2) There are two witnesses (A2) and (A3) testified on the alleged incident.
3) Based on the fingerprint report dated 8/3/2017 (D1), the fingerprint that was found at
D11 belonged to B1.
4) The evidences such as the victim’s cloth (D4), victim’s trousers (D5), victim’s bra (D6),
victim’s panty (D7) and victim’s scarf (D8) which were worn during the incident were
sent to the Chemistry Department for DNA test.
5) The chemical report dated 10/3/2017 (D3A) found that the DNA found on on (D8), (D5)
and (D7) were matched with the semen sample from (B1) found on the (B1)’s shirt (D9)
and (B1)’s trousers (D10).
6) The medical report dated 7/3/2017 (D2A) from Hospital Selayang confirmed that (A1)
had injury on her vagina.
Based on the adduced evidences, I found that (B1) had committed the offence of rape against
(A1) can be prosecuted under section 376 of the Penal Code.

CRIMINAL PROCEDURE CODE
(a) of the commission of or the intention of any other person to commit any offence punishable
under the following sections of the Penal Code: 121, 121a, 121b, 121c, 122, 123, 124, 125, 126,
130, 143, 144, 145, 147, 148, 302, 304, 307, 308, 363, 364, 365, 366, 367, 368, 369, 372, 372a,
372b, 376, 376b, 377c, 377ca, 377e, 382, 384, 385, 386, 387, 388, 389, 392, 393, 394, 395, 396,
397, 399, 402, 435, 436, 449, 450, 456, 457, 458, 459, and 460; or
(b) of any sudden or unnatural death or death by violence or of any death under suspicious
circumstances, or of the body of any person being found dead without its being known how that
person came by death, shall in the absence of reasonable excuse, the burden of proving which
shall lie upon the person so aware, immediately give information to the officer in charge of the
nearest police station or to a police officer or the nearest penghulu of the commission or
intention or of the sudden, unnatural or violent death or of the finding of the dead body, as the
case may be.
(2) If any person discovers any dead body and he has reason to believe that the deceased met
with his death through an unlawful act or omission he shall not remove or in any way alter the
position of the body except so far as is necessary for its safety.
Information of offences
107. (1) Every information relating to the commission of an offence, if given orally to an officer in
charge of a police station, shall be reduced to writing by him or under his direction and be read over to
the informant.
(2) Every such information shall be entered in a book to be kept by that officer, who shall append to
such entry the date and hour on which that information was given, and whether given in writing or
reduced to writing as aforesaid shall be signed by the person giving it.
(3) (a) Notwithstanding subsection (1), information given by a person relating to the commission of
an offence to a police officer, who at the time of receiving the information is not in a police station, shall
be deemed to be received at a police station.
(b) A police officer receiving such information under paragraph (a) where practicable shall
record or cause to be recorded the name and address of the informant, the date and time of the receipt
of such information, and shall convey such information to an officer in charge of a police station or any
police officer whose duty is to receive such information.
(c) such information shall be reduced to writing and entered in a book in accordance with
subsections (1) and (2) and shall subsequently be signed by the person who gave the information.
(4) A police officer shall be duty bound to receive any information in relation to any offence committed
anywhere in Malaysia.
PENAL CODE
Rape
375. A man is said to commit “rape” who, except in the case hereinafter excepted, has sexual
intercourse with a woman under circumstances falling under any of the following descriptions:
