Dear Investigative Committee:

I am making this complaint against Honorable Lori Bolton-Fleming in the 11th district of
Crawford County of 3rd Floor 111 East Forest in Girard Ks 66743 and A.J. Wachter of
602 N. Locust in Pittsburg Ks 66762.

Back on the date of November 16,2014 my whole life was dramatically changed
overnight and not for the better but for the worse. I was involved in an altercation in a
vehicle that night and the driver "Matthew Grotheer" put a gun in my face and said he
would fucking kill me!!! I then took the gun away and put it in his console of his truck
and he told me to get the fuck out! Jamie Wickam who was in the vehicle with us also
then said "let's go Steve" and he would give me a ride home. I then slammed the truck
door and then Matt drove off about 20 yards slammed on the brakes and I was talking
to Jamie and we walked to his truck and then Matthew came in reverse 'It us and I
shoved Jamie out of the way and he ran me over. He hit me with the back of the truck
and I hit the tailgate and I went under the truck and he rode over me with both tires
backwards and then frontwards. I ended up in a wheelchair for 3 1/2 months and my
testicles swelled up and had to have a cathedar for 3 112 months because my urethera
tube was cut. I was supposed to never be able to walk again. I am missing a front tooth
which I now look and talk ridiculous and all the plaintiff Mathew Grotheer received in
court was "18 MONTHS OF PROBATION FOR A PLEA BARGAIN OF AGGRAVATED
BATIERY A LEVEL 8 FELONY"!!!! I was extremely disappointed and that is what has
led me to making this complaint which is the first complaint I have ever made on a
judge! He was charged with aggravated battery, criminal threat, DUI, Aggravated
Assault, and only received AGGRAVATED BATTERY"!! I remembered that J. Gordon

Gregory and Lori-Bolton-Fleming both worked together just three (3) years ago in 2012
at "WILBERT AND TOWNER" in Pittsburg Kansas. My girlfriend asked Crawford
County Attorney Michael Gayoso if it was a conflict of interest for Lori Bolton-Fleming
to hear this case since she worked with J. Gordon Gregory and if she should recuse and
Michael Gayoso said "NO" she did not need to. She also had a conflict of interest with
the prosecuting attorney Michael Gayoso because of her religious conflict of interest ties
to the Lady of Lourdes Church with Michael Gayoso who is also a member.

Another conflict of interest is the fact that Lori Fleming was the assistant prosecutor for
Crawford County in 2002 where she worked with attorney Steve Stockard who is
currently employed at "WILBERTAND TOWNER" and she is biased and prejudiced for
Crawford County prosecuting attorney Michael Gayoso because she worked for the
same Crawford County employer and her husband Kyle Fleming was .~' Gayoso's
previous campaign manager when he ran for county attorney in 2012. 'Mr. Gayoso is
also a member of the same Lady of Lourdes church as Judge Fleming and they have
even performed in a band together called "TEAM JESUS" and I have enclosed the
newsletter for evidence. Their membership in a "band" together alone should have
disqualified Honorable Lori Fleming from ever hearing any law cases of Mr. Michael
Gayoso because it violates Rule 2.3(B)(C) Bias, Prejudice, and Harassment.

I think it is a total conflict of interest for Lori Fleming to be the criminal judge when the
criminal prosecutor Michael Gayoso's campaign manger was her husband, defense
attorney Kyle Fleming. According to the 2008 St. Mary's Colgan Newsletter it shows
that a "BAND" that performs at Youth and Parish events by the name of "TEAM
JESUS" consists of Lori Fleming, Michael Gayoso, and attorney Steve Stockard and it
should be a conflict of interest for Lori Fleming to hear any case litigated by Michael
Gayoso, Steve Stockard, or any other attorney at Wilbert and Towner with Steve
Stockard such as "J. Gordon Gregory".

