- refers to any person engaged in
domestic work within an employment
relationship such as, but not limited to,
the following: general househelp,
nursemaid or “yaya”, cook, gardener,
or laundry person, but shall exclude
any person who performs domestic
work only occasionally or sporadically
and not on an occupational basis.
- It shall be unlawful to employ ANY
PERSON BELOW FIFTEEN (15) YEARS
OF AGE as a domestic worker.
- An employer is any person who
ENGAGES and CONTROLS the services
of a kasambahay and is PARTY to the
Employment Contract.
An employer can hire
DIRECTLY or through PRIVATE
EMPLOYMENT AGENCIES (PEA)
registered with the DOLE regional
offices.
(a) Medical certificate or a health
certificate issued by a local
government health officer;
(b) Barangay and police
clearance;
(c) National Bureau of
Investigation (NBI) clearance; and
(c) National Bureau of Investigation
(NBI) clearance; and
(d) Duly authenticated birth
certificate or if not available, any other
document showing the age of the
domestic worker such as voter’s
identification card, baptismal record or
passport.
- It must obtain a LICENSE and
AUTHORITY TO RECRUIT from the
Regional Office of the DOLE having
jurisdiction over the place.
Employment agencies engage in
Recruitment Activities only through their
representative are:
(a) Duly Authorized to recruit; and
(b) Registered with the Regional
Office of the DOLE
Employment agencies submit to the DOLE
R.O. where recruitment was undertaken:
(a) the Names of the Recruits;
(b) Addresses;
(c) Birth Certificates;
(d) Medical Cerificates; and
(e) Recruitment Contract
Employment agencies should provide the
recruit with STAMPED ENVELOPE:
