1. Does Uber Technologies Inc., (Company) control the selection and hiring of its drivers?

Please
expound you answer.

-Yes, Uber has control of how they select their drivers. This is because of the existence of the circular of
LTFRB which requires Uber to select their drivers in compliance with the circular. Due to this, not
everyone can easily become an UBER driver, since, LTFRB requires that all of them possess a Driver’s
License and possess the ability to read and write Filipino and English language. This qualifications
itself is sufficient to show that their drivers are competent and can communicate with their passengers
if needed. Whether they are locals or foreigners.

2. Does the Company have control over the routes which must be taken by its drivers? Please
expound you answer.

-Yes, The routes used by the drivers are controlled by UBER. The scope of the drivers service area is
limited only to metro manila. But, the drivers themselves has the discretion on whether they would
accept a trip outside metro manila or not, depending on the agreement between the driver and the
passengers. But most of the time, The Drivers won’t agree outside of their scope area because of loss
of gas and time.

3. Does the Company have control over the selection of passengers? Please expound you answer.

-No, Uber has no control on the selection of their passengers. Once the driver is booked by the rider,
The driver may not cancel the ride, otherwise, they will be sanctioned by the Company. However, if the
passenger is not present in the pickup location for a period of time the Driver can cancel the booking
and a cancellation fee will be charged to the passenger and paid to the driver.

4. Does the Company exercise the power to terminate its drivers and impose sanctions? Please
expound you answer.

-Yes, The company can terminate and impose sanctions to its drivers. This is exercised by depriving the
drivers access to the system which prevents them from accepting request for trips. The reasons on why
a driver is penalized by this is usually because of canceling too many rides, violation of code of
conduct, unsafe driving, expiration of documents or failing a background check.

5. Do Uber drivers form an integral part of the operations and business of the Company? Please
expound you answer.

-Yes, The Uber drivers are necessary for the operation and business of the company. UBER is a
company widely known as a transportation business, hence, the employment of the drivers is
necessary in order for the company to function and operate its business in the Philippines. Without the
drivers the company would be crippled and lose their purpose as a transportation business.

6. Do you think Uber drivers must be extended the same rights as that of regular taxi drivers? Why
or why not?

-Yes, the Uber drivers should have the same rights that regular taxi drivers possess. Since, both are
part of the transportation business ,hence, Uber drivers should also be considered as regular
employees, since, the only difference between them is how the transportation business is conducted.