(c) with her consent, when her consent has been obtained by putting her in fear of death or hurt
to herself or any other person, or obtained under a misconception of fact and the man knows or
has reason to believe that the consent was given in consequence of such misconception;
(d) with her consent, when the man knows that he is not her husband, and her consent is given
because she believes that he is another man to whom she is or believes herself to be lawfully
married or to whom she would consent;
(e) with her consent, when, at the time of giving such consent, she is unable to understand the
nature and consequences of that to which she gives consent;
(f) with her consent, when the consent is obtained by using his position of authority over her or
because of professional relationship or other relationship of trust in relation to her; (g) with or
without her consent, when she is under sixteen years of age.
Exception—Sexual intercourse by a man with his own wife by a marriage which is valid under any
written law for the time being in force, or is recognized in Malaysia as valid, is not rape.
(a) living separately from her husband under a decree of judicial separation or a decree
nisi not made absolute; or
(b) who has obtained an injunction restraining her husband from having sexual
intercourse with her, shall be deemed not to be his wife for the purposes of this section.
Explanation 2—A Muslim woman living separately from her husband during the period of ‘iddah, which
shall be calculated in accordance with Hukum Syara’, shall be deemed not to be his wife for the
purposes of this section.
376. (1) Subject to subsections (2), (3) and (4), whoever commits rape shall be punished with
imprisonment for a term which may extend to twenty years, and shall also be liable to whipping.
(2) Whoever commits rape on a woman under any of the following circumstances:
(a) at the time of, or immediately before or after the commission of the offence, causes hurt to
her or to any other person
(b) at the time of, or immediately before or after the commission of the offence, puts her in fear
of death or hurt to herself or any other person;
(c) the offence was committed in the company of or in the presence of any other person;
(d) without her consent, when she is under sixteen years of age;
(e) with or without her consent, when she is under twelve years of age;
(f) with her consent, when the consent is obtained by using his position of authority over her or
because of professional relationship or other relationship of trust in relation to her;
(h) when by reason or on occasion of the rape, the woman becomes insane;
(i) when he knows that he is afflicted with the Human Immuno-Deficiency Virus (HIV)/Acquired
Immune Deficiency Syndrome (AIDS) or any other sexually transmissible disease and the virus or
disease is or may be transmitted to the woman;
(j) when by reason or on occasion of the rape, the woman commits suicide; or
(k) when he knew of the mental disability, emotional disorder or physical handicap of the
woman at the time of the commission of the crime, shall be punished with imprisonment for a
term of not less than ten years and not more than thirty years and shall also be liable to
whipping.
(3) Whoever commits rape on a woman whose relationship to him is such that he is not permitted
under the law, religion, custom or usage, to marry her, shall be punished with imprisonment for a term
of not less than eight years and not more than thirty years, and shall also be punished with hipping of
not less than ten strokes.
(4) Whoever whilst committing or attempting to commit rape causes the death of the woman on whom
the rape is committed or attempted shall be punished with death or imprisonment for a term of not less
than fifteen years and not more than thirty years, and shall also be punished with whipping of not less
than ten strokes.

