‘Agenda 6-16-14 tem 10.338 Approved: 616-14 Final: 6-16-14 ‘SUPERINTENDENT EMPLOYMENT AGREEMENT ‘This AGREEMENT is made by and between the Harrisburg School District (SCHOOL DISTRICT’) and Dr, Sybil Knight-Bumey (‘SUPERINTENDENT’). Recitals ‘The SCHOOL DISTRICT desires to appoint and employ the SUPERINTENDENT nimed herein as the SCHOOL DISTRICT'S superintendent. ‘The Board of School Directors of the District, at a regularly scheduled meeting, duly and properly called on the 16th day of June 2014, did reappoint SUPERINTENDENT to the office of Superintendent in accordance with the provisions of Sections 508, 1071, 1073 and 1073.1 of the Commonwealth of Pennsylvania's Public ‘School Code of 1949, as amended (hereinafler referred to as “Public School Code”) ‘The SUPERINTENDENT desires to accept said appointment and employment, ‘The SCHOOL DISTRICT and the SUPERINTENDENT intend to document the {ull and complete agreement governing the terms and conditions of said appointment and employment relationship between the SCHOOL DISTRICT and the ‘SUPERINTENDENT, Now, therefore, ia consideration of the foregoing premises, for good and valuable consideration, the receipt and sufficiency of which are hereby acknowledged, and intending to be legally bound, the parties agree as follows. Terms 1.0 Employment. 1.1 The SCHOOL DISTRICT hereby employs the SUPERINTENDENT and the SUPERINTENDENT hereby accepts such employment, all ‘upon the terms and conditions set forth below. 20 Duties of SUPERINTENDENT. 21 Job Assignment and Duties. The duties of the SUPERINTENDENT are generally described in: (a) applicable law; (b) as set forth on the job description attached hereto as Exhibit “A”; (c) as may be further determined by Agenda 616-4 Item 10.39 ‘Approved: 6-16-14 Final: 6-16-16 the Board of School Directors (the "SCHOOL BOARD") of the SCHOOL DISTRICT in ppolicy or regulations adopted by the SCHOOL BOARD; (8) in this AGREEMENT; ‘and/or (e) in motions or resolutions adopted at a public meeting by the SCHOOL, BOARD. The SUPERINTENDENT will at all times utilize her best efforts in fulfilling her duties under this AGREEMENT. 22 Additional Duties. ‘The SUPERINTENDENT shall perform such additional services and fulfil such additional duties and responsibilities as may be ‘mutually agreed upon by the SUPERINTENDENT and the SCHOOL BOARD. 23 Administration of Schools. ‘The administration of school policy, the operation and management of schools, and the direction of employees shall be through the SUPERINTENDENT. The parties agree that 23.1. The SUPERINTENDENT shall furnish recommendations to the SCHOOL. ROARD on all matters having to do with the selection, appointment, assignment, transfer, promotion, organization, reorganization, reduction or termination of personnel employed or engaged by the SCHOOL DISTRICT. 23.2 Duties and responsibilities in this AGREEMENT shall be performed and discharged by the SUPERINTENDENT or by her stlf under her ditection, 23.3. The SUPERINTENDENT shall be permitted to meet with the SCHOOL BOARD, and to participate at SCHOOL BOARD meetings and shall have the right to speak om all issues before the SCHOOL BOARD in accordance with applicable law. The SUPERINTENDENT shall have the right to attend all regular, special and executive session meetings of the SCHOOL BOARD and all committee meetings thereof, and shall serve as advisor to said committees on all maters affecting the SCHOOL DISTRICT, except where the SUPERINTENDENT'S puticipation i contrary to the privileges and exceptions existing under applicable law or where such participation, the SCHOOL BOARD'S sole, unreviewable discretion, is net appropriate, including, by way of illustration, matters pertaining to the performance, compensation o ‘evaluation of the SUPERINTENDENT. 234. The SUPERINTENDENT shall take discretionary ation in ‘any matters not covered by SCHOOL BOARD policy and report such actions 10 the SCHOOL BOARD with recommendations for policy as necessary in order to provide guidance forthe future, Agenda 6-16-14 tem 10.309 Approved: 6:16:14 Final: 6-16-14 235 Criticisms, complaints and suggestions called to the attention of the SCHOOL DISTRICT shall be referred to the SUPERINTENDENT for study, disposition or recommendation to the SCHOOL BOARD as appropriate, 23.6 The SCHOOL DISTRICT shall make no agreement with any other organization or individual that would improperly interfere with the SUPERINTENDENT'S carryng out of managerial, administrative or supervisory performance responsibilities ard general duties as defined in the position description for the SUPERINTENDENT. 2.3.7 The SUPERINTENDENT shall be responsible forthe total day-to-day administration of the SCHOOL DISTRICT, subject to officially adopted policies of the SCHOOL BOARD. All official contacts between members of the SCHOOL BOARD and the staff of the SCHOOL DISTRICT shall be through the SUPERINTENDENT. Nothing in this section 2.3 shall be construed to limit or preclude the right ofthe SCHOOL BOARD to exercise its collective responsibilities, as set forthe ‘SCHOOL BOARD policies or as otherwise directed by the SCHOOL BOARD. 24 Contractual Duties. The SUPERINTENDENT shall perform all
