    D a HALIFAX AREA SCHOOL DISTRICT CONTRACT FOR EMPLOYMENT OF DISTRICT SUPERINTENDENT ‘THIS CONTRACT is made and entered this 11% day of October, 2016, by and between the Board of Schoo! Directors ofthe Halifax Area School District with offices. located in Pennsylvania (hereinafter referred to as "Distt or Board” or “Board of ‘School Directors’), wit its principal office located at 3940 Peters Mountain Road. Halifax, Pennsylvania, 17032-9605 and Dr. Michela M. Omer (hereinafter referred to as, ‘District Superintendent” or Dr. Orner) WHEREAS, the Board of School Directors of the District at a regular meeting duly and properly called on the 13" day of September, 2016, did appoint and elect Dr. Omer to the office of Distret Superintendent for Halifax Area’ Schoo! District In accordance with the provisions of Sections 608, 1071, and 1073 of the Commonwealth ‘of Pennsylvania's Public School Code of 1848 (hereinafter referred to as "Public School Code"); and WHEREAS, the parties have agreed upon certain terms and conditions of ‘employment in accordance with the Public School Code and desire to reduce sad terms ‘and concltons to writing; NOW, THEREFORE, the parties, intending to be legally bound hereby, and in ‘consideration of the mutual covenants contained herein, agree as follows: 4. Term, ‘The Board, in consideration of the promises herein contained, has employed Dr. ‘Omer and Dr. Omer hereby accepts said employment as District Superintendent ofthe Halifax Area School District fora term commencing on August 4, 2017 and ending on ‘June 30, 2022 ("Term’) This Contract shall terminate immediately upon the expiration of the aforesaid ‘Term unless the Contract is sooner modified or terminated in accordance with this Contract or allowed to renew automaticaly In accordance with Section 1073(b) of the Public School Code or this Contract. ‘The District Superintendent represents that she possesses al of the qualifications that are required by law to serve as District Superintendent of Schools in the Commonwealth of Pennsyivania and that she will maintain the same throughout the term of this Contract. District Superintendent further agrees to subscribe to and fake the oath of office before entering upon her duties, in accordance with Section 1004 of the Public School Code. Paget or13 3. Authority of District and District Superintendent. ‘The Board of Schoo! Directors on its own behalf and on behalf ofthe electors of the District hereby retains and reserves unto ise, all powers, rights, authority, duties, and responsibilties conferred and vested init by the law and the Constitution ofthe ‘Commonwealth of Pennsylvania, limited only by tha express terms ofthis Contract. 4 ee Duties and Responsibilities, * oe ‘A. During the term ofthis Contract the District Suparintondent agrees to serve as Chief Administrator of the Schoo! District and Executive Officer forthe Board, {nd to perform tothe best of her ably the duties of the District Superintendent in a competent and professional manner in accordance with {he laws of the Commonwealth of Pennsylvania the District job description for the positon of Distict Superintendent (attached and incorporated into this Contract as Appendix A), the policies ofthe District, an the provisions ofthis Contract. The District Superintendent shall be charged with the administration ofthe schools under the direction ofthe Board of School Directors. B. The District Superintendent shall have a seat on the Board of School Directors {and the right to speak on all issues before the Board but shall not have the Fight to vote. The District Superintendent andior her designee shal have the Tight to attend alleguiar and special meetings of the Board and all committee meetings thereof, excepting those relating tothe Distict Superintendents own employment, and shall serve as advisor to the Board and its commitiees in all ‘matters affecting the District. The Board and its members individually shall prompt refer all ricisms, complaints and suggestions called to ls attention to the District Superintendent for study, disposition, or recommendation as is ‘appropriate. CC. The District Superintondont shall be responsible forthe total day-to-day ‘administration ofthe District subject to offially adopted policies ofthe Board, In the day-to-day operations ofthe Distt Board Members shall normally mit their direct contacts with the staf ofthe Distct, generally communicating through the District Superintendent or hor office staf. Nothing In this section shall preclude the right of Board Members to exercise thelr responsibilites as individuals in the areas of monitoring District operations, conducting oversight actives, speaking with employees, or visting schools, as set frth in Board policy or directed by the Board, .
