, I told AAA that the sacks of
sayote belonged to my family however, I decided not to take
the sacks anymore;
9. That I left after five o’clock in the afternoon and arrived in my
home address at around seven o’clock in the evening;

10. That during such time, I and my family members were


watching a Tagalog movie on Channel 3;

11. That I went to bed at ten o’clock in the evening;

12. That the following morning, on April 29, 2001, I woke up


between six to seven o’clock, helped my mother clean the
sayote farm;

13. That at around eight o’clock in the morning, I saw AAA by the
road waiting with a baggage placed in a carton box but did
not do anything;

14. The allegations stated in the complaint-affidavits I.S. No.


_____ and I.S. No. _______, are of no truth, hence, I am
executing this Counter-Affidavit for the purpose of attesting to
the truth of the foregoing statements, to inform the proper
authorities of the above facts, to support my prayer for the
dropping or dismissal of the instant case against me and for
whatever purpose this may serve best.
