The Grand Jury charges:
FIRST COUNT:

Between on or about March 8,2017 and on or about September 9, 2017, within the District

of Columbia, Derek B. Tumer, also known as Fats, Marshay Hazelwood, also known as Shay,

Ronnika M. Jennings, also known as Nik, also known as Sis, and Duan Hill, also known as Smiley,

also known as Smile-Dog, and a person whose identity is known to the Grand Jury, did unlawfully,

knowingly and intentionally combine, conspire, confederate and agree together to obstructjustice.

(Conspiracy in violation of22 D.C. Code, Sections 1805a (2001 ed.))

Obiect of the Consoiracy

The object of the conspiracy was to corruptly impede the due administration ofjustice in

the case of U.S. v. Derek Tumer, 1:17+r-055 (CRC) (D.D.C), in which Derek B. Tumer, also

known as Fats, was charged with a federal firearms offense, and in the process comrptly impede

an investigation into the homicide of Andrew McPhatter on March 1,2017 in Washington, D.C.,

by 1) having Marshay Hazelwood, also known as Shay, or another person provide an account in

an official proceeding that would falsely claim criminal responsibility for the possession of the

firearm that Derek B. Turner, also known as Fats, was charged with possessing, and 2) to

unlawfrrlly access, obtain and use criminal intelligence contained in secure databases maintained

by the Metropolitan Police Department C'MPD'), for the purpose of educating and informing

members of the conspiracy in their endeavors to impede the due administration ofjustice in the

case of U.s. v. Derek Tumer. 1:17-cr-055 (CRC) (D.D.C), and the investigation into the homicide

of Andrew McPhatter on March 1, 2017 in Washington, D.C.

 Backsround

1) At all times relevant to the conspiracy, Derek B. Tumer, also known as Fats, was a

member ofa street gang associated with the neighborhood ofWahler Plase in Southeast

Washington D.C. ("Wahler Place"), and the Wahler Place street gang was engaged in

a feud with a street gang associated with the neighborhood ofTrenton Park in Southeast

Washington D.C. ('Trenton Park").

2) At all times relevant to the conspiracy, a person whose identity is known to the Grand

Jury, and who is referred to in the Background and Overt Acts sections of this

indictment as "Unindicted Co-Conspiralor No. 1," was a close associate of Derek B.

Turner, also known as Fats, and a member of a street gang associated with Wahler

Place, which was engaged in a feud with a street gang associated with Trenton Park.

3) At all times relevant to the conspiracy, Marshay Hazelwood, also known as Shay, was

the girlfriend and the mother of a child of Derek B. Tumer, also known as Fats, and

was employed as a security guard at a housing complex in Southeast Washington, D.C.

4) At all times relevant to the conspiracy, Ronnika M. Jennings, also known as Nik, also

known as Sis, resided in the neighborhood of Barry Farm in Southeast Washington

D.C. ("Barry Farm" or "the Farms") and was a civilian employee of MPD in the police

district where Wahler Place, Trenton Park and Barry Farm are located. In her role as

a station clerk she had access through a password-restricted account to confidential

criminal intelligence maintained ir secure databases known as WALES, NCIC and

Cobalt, and also was so positioned as to be able to monitor police radio

communications in real time. At no time relevant to the conspiracy, or before or after,

did MPD civilian employee Ronnika M. Jennings, also known as Nik, also known as

Sis, have any official or legitimate role or responsibilities in the investigation of any

crime ofviolence arising out ofthe feud between Wahler Place and Trenton Park.

s) At all times relevant to the conspiracy, Duan Hill, also known as Smiley, also known

as Smile-Dog, was a close associate of Derek B. Tumer, also known as Fats, and a

member of a sfreet gang associated with Wahler Place, which was engaged in a feud

with a street gang associated with Trenton Park.

6) At all times relevant to the conspiracy, Sukamo Tumer was a close associate of Derek

B. Turner, also known as Fats, and a member of a street gang associated with Wahler

Place, which was engaged in a feud with a street gang associated with Trenton Park.

7) At all times relevant to the conspfuacy, Jarrad Childs, also known as Hearry, was a close

associate of Derek B. Tumer, also known as Fats, and a member of a street gang

associated with Wahler Place, which was engaged in a feud with a street gang

associated with Trenton Park.

