THIS SETTLEMENT AGREEMENT (“Agreement”) dated this Bay of Nove mach 2017, by and between the ONONDAGA COUNTY SHERIFF'S OFFICE (“Employer”), the DEPUTY SHERIFF'S BENEVOLENT ASSOCIATION. (DSBA”), and Grievant, DEPUTY SHERIFF LIEUTENANT JAMES R. RAUS (“Lt. Raus”). WHEREAS, i. es eC‘ 7 WEES, eC WHEREAS, the parties agreed to submit the issue of the “make whole” remedy owed to Lt, Raus to PERB Arbitretor Clifford Donn and PERB Arbitrator Donn issued a Decision in that regard dated September 26, 2017. NOW, THEREFORE, the parties agree as follows: 1. The Employer agrees to pay Lt, Raus the following less applicable Federal and New York State withholdings: A. $62,100.00 for loss of overtime; B. $1,055.38 for loss of shift differential pay; C. $513.04 for loss of holiday premium pay; and D. $8,625.00 for loss of use of take home vehicle. 2. The parties agree that the above amounts outlined in paragraph “1” represent a total of $72,293.42 owed to Lt. Raus by the Employer, less applicable withholdings, and said amountMaer is in fll satisfaton of the “make whole” remedy owed to Lt, Reus pursuant to the Arbitrator Donn Decision dated September 26, 2017. _ 3. The Employer agrees to process payment to Lt. Raus forthwith and will make its best effort to do so on or before December 31, 2017.
