COMPLAINT – AFFIDAVIT
I, Hetty Spaghetti, Filipino, of legal age, and with residence at 123 Bida ang Saya St., Jollibee,
Legazpi City, after having been duly sworn and in accordance with law, hereby depose and state that:
(1) This complaint – affidavit filed is to charge Ronald McDonald, Filipino, of legal age, and with
residence at 345 Love ko 'to St., McDonald's, Legazpi City of Rape, found under Art. 266 of the Revised
Penal Code, committed as follows:
(a) That on April 1, 2018, around 2:30 in the morning, I texted my officemate, Ronald
McDonald (Ronald) if I could carpool with him going home as our shifts were ending at
the same time and we lived only one street apart. Ronald agreed.
(b) At around 3:15 in the morning, Ronald and I met at the parking lot of the office. After
we got in the car, he offered me a drink from a McDonald's cup, which to me looked like
Coca – Cola.
(c) I sipped from the cup three times, after which I started to feel lightheaded and sleepy.
A few minutes after, I noticed that Ronald was plying a different route from that which
would lead to our neighborhood. I asked him where he was going and he said that he was
just going to drop by 7 Eleven before going home.
(d) I felt the car come to a halt. When I looked out the window we were in an empty lot
with no surrounding houses, no street lights, and very tall grass. I passed out.
(e) As I came to, I felt Ronald carrying me out of the car, laying me down on grass, and
unbuttoning my shirt. I could not move my body, and I could not scream for help because
I felt very drowsy. I passed out again.
(f) I woke up in the morning, under the scorching heat of the sun, with no panties and
pants on, and with my vagina terribly hurting. Ronald was nowhere within sight.
(g) That after waking up, I waited by the roadside and hailed a passing car and asked them
to bring me to the nearest police station.
(2) Upon reaching the police station, I went to the women's desk, and reported the crime
committed by Ronald against my person. The police took my sworn statement, a copy of which is
attached and made integral hereof as "Annex A". I was then examined by a medico-legal officer,
the report of which is also attached and made integral hereof as "Annex B".
(3) That as of two days ago, a formal complaint has not been filed by the police with the Office of
the City Prosecutor on my behalf. Due to this, I am personally filing this formal complaint.
(4) Based on the foregoing, respondent Ronald McDonald committed the crime of Rape under
Art. 266 of the Revised Penal Code. He had sexual intercourse with me while I was unconscious
after having drugged me.