IO Insp.G56789 Nik Hendon binti Nik Mohamad dan Insp. Wan Rashidi bin Wan Sulaiman.
Suspek pada waktu itu berada di ruang tamu rumah bersama-sama dengan dua orang rakannya.
Saya memberitahu sebab dia ditangkap dan haknya sebagai orang yang ditangkap. Saya dan Insp.
Rogayah membawa suspek ke balai dan suspek dimasukkan ke dalam lokap pada jam 1200hrs.

107A. (1) Any person who has given information under section 107 may request for a report on the
status of the investigation of the offence complained of in his information from the officer in charge of a
police station where he gave the information.
(2) The officer in charge of a police station shall give a status report on the investigation of such offence
to the informant not later than two weeks from the receipt of the request made under subsection (1).
(3) Notwithstanding subsection (2), no officer in charge of a police station shall be required to provide a
status report on an investigation of an offence—
(b) unless a period of four weeks has lapsed from the date of the giving of the information under
section 107; and
(c) which contains any matter that is likely to adversely affect the investigation into the offence
or the prosecution of the offence.
(4) Where a request has been made under subsection (1) and the officer in charge of the police station
has failed to furnish the informant with a status report within the period specified in subsection (2), but
subject to subsection (3), the informant may make a report to the Public Prosecutor of the failure.
(5) Upon receipt of the report under subsection (4), the Public Prosecutor shall direct the Officer in
charge of the Police District to furnish him with a detailed status report on the investigation that has
been conducted by the police in relation to the offence in the information given by the informant.
(6) The Public Prosecutor shall cause to be furnished to the informant, or direct the Officer in charge of
the Police District to furnish to the informant, a status report containing such information as may be
directed by the Public prosecutor.
110. (1) If from information received or otherwise a police officer not below the rank of Sergeant or an
officer in charge of a police station has reason to suspect the commission of a seizable offence he shall,
unless the offence is of a character which the Public Prosecutor has directed need not be reported to
him, immediately send a report of the same to the Public Prosecutor, and shall proceed in person or
shall depute one of his subordinate officers to proceed to the spot to inquire into the facts and
circumstances of the case and to take such measures as may be necessary for the discovery and, where
not inexpedient, arrest of the offender:
Provided as follows-
(a) When any information as to the commission of any such offence is given against any person
by name and the case is not of a serious nature the police officer receiving the same need
not proceed in person or depute a subordinate officer to make an inquiry on the spot;
(b) If it appears to the police officer receiving the information that there is no sufficient ground
for proceeding or further proceeding in the matter he shall not do so.
(2) In each of the cases mentioned in paragraphs (a) and (b) the police officer receiving the
information shall state in his said report, if any, his reasons for not fully complying with
subsection (1).
(3) Where a police officer exercises the power of deputation given by subsection (1) the
subordinate officer so deputed shall not be entitled to use any of the powers given by sections
111, 112, 116 and 117.
111. (1) A police officer making an investigation under this Chapter may by order in writing require the
attendance before himself of any person who from the information given or otherwise appears to be
acquainted with the circumstances of the case, and that person shall attend as so required.
(2) If any such person refuses to attend as so required that police officer may report such refusal to a
Magistrate who may thereupon in his discretion issue a warrant to secure the attendance of that person
as required by such order.
112. (1) A police officer making a police investigation under this Chapter may examine orally any person
supposed to be acquainted with the facts and circumstances of the case and shall reduce into writing
any statement made by the person so examined.
(2) Such person shall be bound to answer all questions relating to the case put to him by that officer:
Provided that such person may refuse to answer any question the answer to which would have a
tendency to expose him to a criminal charge or penalty or forfeiture.
(3) A person making a statement under this section shall be legally bound to state the truth, whether or
not such statement is made wholly or partly in answer to questions.
(4) A police officer examining a person under subsection (1) shall first inform that person of the
provisions of subsections (2) and (3).
(5) A statement made by any person under this section shall, whenever possible, be taken down in
writing and signed by the person making it or affixed with his thumbprint as the case may be, after it has
been read to him in the language in which he made it and after he has been given an opportunity to
make any corrections he may wish.