This is the same law firm "WILBERT AND TOWNER" where during a grand jury
petition drive to try to get signatures a radio ad was ran on 100.7 ESPN My Town
Media which is owned by attorney Bill Wachter of "WILBERT AND TOWNER". There
was an inappropriate e-mail that came from Judge Lori Fleming's public 11th district
judicial computer on February 19, 2015 and it was sent to "ATTORNEY BILL
WACHTER" ex-parte that was inappropriate conduct because she called anyone that
signs the petition "Posse Comitatus" which is a demeaning nickname under Rule 2.3 of
Rules Relating To Judicial Conduct and she interfered in a private contract, by usurping
her power under K.S.A. 60-1202(1).

I feel she usurped her power again in the case of State of Kansas vs. Matthew Grotheer
by signing a plea bargain where she did not have ANY SUBJECT-MATTER

JURISDICTION" to sign an order where J. Gordon Gregory her ex-law partner is the
attorney in the case. If she already had an ex-parte conversation with Bill Wachter over
the email of the breached radio advertisement whose to say that J. Gordon-Gregory and
Lori Bolton-Fleming didn't have ex parte emaiIs in this case as well which would violate
Rule 2,9 Ex Parte Communications. Lori Fleming should have disqualified herself from
this case because Lori Bolton-Fleming violated several rules because she failed to
disqualify herself from this case in accordance with K.s.A. 20-311d change of judge and
Rule 2.11(A) Disqualification. She also failed to follow the following Rules Relating to
Judicial Conduct and they are the following:

Canon 2, RULE 2.7 Responsibility to Decide provides that A judge shall hear and

decide matters assigned to the judge, except when disqualification is required by Rule 2.11
or other law.

Canon 2, Rule 2.11(A) Disqualification provides that A Judge shall disqualify himself
/I

or herself in any proceeding in which the Judge's impartiality might reasonably be


questioned .. ."

Canon I, Rule 1.2 Promoting Confidence in the Judiciary provides" A Judge shall act at
all times in a manner that promotes public confidence in the independence, integrity, and
impartiality of the judiciary, and shall avoid impropriety and the appearance of
impropriety." The canons and Rules quoted above are in accordance with the Kansas
Code of Judicial Conduct, Rule 601B as adopted by the Kansas Supreme Court effective
March 1,2009. JUDICIAL ETHICS ADVISORY PANEL Judicial Ethics Opinion, JE 167
March 9, 2009.

Canon 2, Rule 2.4 External Influences on Judicial Conduct provides" (B) A judge shall
not permit family, social, political, financial, or other interests or relationships to influence
the fudge's tudicial conduct or ;Udgment. (C) A judge shall not conveyor permit others to
convey the impression that any person or organization is in a position to influence the judge.

Canon 3, Rule 3.7(A) Participation in Educational, Religious, Charitable, Fraternal, or


Civic Organizations and Activities says that "Subject to the requirements of Rule 3.1, a
Judge may participate in activities, sponsored by organizations or governmental entities
concerned with the law, the legal system, or the administration of justice, and those
sponsored by or on behalf of educational, religious, charitable, fraternal, or civic
organizations not conducted for profit, including but not limited to the following
activities.(Z] soliciting contributions for such an organization or entity, but only from
members of the Judge's family ... "

Canon 1, Rule 2.3 Bias, Prejudice, and Harassment(A) A judge shall perform the duties
of judicial office, including administrative duties, without bias or prejudioe.(B) A judge
shall not, in the performance of judicial duties, by words or conduct manifest bias or
prejudice, or engage in harassment, including but not limited to bias, prejudice, or
harassment based upon race, sex, gender, religion, national origin, ethnicity, disability,
age, sexual orientation, marital status, socioeconomic status, or political affiliation, and
shall not permit court staff, court officials, or others subject to the judge's .direction and
control to do so.

It is noted in the Commentary of Rule 1.2 that public confidence in the judiciary is
eroded by conduct that creates the appearance of impropriety and that tpis principal
applies to both the professional and personal conduct of the Judge.

Rule 2.1 Commentary provides that to ensure that Judges are available to fulfill their
judicial duties; Judges must conduct their personal and extrajudicial activities to
minimize the risk of conflicts that would result in frequent disqualification.

