You attached a copy of a newspaper article from October 1993 relating to Mr. Arthur's plea of guilty to embezzling from eight elderly clients aver a period of years. The article mentions that Sonia Grenadier was one of the victims, having lost approximately $100,000 to Mr. Arthur, The Virginia State Bar revoked Mr. Arthur’s license to practice law the year before.Your records indicate that, in an attempt to recoup embezzled funds, Robin Grenadier’s family sued both law firms where Mr. Arthur had worked. Your records also indicate that on May 20, 1994, attorney James Korman corresponded with Hlona Grenadier about a pending settlement of these claims as well as settlements of claims against one David Grenadier. Your records indicate further that, on May 25, 1994, Tlona Grenadier responded to Mr. Korman with a question about the sum of $30,000 having been paid, asking whether it should be included in the settlement with David Grenadier, It is about this $30,000 payment that you now allege misconduct by Ilona Grenadier. Specifically, on September 16, 1991, the Sonia Grenadier Trust sold several parcels of land to Zimmerman Development Corporation for $300,000. Stewart Title was the settlement agent, The records reflect that Sonia Grenadier endorsed the settlement documents in her capacity as trustee for the Sonia Grenadier Trust. The records also reflect a commission assignment of $30,000 to Wolk & Associates (apparently, your business). Today, you allege that this $30,000 was supposed to have been assigned to the Sonia Grenadier Trust as partial payment for the land that was sold in this transaction. You alleged that you paid your share, but that David Grenadier and Ilona Grenadier did not pay their shares. You have demanded that Ilona Grenadier provide you with a copy of the $30,000 note relating to this transaction because you believe that you can collect on it Through her counsel, Ilona Grenadier has denied any knowledge of such note. By letter to her counsel, dated May 22, 2009, you said that you have been in contact with the FBI to obtain other records you feel will show that Iona Grenadier was involved in the wrongdoing. Additionally, you expressed further concern with Ilona Grenadier’s honesty, noting that she denied being a trustee of the trust. As evidence, you attached a ten-page letter from Mr. Arthur to Sonia Grenadier, dated August 8, 1990, in which Mr. Arthur said that llona Grenadier had no memory of being trustee for certain trust assets. I note further that Mr. Arthur was substitute trustee of the Sonia Grenadier trust after Albert H. Grenadier and John Duvall. Tona and David Grenadier were authorized agents of the trust until Mr. Arthur removed them by letter, dated March 2, 1990. They were never trustees of the trust under the terms of the instrument, although they were designated authorized agents. In summary, you have provided the Virginia State Bar with substantial information relating to purported wrongdoing by former attorney James Arthur, and possibly David Grenadier, between the approximate period of 1975 to 1993. This information was the subject of a lengthy criminal investigation that led to Mr. Arthur’s guilty plea in October 1993, and collateral civil claims against Mr. Arthur’s former law firms, and possibly David Grenadier. Apparently, the criminal investigation was completed at least sixteen years ago with no finding of wrongdoing by Ilona Grenadier. Similarly, from your records, all of the civil claims appear to have been resolved approximately fifteen years ago. It is not clear from your records whether there was any civil exposure by Ilona Grenadier, but none is apparent. It is not appropriate for the Virginia State Bar to commit its resources to investigate several matters already investigated fifteen or more years ago by law enforcement agencies as well as the attorneys who brought civil claims against the purported wrongdoers. From theinformation you have presented, any allegation of wrongdoing by Ilona Grenadier is speculative at best and not the appropriate subject of a detailed Virginia State Bar investigation, which would entail a substantial commitment of Virginia State Bar resources.