174. Whoever, being legally bound to attend in person or by an agent at a certain place and time in
obedience to a summons, notice, order, or proclamation, proceeding from any public servant legally
competent, as such public servant, to issue the same, intentionally omits to attend at that place or time,
or departs from the place where he is bound to attend before the time at which it is lawful for him to
depart, shall be punished with imprisonment for a term which may extend to one month or with fine
which may extend to one thousand ringgit or with both; or, if the summons, notice, order or
proclamation is to attend in person or by agent before a Court, with imprisonment for a term which may
extend to six months or with fine which may extend to two thousand ringgit or with both.
ILLUSTRATIONS
(a) A, being legally bound to appear before the High Court at Kuala Lumpur, in obedience to a
subpoena issuing from that Court, intentionally omits to appear. A has committed the offence
defined in this section.
Omission to give notice or information to a public servant by a person legally bound to give notice or
information
176. Whoever, being legally bound to give any notice or to furnish information on any subject to any
public servant, as such, intentionally omits to give such notice or to furnish such information in the
manner and at the time required by law, shall be punished with imprisonment for a term which may
extend to one month or with fine which may extend to one thousand ringgit or with both; or, if the
notice or information required to be given respects the commission of an offence, or is required for the
purpose of preventing the commission of an offence or in order to the apprehension of an offender,
with imprisonment for a term which may extend to six months or with fine which may extend to two
thousand ringgit or with both * and in relation to offences under Chapter VIB, with imprisonment for a
term which may extend to seven years, or with fine, or with both.
177. Whoever, being legally bound to furnish information on any subject to any public servant, as such,
furnishes, as true, information on the subject which he knows or has reason to believe to be false, shall
be punished with imprisonment for a term which may extend to six months or with fine which may
extend to two thousand ringgit or with both; or, if the information which he is legally bound to furnish
respects the commission of an offence, or is required for the purpose of preventing the commission of
an offence or in order to the apprehension of an offender, with imprisonment for a term which may
extend to two years or with fine or with both.
ILLUSTRATIONS
(a) A, a landholder, knowing of the commission of a murder, within the limits of his estate,
wilfully misinforms the police of the district that the death has occurred by accident in
consequence of the bite of a snake. A is guilty of the offence defined in this section.
(b) A, a police officer, or Penghulu, knowing that a considerable body of strangers has passed
through his village in order to commit a gang-robbery in the house of Z, a wealthy merchant
residing in a neighbouring place, and being bound to give information of the above to his
superior officer, wilfully misinforms the officer that a body of suspicious characters passed
through the village with a view to commit a gang-robbery in a certain distant place in a different
direction. Here A is guilty of the offence defined in this section.
Explanation—In section 176 and in this section the word “offence” includes any act committed
at any place out of Malaysia, which if committed in Malaysia would be punishable under any of
the following sections, namely, 302, 304, 382, 392, 393, 394, 395, 396, 397, 399, 402, 435, 436,
449, 450, 457, 458, 459 and 460, and the word “offender” includes any person who is alleged to
have been guilty of any such act.
179. Whoever, being legally bound to state the truth on any subject to any public servant, refuses to
answer any question demanded of him touching that subject by such public servant, in the exercise of
the legal powers of such public servant, shall be punished with imprisonment for a term which may
extend to six months or with fine which may extend to two thousand ringgit or with both.
180. Whoever refuses to sign any statement made by him, when required to sign that statement by a
public servant legally competent to require that he shall sign that statement, shall be punished with
imprisonment for a term which may extend to three months or with fine which may extend to one
thousand ringgit or with both.
False information, with intent to cause a public servant to use his lawful power to the injury of
another person
182. Whoever gives to any public servant any information orally or in writing which he knows or
believes to be false, intending thereby to cause, or knowing it to be likely that he will thereby cause,
such public servant to use the lawful power of such public servant to the injury or annoyance of any
person, or to do or omit anything which such public servant ought not to do or omit if the true state of
facts respecting which such information is given were known by him, shall be punished with
imprisonment for a term which may extend to six months or with fine which may extend to two
thousand ringgit or with both.
ILLUSTRATIONS
(a) A informs the Inspector General of Police that Z, a police officer subordinate to the Inspector
General, has been guilty of neglect of duty or misconduct, knowing such information to be false,
and knowing it to be likely that the information will cause the Inspector General to commence
disciplinary proceedings against Z. A has committed the offence defined in this section.
(b) A falsely informs a public servant that Z has contraband opium in a secret place, knowing
such information to be false, and knowing that it is likely that the consequence of the
information will be a search of Z’s premises, attended with annoyance to Z. A has committed the
offence defined in this section.
(c) A falsely informs a policeman that he has been assaulted and robbed in the neighbourhood
of a particular village. He does not mention the name of any person as one of his assailants but
knows it to be likely that in consequence of this information the police will make inquiries and

5.(1) No person shall be deprived of his life or personal liberty save in accordance with law.
(2) Where complaint is made to a High Court or any judge thereof that a person is being unlawfully
detained the court shall inquire into the complaint and, unless satisfied that the detention is lawful,
shall order him to be produced before the court and release him
(3) Where a person is arrested he shall be informed as soon as may be of the grounds of his arrest
and shall be allowed to consult and be defended by a legal practitioner of his choice.
(4) Where a person is arrested and not released he shall without unreasonable delay, and in any
case within twenty-four hours (excluding the time of any necessary journey) be produced before a
magistrate and shall not be further detained in custody without the magistrate’s authority:
Provided that this Clause shall not apply to the arrest or detention of any person under the
existing law relating to restricted residence, and all the provisions of this Clause shall be deemed

