PROPOSED RECRUITMENT RULES OF (IRSME)

NOTIFICATION

New Delhi, Dated: 28.11.2014

Indian Railway Service of Mechanical Engineering (IRSME)

GSR……………….In exercise of the powers conferred by the proviso to article 309 of


the Constitution and in supersession of the existing Indian Railway Service of Mechanical
Engineers Recruitment Rules, 1968 published in the gazette vide GSR 1957 dated 09.11.1968
as amended from time to time, the President hereby makes the following rules namely:-

1. Short title and commencement:

i) These rules may be called the Indian Railway Service of Mechanical Engineers
Recruitment Rules, 2014.

ii) These shall come into force from the date of their publication in the Official
Gazette.

2. Definitions: In these rules, unless the context otherwise requires:-

(a) ‘Government’ means the Central Government.

(b) Controlling Authority’ means the Ministry of Railways, Government of India.

(c) Commission’ means the Union Public Service Commission.

(d) ‘‘Departmental Promotion Committee’ (DPC) means a Group ‘A’ Departmental


Promotion Committee specified in Schedule-III for considering the cases of
promotion to Group ‘A’ posts of the Service.

(e) ‘Duty Post’ means the posts which are included in Schedule-I.

(f) ‘Examination’ means the Engineering Services Examination / Special Class


Railway Apprentices Examination conducted by Union Public Service
Commission.

(g) ‘Grade’ means grades of duty posts specified in column -2 of Schedule-I.

(h) ‘Regular service’ in relation to any grade, means the period of service in a
grade rendered after selection thereto and includes any period –

i. Taken into account for the purpose of seniority in the case of those already in
the grade at the time of commencement of these rules;

ii. During which an officer would have held a post in that grade but for being on
leave or otherwise not being available for holding such post.

(i) ‘Schedule’ means the schedules annexed to these Rules.


(j) ‘Screening Committee’ means a committee referred to in column (5) under
Schedule-III of this notification to consider officers for non-functional up-
gradation in Pay Band-3 or Pay-Band-4 and Higher Administrative Grade of
Indian Railway Service of Mechanical Engineering, Group ‘A’ in terms of
DOP&T’s OM No. AB.14017/64/2008-Estt(RR) dated 24.04.2009.

(k) The expressions ‘Scheduled Castes’, ‘Scheduled Tribes’ and ‘Other Backward
Classes, Persons with disabilities’ shall have the meaning respectively assigned
to them in the Constitution of India/Acts of Parliament.

(l) ‘Service’ means the Indian Railway Service of Mechanical Engineering, which
shall consist of the posts or grades or time scales mentioned in Schedule- I to
these rules.

(m) ‘Appendix-I’ means the Appendix regarding details of period and courses of
training, terms and conditions of Apprenticeship of Special Class Railway
Apprentices annexed to these Rules.

3. Constitution:

The Indian Railway Service of Mechanical Engineers, Classification, Grades and Pay
Structure:-

(1) on the date of commencement of these rules, the Service shall consist of
persons:-
(a) who have already been appointed on a regular basis to Group ‘A’ Duty Posts of
Indian Railway Service of Mechanical Engineers (IRSME).
(b) appointed to the Service in terms of these rules.

(2) For the persons referred to in sub-rule (1), regular service rendered prior to
the commencement of these rules shall continue to be counted as regular service for
the purpose of seniority, confirmation, promotion, pension (if applicable) etc. under
these rules.

(3) All the Duty Posts in the Service, as specified in Schedule-I, shall be classified
as Group ‘A’ posts.

4. Grades, Authorised Strength and its review:

(1) The names, designation, grades, sanctioned numbers (strength), Pay Band and
Grade Pay (Pay Scale) etc., of the duty posts on the date of commencement of these
rules shall be as specified in Schedule-I.

