Participant Release, Waiver & Indemnification

Piñatafest 2018 May 4-5, 2018

This agreement is entered into by the East End Foundation 501(c)(3) and the Participant in the 2018
Houston Piñatafest.

1. Participant is voluntarily participating in and assumes all risks associated with participating in the
Piñatafest Weekend events, including, but not limited to: falls, spills, contact with sculptures, other
participants, spectators or others, the effect of weather, including high heat, extreme cold and/or
humidity, traffic and the conditions of the road, all such risks being known and appreciated by
Participant. Having read this Release, Waiver & Indemnification and knowing these facts,
Participant, for itself, and anyone entitled to act on the Participant’s behalf, waives and releases
the East End Foundation, City of Houston and all sponsors of Houston Piñatafest Weekend
events, and each of the respective representatives and successors, officers, directors, members,
agents, and employees of the foregoing, from all present and future claims or liabilities of any
kind, known or unknown, arising out of participating in the Houston Piñatafest Weekend events
event though that liability may arise out of ordinary negligence or fault on the part of the
Participant.
2. Participant agrees to indemnify and hold the East End Foundation, City of Houston and all
sponsors of Houston Piñatafest Weekend and each of the respective representatives and
successors, officers, directors, members, agents, and employees of the foregoing harmless from
any damages, claims, demands, or suits by any and all persons, firms, or corporations arising out
of any acts or omissions by Participant or any related party in connection with any and all of the
Piñatafest Weekend events.
3. Participant hereby gives the East End Foundation, City of Houston, Houston First Corporation,
VisitHouston, and any other entity designated by the East End Foundation, permission to use, for
promotional, non-commercial purposes, photographs, videos, film and other representations of
Participant in conjunction with any and all of the Houston Piñatafest Weekend events and release
all rights that may have inconsistent therewith.
4. 4 PARTICIPANT HAS CAREFULLY READ THIS RELEASE, WAIVER & INDEMNIFICATION
AND UNDERSTANDS IT TO BE A RELEASE OF ALL CLAIMS AND CAUSES OF ACTION FOR
PARTICIPANT’S INJURY OR DEATH OR DAMAGE TO PARTICIPANT’S PROPERTY THAT
OCCURS WHILE PARTICIPATING IN THE HOUSTON Piñatafest WEEKEND EVENTS AND
THAT IT OBLIGATES PARTICIPANT TO INDEMNIFY THE NAMED PARTIES FOR ANY
LIABILITY FOR INJURY OR DEATH OF ANY PERSON AND DAMAGE TO PROPERTY
CAUSED BY PARTICIPANT’S NEGLIGENCE OF INTENTIONAL ACT OR OMISSION.