15. (1) In making an arrest the police officer or other person making the same shall actually touch
or confine the body of the person to be arrested unless there is a submission to the custody by word
or action.
(2) If such person forcibly resists the endeavour to arrest him or attempts to evade the arrest such
officer or other person may use all means necessary to effect the arrest.
(3) Nothing in this section gives a right to cause the death of a person who is not accused of an

(a) any person who has been concerned in any offence committed anywhere in Malaysia

diary hereinafter prescribed relating to the case and shall at the same time produce the accused
(2) The Magistrate before whom an accused person is produced under this section may, whether
he has or has no jurisdiction to try the case, authorize the detention of the accused in such custody

(a) if the offence which is being investigated is punishable with imprisonment of less than
fourteen years, the detention shall not be more than four days on the first application
and shall not be more than three days on the second application; or
(b) if the offence which is being investigated is punishable with death or imprisonment of
fourteen years or more, the detention shall not be more than seven days on the first
application and shall not be more than seven days on the second application.
(3)The officer making the investigation shall state in the copy of the entries in the diary referred
to in subsection (1), any period of detention of the accused immediately prior to the application,

Tuan,
Saya mengfailkan kes ini di bawah Seksyen 375 Kanun Keseksaan kepada tuan.
2. Pengadu merupakan seorang perempuan berumur 28 tahun dan bekerja sebagai kerani di
sebuah sebuah universiti swasta yang berdekatan. Pada 6/3/2017, lebih kurang jam 7.45 petang,
pengadu bersama teman lelakinya iaitu Senin bin Selasa (B1), telah keluar mengambil angin
malam bersama di sungai pusu, Gombak. Pada ketika itu, pengadu memakai pakaian kasual iaitu
sehelai baju blaus beserta seluar jean.
3. Ketika tiba di sungai pusu, teman lelaki pengadu mengeluarkan tikar untuk dibentangkan
di hadapan kaki sungai tersebut yang mana keadaan di situ agak sunyi dan tidak ramai pengunjung
yang berada di situ. Pengadu merasakan itu adalah perkara normal yang dilakukan oleh teman
lelakinya ketika keluar mengambil angin. Beberapa lama kemudian, teman lelaki pengadu cuba
untuk memegang tangan pengadu dan ingin mencium pengadu. Tetapi, pengadu enggan untuk
melakukan perkara itu kerana merasakan tidak selesa dan tidak sopan.
4. Isnin(B1) tetap memaksa pengadu untuk menuruti kehendaknya dan telah menanggalkan
baju pengadu dengan kasar. Apabila pengadu cuba untuk melawan Isnin(B1), pengadu ditampar
berkali-kali sehingga pengadu tidak mampu untuk berbuat apa-apa kerana pengadu berada dalam
keadaan lemah. Isnin(B1) kemudian memasukkan alat sulitnya ke dalam kemaluan pengadu dan
merogol pengadu secara kasar.
5. Saya mencadangkan bahawa B1 disabitkan dengan kesalahan rogol di bawah Seksyen 375
Kanun Keseksaan.

Saya, ANGELINA TAN (NO K/P: 891220-04-5676), Ahli Kimia dalam Perkhidmatan Kerajaan
Malaysia, dengan ini memperakui bahawa pada pukul 10.40 pagi pada 7 MAC 2017 telah
diserahkan kepada saya oleh INSP. G56789 Nik Hendon bin Nik Mohamad sebanyak empat
ekshibit.
Setelah dianalisis, saya mendapati bahawa ekshibit yang bertanda C dan D menunjukkan kesan
kehadiran air mani.
Saya telah menjalankan analisis DNA ke atas kesan air mani pada sampel-sampel di atas dan
keputusan analisis DNA seperti berikut:
1. Profil DNA yang diperolehi daripada kesan air mani pada baju berwarna putih yang
bertanda ‘A’ berlabel (Maria Melati Binti Deraman) dan kesan air mani dari seluar
dalam bertanda ‘B’ adalah berpadanan antara satu sama lain dan berpadanan pada
sampel air mani bertanda ‘C’ berlabel (Remy Ibrahim Bin Ishak) menunjukkan
bahawa DNA yang dikenalpasti berasal dari sumber yang sama.