8) On January 25,2017, trial commenced in the Superior Court for the District of

Columbia in the case of U.S. v. Sukamo Tumet, 20't5 CF2 5673, in which the

defendant Sukamo Tumer was charged witlt inter a/ia, unlawfi:i possession of a

firearm. On January 26,2017,lanan Childs, also known as Healy, testified on behalf

of defendant Sukamo Tumer and claimed criminal responsibility for possession of the

firearm that defendant Sukamo Tumer was charged with possessing. On January 31,

2017, a jury returned a verdict acquitting defendant Sukamo Tumer on all charges in

Case No. 2015 CF2 5673.

9) On March 1,2017, at 10:49 a.m., Andrew McPhatter, a Trenton Park subject, was

killed at 3501 Wheeler Rd. SE.

10) On March 8, 2017, at 2:47 p.m' Derek B. Turner, also known as Fats, was the

complaining witness in an Assault With a Dangerous Weapon offense at 4415 S.

Capitol St. SW. MPD officers investigating the shooting impounded as evidence a

white 201I Lexus LS350 that was registered to Derek B. Turner, also known as Fats.

A warrant to search the vehicle was applied for, approved and execute4 and police

recovered from it a Glock l0 mm handgun, SN XML22l, which was later definitively

linked by way of ballistics analysis to the shooting of Andrew McPhatter on March 1,

2017.

11) On March 11,2017, at 2:55 a.m., Derek B. Tumer, also known as Fats, was amested

at 901 Massachusetts Ave. NW, and charged with a federal fuearms offense based on

the recovery of the Glock 10 mm handgun, SN XML22I, from the white 2011 Lexus

LS350. In the company of Derek B. Tumer, also known as Fats, at the time of his

arrest was Marshay Hazeiwood, also known as Shay, and others whose identities are

known and unknown to the Grand Jury. The case proceeded to the U.S. District

Court for the District of Columbia with the caption U.S. v. Derek Tumer l:17-cr-055

(cRC).

12) On April 27, 2017, an appearance was entered by defense counsel in U.S. v. Derek

Tumer, 1:17-cr-055 (CRC). From that point forward the defense counsel of record

for Derek B. Tumer, also known as Fats, in that matter was the same defense counsel

who had represented the defendant in U.S. v. Sukamo Tumer,2015 CF2 5673, the

case in which Jarrad Childs, also known as Heavy, had testified on behalfof

defendant Sukamo Tumer and claimed criminal responsibility for possession ofthe

fuearm that defendant Sukarno Tumer had been charged wi& possessing.

13) In May and June,2017, Marshay Hazelwood, aiso known as Shay, was subpoenaed

to the Grand Jury in the U.S. District Court for the District of Columbia as a witness

in U.S. v. Derek Tumer, 1:17-cr-055 (CRC), but through counsel ultimately declined

to testiry in the absence of a grant of immunity, which the govemment declined to

confer upon her.

 14) On September 6,201'1, at 8:01 a.m., Derek B. Turner, also known as Fats, was

transported from D.C. Jail to MPD Headquarters to be served with an arrest warrant

for First Degree Murder While Armed in the homicide of Andrew McPhatter, and

later the same day was presented in the Superior Court for the District of Columbia

on the charge in the case of U.S. v. Derek Turner,2017 CFI 15352.

15) On September 10,2017, the government moved in the U.S. District Court for the

District of Columbia to dismiss U.S. v. Derek Tumer, 1:17-cr455 (CRC), and on

September 11,2017, the governnent's motion was granted.

Ways. Manner and Means

Between on or about March 8, 2017 and on or about September 6, 2017, Derek B.

Turner, also known as Fats, Marshay Hazelwood, also known as Shay, Ronnika M. J

also known as Nilg also known as Sis, and Duan Hill; also known as Smiley, aiso known as

Smile-Dog, and a person whose identity is known to the Grand Jury, in various combinations,

met, discussed and planned, by way of various forms of communication including cellphone

calls, text messages, social media postings and personal interactions, for the purpose of impeding

the due administration of justice in the case of US v. Derek Tumer. 1:17-cr-055 (CRC), and the

investigation into the homicide of Andrew McPhatter on March 1, 2017 in Washington, D.C.

Overt Acts

In furtherance of the conspiracy and to effect the obj ect thereof, between on or about March

8,2017 and on or about September 9,2017, the following overt acts, among others, were

committed in the District of Columbia:

1) On March 8, 2017 .- the same day that MPD offrcers impounded as evidence his white

2011 Lexus LS350, in which the Glock 10 mm handgun, SN XML221, was then

concealed -- Derek B, Tumer, also known as Fats, deactivated a cellphone device that

was in his name.

