COMPLIANCE

COMES NOW the Petitioner by the undersigned Attorney and to the Honorable

Court, most respectfully asseverates that:

1. In a Resolution dated April 20, 2012, the Honorable Court observed from

infirmities in the petition such that: (1) the docket fees paid is short by

Php80.00; (2) petitioner failed to explain why the petition was filed by

registered mail; (3) Petitioner failed to show competent evidence of identity

in Verification/ Certification portion of the petition;

2. The Honorable Court directed the petitioner to rectify the foregoing infirmities

although the Court did not provide a time-frame within which petitioner was

to do so. The petitioner endeavoured to comply sooner however the records

of this case was misplaced in the law office and was recovered only in August

2012 thus the delay in this submission;

3. In compliance with the directive, petitioner is submitting a postal money

order in the amount of Php80.00 per Postal _______________ herewith

attached;

4. Also, petitioner on page 6 of his petition where the Verification/ Certification

can be found, has indicated under his computer-printed name his Senior

Citizen ID No. 000258;

5. Lastly, he begs the indulgence of the Honorable Court as he failed to state

that: “THE PETITION WAS FILED BY REGISTERED MAIL GIVEN THE

DISTANCE OF THE VENUE OF THE COURT IN CEBU CITY FROM THE OFFICE

OF THE UNDERSIGNED COUNSEL WHICH MAKES PERSONAL SERVICE

RATHER IMPRACTICABLE”;

6. With these submissions, the petitioner pleads that the merits of his petition

be taken into account and that his slight procedural lapse be overlooked to

yield to substantial justice.

PRAYER

WHEREFORE, premises considered, it is most respectfully prayed of the

Honorable Court that the instant Compliance be deemed compliant with the directive as

encapsulated in the Resolution of the Honorable Court dated April 20, 2012.

Other reliefs just and proper are also prayed for.
