Sec. 88. Public rally.

- Any political party or candidate shall notify the election registrar


concerned of any public rally said political party or candidate intends to organize and hold in
the city or municipality, and within seven working days thereafter submit to the election
registrar a statement of expenses incurred in connection therewith.

Sec. 89. Transportation, food and drinks. - It shall be unlawful for any candidate, political
party, organization, or any person to give or accept, free of charge, directly or indirectly,
transportation, food or drinks or things of value during the five hours before and after a public
meeting, on the day preceding the election, and on the day of the election; or to give or
contribute, directly or indirectly, money or things of value for such purpose.

Sec. 90. Comelec space. - The Commission shall procure space in at least one newspaper
of general circulation in every province or city: Provided, however, That in the absence of said
newspaper, publication shall be done in any other magazine or periodical in said province or
city, which shall be known as "Comelec Space" wherein candidates can announce their
candidacy. Said space shall be allocated, free of charge, equally and impartially by the
Commission among all candidates within the area in which the newspaper is circulated.

FOR NATIONAL CANDIDATES

Sec. 7 Affirmative Action by the COMELEC (RA 9006)

> Pursuant to Sec. 90 and 92 of the OEC, the COMELEC shall procure th print space upon
payment of just compensation from at least three (3) national newspapers of general
circulation wherein the candidates for national office can announce their candidacies.
> Such space shall be allocated for FREE OF CHARGE, EQUALLY AND IMPARTIALLY,
among all candidates for national office on three (3) different calendar days.
> 1st day within the 1st week of the Campaign Period
2nd day within the 5th week of the Campaign Period
3rd day within the 10th week of the Campaign Period
Sec. 8, COMELEC Space and Time (RA 9006)

> The COMELEC shall procure space in at least one (1) newspaper of general
circation and air time in at least one (1) major broadcasting station or entity in
every province or city: PROVIDED

-in the absence of said newspaper, publication shall be done in an other


magazines or periodical in said province or city.

> It shall be utilized exclusively by the COMELEC for public information


dissemination on election related concerns.

COMELEC may not compel print media to donate free “Comelec Space” for
dissemination of election information since it amounts to taking of private
property without just compensation and does not constitute a valid exercise of
police power. (Philippine Press Institute v. COMELEC, 244 SCRA 272, 1992)

The use of “COMELEC space” is personal to the candidate. He cannot


delegate or transfer the use to any other person.
