JUDICIAL AFFIDAVIT OF WITNESS

LYANNIE HOPE G. AGERO-REDOBLADO

I, LYANNIE HOPE G. AGERO-REDOBLADO, of legal age,

Filipino, married to Tristan R. Redoblado, and a resident of Crispino
Subdivision, Quirino Ave., Digos City, Davao del Sur, Philippines,
states under oath, as follows:
PRELIMINARY STATEMENT

The person examining me is Atty. Rogelio M. Watin, Sr. with

office address at Jose Abad Santos Street, Digos City, Davao del Sur.
The examination is being held at the same address. I am answering
his questions fully conscious that I do so under oath and may face
criminal liability for false testimony and perjury.

OFFER OF EVIDENCE

Witness LYANNIE HOPE G. AGERO-REDOBLADO offers this

Judicial Affidavit to prove that:

a. The jurisdictional requirements of this Petition had been

complied with;
b. She is the petitioner and the registered owner of a parcel of
land covered by Transfer Certificate of Title No. 144-
2011001446 situated at Poblacion, Digos City, Davao del
Sur;
c. There appears a five-year lien on the face of the title of the
said property;
d. The original patentee or his heirs failed to exercise their
right to repurchase the subject property within five (5)
years from the registered owner; and
e. To prove all other matters necessary and consistent with his
prayer in this petition.
1. QUESTION: Are you the same LYANNIE HOPE G. AGERO-
REDOBLADO who is the petitioner in this case?

ANSWER: Yes, Sir.

2. QUESTION: Would you know if the Petition had complied with

the jurisdictional requirements?

ANSWER: Yes Sir. There is a Certification issued by the Process

Server alleging that the Notice of Hearing dated March 17,
2017 was posted in three (3) conspicuous places;

3. QUESTION: I would like to show you a copy of the Certification

dated March 30, 2017 (in the Court’s record), would you
kindly go over the same and tell me if this is the same
Certification you mentioned a while ago?

ANSWER: Yes, Sir. That is the Certification.

4. QUESTION: I am marking this Certification as Exhibit “A” to

form part of your Judicial Affidavit. Do you confirm my action?

ANSWER: Yes, Sir.

5. QUESTION: I am showing to you a Notice of Hearing dated

March 17, 2017 (in the Court’s record), would you please
tell me if this is the same Notice of Hearing you mentioned
earlier?

ANSWER: Yes, Sir. That is the Notice of Hearing.

6. QUESTION: I am marking this Notice of Hearing as Exhibit

“B” to form part of your Judicial Affidavit. Do you confirm my
action?

ANSWER: Yes, Sir.

7. QUESTION: I would like to show you a copy of the Petition

dated March 15, 2017 (in the Court’s record), would you go
over the same and tell me if this is the Petition you filed?

ANSWER: Yes, Sir.

8. QUESTION: Below the 2nd and 3 rd page of this Petition there

appears a signature. Do you know whose signature is this?

ANSWER: Yes, Sir. That is my signature.

9. QUESTION: I am marking this Petition as Exhibit “C” and

the Signatures thereof as Exhibit “C-1” & “C-2” to form
part of your Judicial Affidavit. Do you confirm my action?

ANSWER: Yes, Sir.

10. QUESTION: Now, do you know the property embraced in

and covered by Transfer Certificate of Title No. 144-
2011001446 situated at Poblacion, Digos City, Davao del Sur?
 ANSWER: Yes Sir. I am the registered owner of that property.

11. QUESTION: I would like to show you a certified true copy

of Transfer Certificate of Title No. 144-2011001446, would you
kindly go over the same and tell me whether you are referring
to the same title number which you mentioned a while ago?
ANSWER: Yes, Sir. That is the certified true copy of the title
subject in this case

12. QUESTION: I am marking this certified true copy of TCT

No. 144-2011001446 as Exhibit “D” and I am attaching
this to your Judicial Affidavit to form part of it. Do you confirm
my action?
ANSWER: Yes, Sir.

13. QUESTION: You said that you are the registered owner of
a parcel of land covered by Transfer Certificate of Title No. 144-
2011001446, could you inform the Court if the said title bears
any annotation?
ANSWER: Yes, it has annotation Sir which states: “This lot is
primarily for Agricultural purposes as Certified by the
registered owner pursuant to LRC Circular No. 301. (Note:
Annotation is carried over from TCT No. T-51905)
“The right of repurchase by the original patentee or heirs
within a period of five years (5) from the date of conveyance,
April 19, 1995, pursuant to the provisions of Section 119, Act
No. 141, as amended.” (Note: Lien is carried over from TCT
No. T-51905)

14. QUESTION: Since you bought the land and transferred it

to your name last September 14, 2011, was there anyone
exercising the right to repurchase?
ANSWER: None, Sir.

15. QUESTION: Do you have proof that the original copy of

the title is still intact and existing?
ANSWER: Yes, Sir. The Office of the Register of Deeds issued a
certification to that effect.

16. QUESTION: I am marking this Certification dated

March 13, 2017 issued by the Register of Deeds as Exhibit
“E” to form part of your Judicial Affidavit. Do you confirm my
action?
ANSWER: Yes, Sir.

17. QUESTION: Do you know of a case of recovery of

possession or ownership involving the land covered by Transfer
Certificate of Title No. 144-2011001446?
ANSWER: No, Sir.

18. QUESTION: Do you have proof to that?

 ANSWER: Yes, Sir. There is a Certification from the Office of the
Clerk of Court, Regional Trial Court which states, among
others, that TCT No. 144-2011001446 has no case of recovery
of possession or ownership.

19. QUESTION: I am marking the Certification from the

Office of the Clerk of Court as Exhibit “F” to form part of your
Judicial Affidavit. Do you confirm my action?

ANSWER: Yes, Sir.

20. QUESTION: What is now your prayer to the Honorable

Court?

ANSWER: I want the Court to issue an Order directing the

Registrar of Deeds of Davao del Sur to cancel the annotation of
the Five Year lien appearing on the face of Transfer Certificate
of Title No. 144-2011001446.

21. QUESTION: I have no more questions to ask you in

connection with this Petition. Are you willing to sign this
Judicial Affidavit in attestation of the truth thereof?

ANSWER: Yes, Sir.
