APPELLANT MOTION REQUESTING MA AGO CLARIFICATION REGARDING
FILED CRIMINAL COMPLAINTS
The Appellant respectfully prefaces this MOTION with the following Disclosure:
The gravity of serious legal issues addressed in the Civil Complaint against ALL
Appellees/Defendants, this associated Appeal, and in the RELATED Appeal,1 include (but are
not limited to) evidenced allegations of TREASON under ARTICLE III, Section 3 of the
Constitution, Economic Espionage pursuant to 18 U.S.C. § 1832 and are believed to impact
matters of National Security. Therefore, copies of this filed MOTION are sent via email,
social media and/or certified mail to: The Executive Office of the President (EOP), the US
Inspector General - Michael Horowitz, US Attorney General - Jeff Sessions, members of
the US Senate and House of Representatives, the House Judiciary Committee, House
Oversight Committee and to the Federal Bureau of Investigation (FBI). A copy will also be

made available to the Public. THEREFORE, ALL AMERICANS serve here as WITNESS.
Parties are additionally informed for documentation purposes, and out of the Appellant’s
continued concerns for personal safety/security.
This Court is hereby notified that on February 21, 2018, the Appellant filed with the FBI and
MA AGO – CRIMINAL COMPLAINTS against ALL Appellees/Defendants associated with
this Appeal.2 The newly filed complaints address evidenced criminal misconduct claims
associated with the related civil complaint, which ultimately impacts this Appeal.
The Appellant respectfully requests for the record and for documentation purposes, clarification
from Massachusetts Attorney General – MAURA HEALEY, regarding the AGO’s intention
to TIMELY bring criminal charges against ALL responsible parties of record. The Court is
reminded that ALL Appellees/Defendants have been given MULTIPLE opportunities to seek
mutual agreement, all of which have been either IGNORED or DENIED. Any FAILURE by
the MA AGO to NOW bring criminal charges against referenced parties will (at minimum) show
cause to EXPAND UPON (or file NEW) Color of Law/Due Process Violations against the
Commonwealth. Please be advised – for documentation purposes and in FULL PUBLIC
VIEW, a copy of this Motion is being delivered via email communication to the direct
attention of AG Maura Healey.3 Parties copied on the email will include: 1.) US Senator

complaints serve as an update to previously filed complaints with both the FBI and the MA
AGO.

Elizabeth Warren, 2.) US Senator Ed Markey, 3.) Governor Charlie Baker, 4.) US
Congresswoman Niki Tsongas, 5.) The US Attorney’s Office (MA) and 6.) The FBI.
Similarly, the Appellant filed a motion with this Court on Sunday, March 4, 2018 requesting
clarification from the Asst. US Attorneys (in the related Appeal) regarding the DOJ’s intention
to TIMELY bring FEDERAL criminal charges against ALL responsible parties of
record(s).
This Court is respectfully reminded that an EVIDENCED RICO claim of COLLUSION
brought against the Commonwealth stands as UNOPPOSED. Reference Attachment D – The
West LegalEdcenter© course, “After the Bubble Bursts.”
For documentation purposes, after sending a copy of this document to the President,
confirmation of its receipt is attached (See Attachment E) with the filed Court copy. If there is a
question regarding ANY portion of this Motion, the Appellant is happy to provide additional
supporting information upon request, in a separate, hearing and with the presence of an
independent court reporter.

