Memorandum of Agreement

KNOW ALL MEN BY THESE PRESENTS:

This Memorandum of Agreement is made and entered into by and between:

HRC PRIME HOLDINGS INC., an umbrella organization that covers different SBU’s, with address at
De Venecia Highway, Lucao District, Dagupan City, Pangasinan hereinafter referred to as the
ACCREDITED COMPANY and represented by its President, Mr. Jan Michael P. Cua.

AND

KINGFISHER SCHOOL OF BUSINESS AND FINANCE, INC., an educational institution duly


organized and existing under the laws of the Republic of the Philippines, with address at 1131MacArthur
Highway, Lucao District, Dagupan City, Pangasinan, hereinafter referred to as the BUSINESS SCHOOL
and represented by its Academic Dean, Mr. Augustues P. Lambino.

W I T N E S S E T H:
WHEREAS, the BUSINESS SCHOOL offers Business Programs that require students to undergo
practical training in companies as a requirement in their curriculum in order to expose them in actual
business practices preparation for their professional work after graduation.

WHEREAS, the ACCREDITED COMPANY willingly accepts on-the-job (OJT) TRAINEES officially
enrolled in the BUSINESS SCHOOL subject to the terms and conditions provided for in this
Memorandum of Agreement:

NOW, THEREFORE, for and in consideration of the foregoing premises herein contained, the
ACCREDITED COMPANY and the BUSINESS SCHOOL, do hereby agree and stipulate the following:

THE ACCREDITED COMPANY shall:

1. Accept TRAINEES endorsed by the BUSINESS SCHOOL to undergo 300 hours of the job
training starting April 3, 2018 to May 25, 2018;
2. Assign personnel to take charge and supervise the TRAINEES. It is understood that the
TRAINEES will be assigned/ required to perform duties and functions in areas of accounting or
finance and treasury to strengthen their theoretical training as they perform their duties and
functions in the ACCREDITED COMPANY.
3. Issue the Certificate of Acceptance of Student Trainee as required by the BUSINESS SCHOOL
in connection with the TRAINEE’S on-the-job training;
4. Provide the TRAINEE orientation and training on the areas pertinent to their line of
specialization.
5. Accomplish the necessary STUDENT TRAINEE’S EVALUATION SHEET based on the
evaluation tool given by the BUSINESS SCHOOL, to TRAINEES who will successfully finish
their on-the-job training; and
6. Enforce rules that will govern the conduct of the TRAINEES while inside and within the
premises of the ACCREDITED COMPANY. However, such rules shall be made known to the
BUSINESS SCHOOL and the TRAINEES for proper guidance.

THE BUSINESS SCHOOL shall:

1. Endorse TRAINEES who will undergo 300 hours of the on-the-job training in the
ACCREDITED COMPANY.
2. Designate an OJT Program Coordinator who will work closely with the ACCREDITED
COMPANY to monitor the actual conduct of the on-the-job training;
3. Provide the ACCREDITED COMPANY whatever documents required as the TRAINEES
undertake their on-the-job training; and
4. Together with the TRAINEES and their parents, renounce and waive any claim against the
ACCREDITED COMPANY for any injury that the TRAINEES may sustain or suffer, personal
and pecuniary, in the performance of their duties / functions while under training.

THE ACCREDITED COMPANY and the BUSINESS SCHOOL further agree that:

1. There will be no employee-employer relationship between the ACCREDITED COMPANY and


the TRAINEES.
2. The TRAINEE and OJT Program Coordinator shall abide to all policies, rules and regulations of
the ACCREDITED COMPANY while on training.
3. The TRAINEES will be personally responsible for any damage to property or injury that may
result to intentional or negligent acts while doing their duties and functions.
4. The TRAINEE and also the BUSINESS SCHOOL shall not divulge any information that they
may have access to, and any such information will only be used for academic purposes.
5. Both the ACCREDITED COMPANY and the TRAINEE reserves the right to discontinue the on-
the-job training upon submission of written notice of:
a. The TRAINEE does not show the required interest, maturity, or discipline during the training
period, or if there is serious misconduct or
b. The ACCREDITED COMPANY does not provide the kind of responsible training agreed
upon.
6. The terminating party will formally inform the OJT Program coordinator before any decision to
terminate is made and finalized. The OJT Program Coordinator will intervene in order to rectify
the situation in the interest of all parties concerned.

This Agreement shall take effect immediately upon signing hereof and shall continue to be enforced
until such time that anyone of the parties withdraws from this agreement upon 30 days prior to notice
to other.

IN WITNESS WHEREOF, the parties have hereunto affixed their respective signatures ___ of April
2018 at Lucao District, Dagupan City, Pangasinan Philippines.