(2) Notwithstanding anything contained in sub-rule (1), by notification in Official


Gazette, the Controlling Authority may, from time to time-
(a) Make additions, alterations, substitutions or modifications to the number of Duty
Posts or Grades, designation and Pay Band & Grade Pay (Pay Scale) specified in
Schedule-I;
(b) In consultation with the commission, include in the service any Duty Post or
exclude from the Service any Duty Post included in Schedule-I;
(c) In consultation with the commission, appoint an officer to a Duty Post included in
the Service under sub-clause (b) to the appropriate Grade.
5. Members of the Service: The following persons appointed from time to time in the
appropriate Grade or Duty Post shall be the members of the Service-

(a) Persons appointed in terms of sub-rule (1) of rule 3;


(b) Persons covered under clause (c) of sub-rule (2) of rule 4; and
(c) Persons appointed to the Duty Posts, in terms of rule 6.

6. Future maintenance of the Service and method of recruitment to the Service:

(1) From the commencement of these rules, the initial appointments to the Service
shall be made in the Junior Time Scale, as specified in Schedule-I.

(2) The method of recruitment and appointment to the Junior Time Scale shall be
50% by direct recruitment through Engineering Services Examination and
Special Class Railway Apprentices Examination (in the ratio 50:50), conducted by
the Commission and 50% by promotion from Group ‘B’ officers of Mechanical
Engineering Department of Indian Railways, in accordance with the provisions
contained in Schedule-II.

(3) The method of recruitment and appointment to the Grades above Junior Time
Scale shall be by promotion.

(4) The field of selection for appointment by promotion to the various Grades of the
Service shall be as specified in Schedule-II.

(5) Promotion, confirmation, placement on Non-functional Selection grade (NFSG)


and Non-functional upgradation of Duty Posts in Pay Band-3 and Pay Band-4, in
terms of DOP&T’s OM No. AB-14017/64/2008-Estt (RR) dated 24.04.2009, and any
other instructions issued from time to time, shall be done by the Controlling
Authority on the basis of the recommendations of the Departmental Promotion
Committee(s) (DPC)/Departmental Confirmation Committee (DCC) or the
Screening Committee(s), as the case may be, constituted under Schedule-III, and
in accordance with the instructions issued by the Government/Controlling
Authority on such matters from time to time.

(6) Where Juniors who have completed their qualifying or eligibility service are
being considered for promotion, their seniors would also be considered
provided they are not short of the requisite qualifying or eligibility service by
more than half of such qualifying/eligibility Service or two years, whichever is
less, and have successfully completed their probation period for promotion to the
next higher grade along with their juniors who have already completed such
qualifying or eligibility service.

7. Seniority:
(1) The seniority of members of the Service already appointed to any Grade or Duty
Post shall be governed by their relative seniority in the respective Grade or Duty
Post immediately before the date of commencement of these rules;

Provided that if the seniority of any such member had not been determined on
the said date, the same shall be determined by the Controlling Authority on the
basis of the rules as were applicable to such member before the commencement
of these rules.
(2) The seniority of officers appointed to the service in any grade/Duty Post after its
constitution shall be determined in accordance with the general instructions or
orders or guidelines issued by the Government/Controlling Authority in the
matter from time to time.

(3) The fixation of inter-se seniority between the direct recruits and the officers
promoted to Junior Time scale will be done in accordance with the rules
applicable & instructions issued by the Government/Controlling Authority from
time to time in this regard.

(4) The interpolation of seniority of officers recruited through the Engineering


Services Examination and the Special Class Railway Apprentices Examination
will be done in accordance with the rules applicable & instructions issued by the
Controlling Authority from time to time in this regard.

(5) In the cases not covered by sub-rules 7(1) and 7(2) above, seniority shall be
determined by the Controlling Authority in consultation with Department of
Personnel & Training and the Union Public Service Commission.

8. Deputation to other departments or organisations.

Notwithstanding anything contained in these rules, officers appointed to the


Service shall be liable to be sent on deputation or Foreign Service to any other Central
or any of the States or Union Territories or the autonomous bodies or public sector
enterprises of Government or State Governments or any foreign country having an
agreement in this regard with the government or State Government Department in
public interest, subject to the Government instructions or orders in force from time to
time for such deputation for foreign service.

