The appellant named Mr. Berman in his brief and reply brief as having misled the district

court by direct lie and lie by omission in the Fairness Hearing. That name was incorrect

and Mr. Friedman's name should be substituted as the transcript shows. A bar complaint

was withdrawn against Mr. Berman today with a copy sent to him. A bar complaint was

filed against Mr. Friedman today instead. Please note the name substitution change. My

apologies to Mr. Berman and the Court.
