Editorial : Bench Fixing by Government & Collegium

Both central government & state governments in india are the biggest litigants in the country.
Powers that be misuse laws and mete out gross injustices to citizens of india. To get their illegal
acts legalized , they select favorable candidates for the posts of police officers , magistrates ,
judges & other quasi judicial posts. Just recall VYAPAM , KPSC recruitment scams , etc.
These undeserving candidates selected does the bidding of the powers that be and dance to
their tunes. Even when a candidate is merited and of highest integrity he is not selected because
he will uphold law. In many instances Supreme Court Collegium & Government of India has
bypassed deserving judges for promotion to high courts & supreme court and appointed /
promoted tainted judges . Read the sample cases at following web pages. This is bench fixing /
Judge fixing amounting to violation of Indian Citzen’s Fundamental Rights as well as Human
Rights.
Supreme Court Collegium & Government of India must make public complete details of
Judges selected / promoted to High Courts & Supreme Court as well as details of persons
denied selection / promotion. This will minimize BENCH FIXING / JUDGE FIXING.

2. Question(s) of Law:
Why NOT transparency in selection / promotion of Judges to High Courts & Supreme Court of
India ? When a tainted judge presides in a court he will repeatedly mete out injustices to
thousands of victims for years throught his service. Is it not violation of RIGHT TO FAIR &
EQUITABLE JUSTICE ?

3. Grounds:
Requests for equitable justice. Prosecution of corrupt Judges & Corrupt Government of India
Ministers who have made undeserving judicial selection.

4. Averment:
Hereby , I do request the honorable supreme court of India to consider this as a PIL for : “writ of
Mandamus” and to issue instructions to the concerned public servants in the cases to perform
their duties.

PRAYER:
In the above premises, it is prayed that this Hon'ble Court may be pleased:

a . Hereby , I do request the honorable supreme court of India to consider this as a PIL for :
“writ of Mandamus” and to issue instructions to the concerned public servants , Union Cabinet
GOI & Supreme Court Collegium in the case to perform their duties.

b. To make public complete details of Judges who were selected / promoted to High Courts &
Supreme Court of India since last 20 years till date listing their achievements , eligibility factors.

c. In the same way to make public complete details of Judges who were not selected / denied
promotion to High Courts & Supreme Court of India since last 20 years till date listing their
ineligibility factors.

d . to pass such other orders and further orders as may be deemed necessary on the facts and in
the circumstances of the case.