9. Liability for service in any part of India and other Service conditions.

Any person appointed to the Indian Railway Service of Mechanical Engineers ,


shall, if so required, be liable to serve anywhere in India or abroad in public interest
with duties of fieldworks on land or offshore. Other service conditions, which are not
specifically mentioned in these rules, are as applicable to the Central Civil Services.

10. Probation & Confirmation:

(a) Every person appointed to the service in Junior Time Scale by direct recruitment/by
promotion shall be on probation for a period of three years during which the service
of the officers will be liable to termination on three month’s notice in writing on either
side. Officers on Probation will be required to undergo practical and institutional
training for a period prescribed by the Controlling Authority from time to time. Those
who complete this training successfully and are otherwise considered suitable will be
placed in charge of a working post provided they have passed the prescribed
departmental and other examination as decided by the Controlling Authority from
time to time. Failure to pass any of the examinations may result in the termination of
Service and will in any case involve stoppage of increments.

Provided that the Controlling Authority may extend the period of probation in
accordance with the instructions issued by the Government from time to time.
(b) If for any reason, which in the opinion of the Controlling Authority, are not beyond the
control of the probationers, a probationer wishes to withdraw from training or
probation he/ she shall be liable to refund any money paid to him, including the pay
and allowances, travelling expenses to join appointment and all expenses that shall or
may have been incurred by the Controlling Authority for the probationary training.

(c) On the conclusion of period of probation Controlling Authority may confirm the
probationers against the posts in the Grade of Junior Time Scale as per the prescribed
procedure. If however their work or conduct has in the opinion of Controlling
Authority been unsatisfactory, Controlling Authority may either discharge them from
the Service or may extend their period of probation for such further period as the
Controlling Authority may think fit.

(d) Pay will commence from the date of joining service as a probationer. Service for
increments will also count from the same date. Particulars regarding scales of pay are
contained in Schedule-I of the main rules.

(e) Officers recruited under these rules shall be eligible for leave in accordance with the
leave rules for the time being in force applicable to officers of Indian Railways.

(f) Officers will be employed on the Railway to which they may be posted on first
appointment and will have no claim as a matter of right to transfer to some other
Railway, but the Controlling Authority reserve the right to transfer such officer, in the
exigencies of service to any railway, production unit or project in or out of India.

(g) Probationers will start on the minimum of the Junior Scale and will count their service
for increments from the date of joining. They will, however, be required to pass any
departmental examination or examinations (including examination in Hindi) that may
be prescribed by the Controlling Authority for earning increments during probation.

Note: In the case of a person already in Government service his/ her pay on
appointment as probationer will be fixed in accordance with the rules and regulations
issued by the Government/Controlling Authority from time to time.

(h) In all matter not specifically provided for herein, the probationers will be governed
by the provisions of the Indian Railway Codes as amended from time to time and other
orders in force issued by the Controlling Authority from time to time.

(i) As regards other matters relating to probation, the members of the service will be
governed by the instructions issued by the Controlling Authority in this regard from
time to time.

11. Disqualification:

No person:

a) who has entered into or contracted a marriage with a person having a spouse
living, or

b) who having a spouse living has entered into or contracted marriage with any
person, shall be eligible for appointment to the service.
Provided that the Controlling Authority may, if satisfied that such marriage is
permissible under the personal law applicable to such person and the other
party to the marriage and that there are grounds for so doing, exempt any
person from the operation of this rule.

12. Regulation of Pay, Leave, Pension and other conditions of service:

a) The pay, increments, leave pension and other conditions of service of officers of
the various grades shall be regulated in accordance with the Indian Railway
Estt. Code Vol. I & Vol. II and IREM or other relevant instructions in force from
time to time issued by the Government/Controlling Authority.

b) The other conditions of service of the members of the service, in respect of


matters not expressly provided for in these rules, shall, mutatis mutandis and
subject to any special orders issued by the Government /Controlling Authority
in respect of the service, be the same as those applicable to officers of the
Central Civil Services in general.

