ARTICLE IX

UNION SECURITY

SECTION 9.1 All bargaining unit employees who, on the ratification date of the
Agreement, are members of the Union, and all employees who
voluntarily become members thereafter, shall, as a condition of
continued employment, maintain their membership in the Union in
good standing for the duration of this Agreement. Employees who
do not choose to join the Union shall begin paying a fair share fee –
to be determined by the Union, for the costs of representation, as a
condition of continued employment, to the Union within thirty (30)
days following the signing of this Agreement or date of hire,
whichever date occurs last. Any employee who is a member of the
Union may voluntarily withdraw from the Union by giving written
notice to the Union by certified mail within the last thirty (30) days
prior to the expiration date of this Agreement and shall pay the fair
share fee thereafter.

SECTION 9.2 Dues and fees deduction: The Employer shall provide for the semi-
monthly payroll deduction of union dues and fees, which are
uniformly applied to all members in the bargaining unit. Recognized
payroll deduction cards which are submitted to the Employer's
payroll officers by the 10th of the month will become effective on
the first day of the same month; those received by the 25th of the
month will become effective on the 16th day of the same month.
Upon issuance and transmission of a check to the Union, the
Employer's responsibility shall cease with respect to such
deductions. The Union and each employee authorizing the
assignment of wages for the payment of Union dues and fees
hereby undertakes to indemnify and hold the Employer harmless
against all claims, suits or other forms of liability that shall arise
against the Employer for, or on account of, any deduction made
from the wages of such employee.

9.2.1 The Union agrees to certify in writing promptly after this


Agreement becomes effective the current rate of Union dues
and service fees, if necessary. Thereafter, if the Union
changes its dues and service fees, it shall give the Board at
least thirty (30) days written notice of the change prior to
the first deduction at the changed rate.

9.2.2 Upon written request from the Union, to be made no more


frequently than once per year, the Employer shall provide to
the Union in writing a list showing the names of all
employees in the bargaining unit together with their
classification and current rate of pay.

9.2.3 The Employer shall remit to the Union monthly all bargaining
unit dues and fees deducted for that pay period. 

9.2.4 It is the responsibility of the Employer to provide the name
and schedule of the new hire to the Union within 15 days of
hire.

SECTION 9.3 The Union agrees to indemnify and save the Employer harmless
against any claim or liability arising out of the application of this
Article except for any claim or liability arising out of an error
committed by the Employer.