The provisions of Rule 2.11(C) which states as follows: "(C) A [udgesubiect to


disqualification under this Rule, other than for bias or prejudice under paragraph
(A)(l), may disclose on the record the basis of the rudge's disqualification and may ask the
parties and their lawyers to consider, outside the presence of the Judge and cour.tlersonnel,
whether to waive disqualification. If, following the disclosure, the parties-an~ lawyers
- "
agree,. without participation by the Judge or court personnel, that fhe Judge should not
be disqualified, the Judge may participate in the proceeding. The agreement shall be
incorporated into the record of the proceeding."

I also think it is a conflict of interest for Lori Fleming to have a husband Kyle Fleming
an attorney who is on the city of Pittsburg economic advisory Board and ntj approves
money and forgiveness loans in Pittsburg to local businesses. It would not surprise me
one bit if he didn't have some involvement with trying to get the casino bid to "Equity
Ventures/Kansas Crossing Casino" of 3501 Fairlawn, Ste. 200, Topeka, Ks 6614 the
casino in this town since they were his client in 2014 according to Lori Flemiryt s financial
disclosure report. As unethical as she has been it would not surprise me- i£jler husband
and her were going to receive a "kickback" for the casino coming to town before the
"INJUNCTIVE" got filed to stop the building of the casino.
I have included the evidence of the conflicts of interest of "TEAM JESUS"-and the
picture of Lori Bolton-Fleming and J. Gordon Gregory together at "WILBE~T AND
TOWNER" in 2012. I also have included a copy of Lori Bolton-Fleming's 2014 Calendar
Year 2014 Financial Disclosure Report and a copy of the in appropriate email she sent
back on February 19, 2015 to attorney Bill Wachter which shows she has previously had
ex parte matters with the law firm of "WILBERT AND TOWNER" and that is why she
should never have heard this case with J. Gordon Gregory as it is a conflict of interest.

This was a very serious mistake that has me "EXTREMELY UPSET"!!!!!!l!!!!!!! This case
needs a "SERIOUS INVESTIGATION" since it needs to be re-opened and modified
since there was no 5th and 14th amendment due process. A judge can not be signing
orders that a judge has a conflict of interest with the other attorney and they worked
together unless they wait five (5) years according to "MEMORANDUM AND ORDER"
signed by judge Oliver Lynch in case number 2012LM356P and I included the
"ORDER" from case number 2012LM356P where chief judge A.I. Wachter was ordered
out of the case and I have enclosed those with this complaint.

Judge Wachter has already failed to follow Rule 2.12(A)(B) Supervisory Duties as he
continues to let Lori Fleming work as a judge under him without sanctioning her at all
or suspending her for sending the inappropriate e-mail and for her hearing cases from
her former law firm. I would like Judge Wachter investigated for allowing,Lori Fleming
to litigate law within (3) years to his former law firm of "WILBERT AND TpWNER"
which his brother William Wachter is the managing partner of the firm when he hasn't
even taken the time to ask either Lori Bolton-Fleming or William Wachter if in fact Lori
Bolton-Fleming did sent the inappropriate e-mail or he just doesn't seem to care and
does not think inappropriate e-mails violates Rule 2.12(B).

P.S. Please take the 11th judicial computer that the email was sent from on February 19,
2015 to find out why an inappropriate email was sent from the public 11th judicial
district computer. I would also like to see how many" ex-parte" emails have happened
between Lori Fleming and Crawford County attorney Michael Gaoyoso.and between
Lori Fleming and any attorney at "WILBERT AND TOWNER", "FLEMING LAW FIRM,
AND "SPIGARELLI LAW FIRM" because she previously worked there at Wilbert and
Towner and Spigarelli Law firm and is currently receiving money from Fleming Law
Firm through her husband Kyle Fleming.

ORDER

The defendant herein filed a motion for recusal and affidavit in support thereof

seeking recusal of the Hon. A. J. Wachter. The case bas been transferred to this court for

consideration.

