Kyi forcibly displaced one or more persons by expulsion or other coercive acts from an. area in which the person or persons were lawfully present, to another country or location. PARTICULARS: (2) Since 25 August 2017, over 655,000 Rohingya have been forced to flee Myanmar, where they were lawfully residing, as a result of Myanmar government actions, to other countries mainly to Bangladesh. (b) Aung San Suu Kyi knew or was reckless to the factual circumstances that establish the lawfulness of the presence of the Rohingya in Myanmar. (©) Aung San Suu Kyi’s conduct was committed knowingly as part of a widespread or systematic attack directed against a civilian population, namely the Rohingya in Myanmar. (@) Aung San Suu Kyi, in her role as the leader of the Myanmar National League for Democracy, State Counsellor, Minister or Foreign Affairs, and Minister of the President's Office, is a person effectively acting as a Military Commander, and is criminally responsible for the offences in this charge, as: (i) forces under her effective authority and control attacked the Rohingya population, forcing them to flee; (ii) she failed to exercise control over those forces, where she knew or was | reckless as to whether the forces were committing or about to commit such actions; (iii) She failed to take all necessary and reasonable steps within her power to prevent or repress the actions of those forces, or to submit the matter to any ‘competent authority for investigation and prosecution; and (iv)She failed to submit the matter to any competent authority for investigation.Under What Law?