“This UPDATED Criminal Complaint is filed by Massachusetts resident - Mohan A. Harihar for
the specific purpose of bringing CRIMINAL CHARGES (Federal and State) against ALL
identified parties associated with the ILLEGAL FORECLOSURE of his residential
Property/HOMESTEAD located at 168 Parkview Avenue, Lowell, MA 01852. As a respectful
reminder: 1.) The Department of Justice (DOJ), 2.) The MA Attorney General’s Office and 3.)
Federal Bank Regulators have ALL identified the referenced foreclosure as ILLEGAL. Civil
litigation related to the referenced illegal foreclosure is ongoing in the First Circuit Appeals
Court – Appeal No. 17-1381, HARIHAR v US BANK et al, and Appeal No. 17-2074
HARIHAR v THE UNITED STATES. A third complaint is now being filed with the
Massachusetts Land Court, in conjunction with this criminal complaint (which will be included
as an attachment for the Court’s records). Evidenced CRIMINAL claims of record include (but
are not limited to): FRAUD, Criminal RICO, Conspiracy, Economic Espionage, Treason,
Misprision, Fraud on the Court and others. ANY continued failure to prosecute these evidenced
criminal claims will show cause to expand upon (or bring NEW) Color of LAW/Due Process
violations against THE UNITED STATES and ALL responsible parties. Please be advised - on
January 24, 2018, 10:12am (EST), I placed a call to FBI Headquarters to report an evidenced act
of TREASON and ECONOMIC ESPIONAGE against The United States. After nine (9) minutes
of articulating these evidenced claims (ALL of which are documented by court record(s)), the
intake FBI agent HUNG UP on the phone call. This is a serious concern which must be legally
addressed, as it impacts the ongoing litigation. It is also interpreted that these evidenced criminal
claims impact NATIONAL SECURITY. It is my understanding that ALL calls are recorded. Out
of fear for my personal SAFETY AND SECURITY, copies of this criminal complaint are made
available to the public.”

The purpose of this email communication is to respectfully inform you of a MOTION being filed with the US
Appeals Court (First Circuit) - Appeal No. 17-1381, HARIHAR v. US BANK et al. The motion requests
clarification for the record regarding EVIDENCED CRIMINAL COMPLAINTS filed with your office on February
21, 2018, and the timeline for when CRIMINAL CHARGES will be brought against ALL responsible
Appellees/Defendants.
There are additional concerns that I respectfully ask you to clarify for the record:
1. Please provide a detailed explanation as to why the MA AGO refused to bring criminal charges against
referenced parties, for previously filed criminal complaints, filed by MOHAN A. HARIHAR;
2. Throughout the history of my ILLEGAL FORECLOSURE litigation, I have copied the MA AGO - under your
predecessor - AG Coakley AND under your leadership, via email communication and social media. You are
aware that YOUR OFFICE - along with the DOJ AND Federal Bank Regulators IDENTIFIED MY
FORECLOSURE AS ILLEGAL. Please explain for the record, why these repeated pleas for help have fallen
on "DEAF EARS";
3. You are aware that ILLEGAL Foreclosure continues to be a major issue in the Commonwealth AND
Nationwide. Even as recent as January 30, 2018, your office has boasted about its settlement against
Nationstar (aka Mr. Cooper) over servicing abuses. Yet your office has refused to take necessary action for
nearly 7 years, as it relates to my EVIDENCED CLAIMS. Please explain;
4. Please clarify why you have BLOCKED me from the MA AGO Twitter page;
5. Illegal foreclosure has conservatively damaged an estimated 60,000 households in the Commonwealth
alone - 4.2M Nationwide. The Intellectual Property known as "The HARIHAR FCS Model" was personally
(and favorably) presented by me to your office under AG Coakley's leadership. The same presentation has
been favorably made to: 1.) US Senator Warren's Senior Economic Advisor - Bruno Freitas, 2.) The
Office of US Congresswoman Niki Tsongas, 3.) Deputy Chief Counsel (former) - Gail Laster (House
Financial Services Committee) and 4.) The Executive Office of the President (under the prior Obama
administration), per the DIRECT request of VP Joe Biden. Please explain in detail, why a supported
framework to help millions of Americans and bring historic economic growth continues to be blatantly
ignored by your office.
It remains my sincere hope, that a mutual agreement can ultimately be made with ALL parties. It also remains
my INTENTION to align with The United States AND The Commonwealth for the purpose of implementing the
FCS model for the reasons stated above. Thank you for your assistance with this very serious matter. I look
forward to your timely response.

with the Court.