2) On March 10, 2017, at 8:24 a.m., Derek B. Tumer, also known as Fats, used a

cellphone to call MPD civilian employee Ronnika M. Jennings, also known as Nik,

also known as Sis, with the call lasting for six seconds

3) On March 10, 2017, at 8:25 a.m., Derek B. Tumer, also known as Fats, used a

cellphone to send to MPD civilian employee Ronnika M. Jennings, also known as Nik,

also known as Sis, the following text message: "Nik I need u to call me ASAP

Please."

4) On March 10,2017, at 9:01 a-m., Derek B. Tumer, also known as Fats, used a

cellphone to call MPD civilian employee Ronnika M. Jennings, also known as Nik,

also known as Sis, with the call lasting for eight minutes and 45 seconds.

5) On 11,2017 -- the same day that Derek B. Tumer, also known as Fats, was

arrested at 901 Massachusetts Ave. NW, at 255 afi. and charged with a fedeml

firearms offense - Unindicted Co-Conspirator No. I used a cellphone at 7: 18 p.m. to

contact MPD civilian employee Ronnika M. Jennings, also known as Nik, also known

gaSi+ with the call lasting for four minutes and 47 seconds.

6) On March 11,2017, Derek B. Tumer, also known as Fats, used a telephone at D.C. Jail

to contact the cellphone of Marshay Hazelwood, also known as Shay, and in a call that

commenced at 10:21 p.m. said, among o&er things, that she should text or call

Unindicted Co-Conspirator No. I "and tell him to explain to you what me and him

were talking about outside your house."

7) On March 12,2017, x 12:04 p.m., Unindicted Co-Conspirator No. 1 used a cellphone

to send to MPD civilian employee Ronnika M. Jennings, also known as Nik, also

known as Sis, the following text message: "Hey nik.man they said he in district cor:rt

can check 4me m see wat they got".

8) On March 12,2017, at 2:10 p.m., Unindicted Co-Conspirator No. 1 used a cellphone

to contact MPD civilian employee Ronnika M. Jennings, also known as Nik, also

known as Sis, with the call lasting for 35 seconds.

9) On March 12, 2017 , at 2:13 p.rn., MPD civilian employee Ronnika M. Jennings, also

known as Nilg also known as Sis, used a cellphone to contact Unindicted Co-

Conspimtor No. l, with the call lasting for one minute and 39 seconds.

l0) On March 12,2017, at 2:56 p.m., Unindicted Co-Conspirator No. I used a cellphone

to contact MPD civilian employee Rorurika M. Jennings, also known as N also

known as Sis, with the call lasting for 16 seconds

11) On March 12,2017, at 9:07 p.m., MPD civilian employee Ronnika M. Jennings, also

known as Nih also known as Sis, accessed het secure and password-restricted

WALESA.,ICIC account and queried the name of Duan Hill, also known as Smiley, also

known as Smile-Dog.

12) On March 12,2017, at 9:35 p.m., a person whose identity is known to the Grand Jury

used a cellphone to contact MPD civilian employee Ronnika M. Jennings, also known

as Nik, also known as Sis, with the call lasting for six seconds

13) On March 15, 2017, Derek B. Tumer, also known as Fats, used a telephone at D.C. Jail

to contact the cellphone of Marshay Hazelwood also known as Shay, and in a call that

commenced at 5:22 p.m. said, among other things, that she should arrange a three-way

communication to include Unindicted Co-Conspirator No. 1, and when the

conversation between Derek B. Tumer, also known as Fats, and Unindicted Co-

Conspirator No. 1 turned to a reference to "Sis," Unindicted Co-Conspirator No. 1

terminated the conversation about that subject and then said, among other things, that

he would have to come to thejail to discuss the subject in person with Derek B, Turner,

also known as Fats.

14) On March 15,2017, Derek B. Tumer, also known as Fats, used a telephone at D.C. Jail

to contact the cellphone of Marshay Hazelwood, also known as Shay, and in a call that

commenced at 9:29 p.m. referred to Unindicted Co-Conspirator No. I and then said,

among other things, "He told you what we gonna do, that's alright?" and Marshay

Hazelwood, also known as Shay, said, ''Yeah."