At the heart of the defendant's request is the earlier filing of a small claims suit

with this defendant as plaintiff and Judge Wachter as defendant, being case number 2010

SC 139P. His legal basis derives from the recusal procedure set out in K.S.A. 20-311d.

While he cites several of the "Rules Relating to Judicial Conduct" being Rules 1.1,2.1,

..u A judge -
and 2.3 which are within Supreme Court Rule 6OlB, the more relevant role is 2.11 (A):

shall disqualify himself or herself in any proceeding in which the


7f' judge's impartiality might reasonably be questioned ...

As Judge Wachter indicated on the record in the proceedings of June 25, 2013,

herein, he is satisfied that he can put aside any prejudice he may feel for the defendant

and decide the case impartially. He demonstrates the same in the proceedings transcribed

by patiently hearing out the defendant and allowing the defendant to make any and all

arguments he may have had. Judge Wachter then fairly applied the law and rendered

appropriate rulings.

The standard of review ofruIings on disqualification of'ajudge are stated in Smith

v. Printup. 262 Kan. 587.1997, at Syi. 8:

The standard to be applied to a charge of lack of impartiality is whether


the charge is grounded in facts that would create reasonable doubt
concerning the court's impartiality, not in the mind of the court itself: or
even necessarily in the mind of the litigant filing the motion, but rather in
the mind of a reasonable person with knowledge of the circumstances.

This court is satisfied that a jurist of Judge Wachter's experience can easily put

aside any prejudice he may have against the defendant and decide the case only on the

law and the evidence. This court is satisfied that it could do the same under similar

circumstances. This court is satisfied that most if not all lawyers who practice before

Judge Wachter would be satisfied of the same.

However, Judge Wachter's or this court's satisfaction that he could rule

impartially does not resolve the case. The issue is the appearance to a "reasonable

person with knowledge of all of the circumstances". Such a person might well question

the ability of a judge to be impartial under the circumstances.

The court notes Judge Wachter's noble intentions to prevent burdening another

judge with the case. however, this concern does not override how an outside "reasonable

person" would view the circumstances.

MEMORANDUM AND ORDER

This matter comes on for determination of the Motion for Disqualification of

Judge Loy filed by Defendant. The court has reviewed the Motion and Affidavit, Judge

Loy's response, and the Kansas Code of Judicial Conduct. For the reasons set out below,

the motion is denied.

Defendant argues that Judge Loy should be disqualified because of his previous

relationship with Mark Werner who has now entered an appearance in the case.

His first allegation that Werner and Judge Loy were law partners does not create a

showing of prejudice, impropriety. or an appearance of impropriety. This partnership

ended in 1994. After 20 years this prior relationship cannot bc said to have an effect on

Judge Ley's impartiality. It is not uncommon for Judges to hear cases in which former

partners appear as attorneys in as little as five years after leaving the partnership 10

become a judge.

His second allegation is that Werner represented Judge Loy in litigation during the

same period. Here Defendant is mistaken as the client in that case was Kenneth I. Loy,

not Judge Lay (Kurt 1. Loy). Even if Werner had represented Judge r .oy almost 20 years

ago, that relationship is so distant as 10 have no cffe.•ct upon Judge Loy's impartiality.

Finally. Defendant elaims that both Werner and Judge Loy donated to the same

political campaign. Numerous people appear to have donated to the same campaign. The

coincidence of both Werner and Judge Loy donating to the same campaign is not

indicative of a relationship that would disqualify Judge Lay from hearing this case.

Defendant next claims that Judge Loy should be disqualified from hearing any

cases "with allegations of forged. altered or fraudulent notes or retail installment

contracts" because of allegations in Deere and Co. v. Loy, 872 F. Supp. 867 (D. Kan.

1994). 'Ibis is the case discussed above wherein Kenneth I. Loy was sued and Werner

and Judge Loy acred as counsel for him. There is no factual basis 10 support this claim as

Defendant is confused about who was the Defendant in that casco There is no legal basis

to support this claim because even if Judge Loy had been a party in a lawsuit wherein

such allegations occurred, it would not disqualify him from hearing cases 20 years later

with the same subject matter. By Defendant's logic. if Judge Loy had ever gotten a

speeding ticket, he would not be able to hear a speeding case.

