ABSTRACT
Role of judiciary in protecting environment in India

Environment is not mine not yours it is ours and it is a duty to protect the environment while in
India judiciary has played its effective role in protecting the environment. In form of PIL (Public
interest and litigation) has played an effective role in protecting environment in India. Whether it
is about environment education or whether it is about harming environment judiciary has played
an important function to safeguard the environment. In case M.C Mehta V. Union of India 1 in
which court made a land mark judgement to remove environment illiteracy. Even in case M.C
Mehta V. Kamal Nath2 in which court held that basic environment elements like air, water cannot
be polluted. Judiciary has played a major role in protecting environment from trees, mining, stone
crushing to river everything is protected by the judiciary to protect the environment. Cases like
R.L. & E. Kendra, Dehradun v. State of U.P3, Ishwar Singh v. State of Haryana4, Indian Council
for Enviro-Legal Action v. Union of India5 and many cases in which court gave judgement to
protect the environment . In form of protection of environment National Green Tribunal has been
playing a major role to protect the environment from saving Yamuna River to increase in pollution
tribunal has been playing a major role to protect the environment.

Conclusion
Judiciary has played a major role in protecting environment, it has fulfill its duty to safeguard
environment.