13. Power to Relax:

Where the Controlling Authority is of the opinion that it is necessary or


expedient so to do, it may by order for reasons to be recorded in writing and in
consultation with the Commission, relax any of the provisions of these rules in respect
of any class or category of persons or posts.

14. Saving:

Nothing in these rules shall affect reservations, relaxation of age limit and other
concessions required to be provided for the Scheduled Castes, the Scheduled Tribes,
Other Backward Classes, Persons with Disabilities, Ex-Servicemen and other special
categories of persons in accordance with the orders issued by the Government from
time to time in this regard.

15. Interpretation:

If any question relating to interpretation of these rules arises, it shall be


decided by the Controlling Authority in consultation with the Commission.

APPENDIX - I

Particulars regarding the period and courses of Training and Terms and Conditions of
Apprenticeship of Special Class Railway Apprentices)

The terms and conditions of apprenticeship will be as set out in the form of agreement, brief
particulars of which are given below:

1. A candidate selected for appointment as a Special Class Railway Apprentice shall execute
an agreement binding himself and one surety jointly and severally to refund, in the event of
his/ her failing to complete training and probation to the satisfaction of the Government, any
money paid to him consequent on his/ her appointment as apprentice and probationer
respectively.

The apprentices will be liable to undergo practical and theoretical training for 4
years in the first instance under an indenture binding them to serve on the Indian Railways
on the completion of their training if their Services are required. The continuance of
apprenticeship from year to year will depend on satisfactory reports being received from
the authorities under whom the apprentices may be working/ receiving training. If at any
time during apprenticeship, any apprentice does not satisfy the superior authorities that he/
she is making good progress, he/ she will be liable to be discharged from the
apprenticeship.

Note: The Government of India may at their discretion alter or modify the periods and
courses of training.

2. A Special Class Railway Apprentice will be required to obtain B.E.(Mech.) Degree


from an institute notified by the Controlling Authority within 4 years of apprenticeship i.e.
within 4 year from the date of joining. In addition to the above, an apprentice should
satisfactorily complete all the 4 workshops sessions and obtain pass marks as prescribed by
Indian Railway Institute of Mechanical and Electrical Engineering (IRIMEE). If a Special
Class Railway Apprentice fails in one or more courses in a semester, he/ she shall be
allowed to repeat them in the subsequent semesters or summer programme, as per extant
rules. In respect of Special Class Railway Apprentice, the maximum duration for completion
of degree programme is 10 semesters i.e. 5 years. Thus an apprentice will be required to
obtain his/ her degree within a maximum period of 5 years (4years + 1 year grace) from the
date of joining. If an apprentice fails to pass prescribed examinations within a period of 4
years from the date of joining to become eligible for award of B.E.(Mech.) degree, he/ she
may be granted one year relaxation. The maximum period permitted to obtain degree shall
not exceed 5 years from the date of joining.

The apprenticeship of an SCRA shall be terminated under the following conditions:

(a) If he/ she is not able to obtain his/ her degree from the collaborating institute
within 5 years from the start of his/ her apprenticeship.

(b) If, under the regulations of the collaborating institute, he/ she is dropped from the
degree program, for reasons considered grave enough by Director/ IRIMEE.

(c) If he/ she fails in shop evaluation.

(d) On disciplinary grounds as per terms of appointment/ bond etc.


3. The minimum qualifying marks/ standard in various examinations during apprenticeship
training and the criteria for determining the successful completion of apprenticeship will be
decided by the Controlling Authority, which may be altered or modified at any time.

4. Unsuccessful apprentices will be discharged from their apprenticeship, one month’s


notice of discharge being given along with the intimation that the apprentice has been
unsuccessful.

5. During the period of probation they will be governed by the conditions as prescribed in
Rule 11 of the main Rule.

6. Appointment as a probationer will be from the date of completion of four years of


apprenticeship training, except in cases where the period of Apprenticeship training is
extended on account of failure in passing the prescribed examinations. Service for
increment will, subject to paragraph 5 above, count from the date of appointment as
probationer.

7. Particulars as to pay and general conditions of Service prescribed for the Indian Railway
Service of Mechanical Engineers will be found in Schedule-I to these rules.