Defendant's allegations of prejudice individually or in combination do not support

a basis to reasonably question Judge Ley's impartiality.

11is therefore ORDERED that the Motion for Disqualification filed by Defendant

herein is denied.

Originally, sworn into office on January 12, 2009 by the Hon. Judge David F. Brewster, Gayoso
brings 10 years of criminal law experience to the office of the County Attorney. He was re-elected,
in a contested race, in November 2012 to a second term in office and was sworn in on January 14,
2013. Gayoso has argued before the Kansas Supreme Court and Court of Appeals and in 1999 was
selected as a member to the National Order of Barristers for his strong courtroom advocacy skills.

He earned his law degree from Washburn University School of Law in Topeka, Kansas and a
Bachelor of Arts degree in Philosophy from the Pontifical College Josephinum in Columbus, Ohio.

PITTSBURG, Kan. - Crawford County authorities on Tuesday said that it is continuing to


investigate a Sunday morning assault in which a man was struck by a truck and then run over a
second time.

Matthew Ian Grotheer, 25, of Pittsburg, was arrested and taken to the Crawford County Jail, where he
was booked on charges of aggravated battery, aggravated assault, criminal threat and driving under
the influence. Bond was set at $25,000.

According to a statement issued by the sheriffs office, deputies were dispatched at 3:21 a.m. to
the Lightning Creek Restaurant and Bar, 134 S. U.S Highway 69, regarding a report of a vehicle-
pedestrian accident in the parking lot.

they allege that Grotheer got into an altercation with Steven Melton, 45, of Pittsburg. Both men were
inside the truck at the time. After the altercation ended, and Melton was walking away from
Grotheer's truck, Grotheer allegedly put the truck in reverse and accelerated toward Melton, running
over him. Grotheer then put the truck in drive and again struck Melton before leaving the scene,
according to authorities. He later returned to the scene in the same truck.

Another man, Jayme Wickham, 39, of Arma, was also in the path of Grotheer's truck but was not
struck and reported no injuries.

Melton was transported by Crawford County emergency services to Via Christi Hospital in Pittsburg
with possible internal injuries.

Arma Police provided assistance at the scene.

You have got to be freaking kidding me, the man that ran me over got 18 months probation
& told the court he was sorry. That just goes to prove in Crawford County you can have
money and get away with damn near murder because that's what he damn near did. I don't
know about anybody else but I think it's time for new judges and new lawyers in this
county. Justice system here isn't worth shit. All I can tell you guys out there is I hope
everything is better for you

I hsve know alot of people who have gotten arested for failure to appear. When they never

Kendra Richello Tackkett you can alwaysappeal, find a state licensed personal injury
lawyer ... explain. if there's a case worth investigation and worth anything ...they'll takeit
because it would be a huge case for any lawyer to turn up truths about a county. that is

Facebook friends I would like to clear something up about my accident, if me speaking the
truth is offensive to anyone .I'rn not apologizing.matt and I were friends pryor to that
night.and fighting don't really solve anything, so if some of you think I started that fight
your wrong, but regardless of who or what started it, the fact remains that I had a gun stuck
in my face was run over not once but twice, went through all kinds of hell in the hospital
had to move to a handicap accessible house, lost my job .had to have someone wait on my
every need, was told I would not walk again, because of fractured pelivs and tail bone, had
a catheter for 3-1/2 months, not to mention a severd yariethia tube, had a breathing
machine due to punctured lung & broken ribs, I have since then taught myself how to walk
again I get approximately three to four hours a night sleep due to pain when I am laying
down, and I never even got an apology so if I seem a little pissed about the county letting a
guy that did that go with just probation you damn right I'm pissed, for those of you who
think I'm wrong put yourself in my position, and let's just see how happy and cheerful and
upbeat you are. So there you have it I'm not trashing anyone simply stating facts ....so if this
offends anyone delete me & don't worry about hurting my feelings because in the last year
I've dealt with enough, I'll deal with that too