15) On March 15,2017, Derek B. Tumer, also known as Fats, used a telephone at D.C. Jail

to contsct the cellphone of Marshay Hazelwood, also known as Shay, and in a call that

commenced al 9:29 p.m. referred to Unindicted Co-Conspirator No. I and then said

the following, among other things: "You gotta sit, think, and be on your toes. Cuz I
needyou. I love you. And I appreciate it too."

 l6) On March.15, 2017, Derek B. Turner, also known as Fats, used a telephone at D.C. Jail

to contact the cellphone of Marshay Hazelwood, also known as Shay, and in a call that

commenced at 9:46 p.m. the two had the following exchange in which the following

was said, among other things, with Derek B. Turner, also known as Fats, referred to

here as "DT," and Marshay Hazelwood, also known as Shay, refened to here as "MH":

DT: "After I talk to her I'm gonna call you."

MH: "Uh-huh."

DT: "But you gotta be sharp, You hear me? For real."

MH: 'TIe was telling me, but I'm like, I guess, I don't know, we'll see."

DT: "You think you got it?"

MH: "Hmm."
DT: "You think you got it?"

MH: "Yeah. Yeah."

DT: "l love you."

lf On March 16,2017, Derek B. Tumer, also known as Fats, used a telephone at D.C. Jail

to contact the cellphone of Marshay Hazelwood, also knovt'n as Shay, and in a call that

an exchange in which the following was said, among other things, with Derek B.

18) On March 16,2017, Derek B. Tumer, also known as Fats, used a telephone at D.C. Jail

to contact the cellphone of Marshay Hazelwood, also known as Shay, and in a call that

commenced at 12:42 p.m. the two discussed having another person whose identity is

unknown to the Grand Jury "fi1l in" for Marshay Hazelwood, also known as Shay, if
she were unable to go forward with what had been discussed before.

19) On March 28 , 2017 -- the same day that Unindicted Co-Conspirator No. 1 was killed

at2125 AlabanaAve, SE - MPD civilian employee Ronnika M. Jennings, also known

as Nik, also known as Sis, deactivated a cellphone device and activated a new one

using the same cellphone number she had previously used.

20) On April 2,2017,Derck B. Turner, also known as Fats, used a telephone at D.C. Jail

to contact the cellphone ofa person whose identity is known to the Grand Jury, and in

a call that commenced at 9: 14 p.m. the two had an exchange in which the following

was said, among other things, with Derek B. Turner, also known as Fats, referred to

here as "DT," and the other person referred to here as "OP":

DT: "I'm abdut to work it the same way 'Heavy' worked it."

OP: "Who you got?"

DT: "I got a friend."

21) On April 12,2017, Marshay Hazelwood, also known as Shay, used a cellphone to

contact MPD civilian employee Ronnika M. Jennings, also known as Nik, also known

and the following text message exchange occured between 9:46 p.m. and 9:47

RJ: "Te1l him ok just tell him call me another name tell him keep that head up"

22) Ol Apill9,2017, Marshay Hazelwood, also known as Shay, posted a message on the

social media website Instagram that said, among other things, "I'm doing time with

you, putting my right hand on the book and straight llng for you."

23) On May 4, 2017, Derek B. Tumer, also known as Fats, used a telephone at D'C' Jail to

contact the cellphone of Marshay Hazelwood, also known as Shay, and in a call that

commenced at 5:36 p.m. told her to arrange a three-way communication to include

Duan Hill, also known as Smiley, also known as Smile-Dog, and the three of them

arranged the scheduling ofa meeting of Marshay Hazelwood, also known as Shay, and

Duan Hiu, also known as Smiley, also known as Smile-Dog, with defense counsel of

record for Derek B. Tumer, also known as Fats, in U.S. v' Derek Tumer, 1:17-cr-055

(cRC).

24) On May 5, 2017, in the moming, Marshay Hazelwood, also known as Shay' and Duan

Hill, also known as Smiley, also lnown as Smile-Dog, met with defense counsel of

record for Derek B. Tumer, also known as Fats, in U.S. v. Derek Tumer, l:17-cr-055

(cRC).

25) On May 5, 2017, Derek B. Tumer, also known as Fats, used a telephone at D'C' Jail to

contact the cellphone of Marshay Hazelwood, also known as Shay, and in a call
that

commenced at 11:30 a.m. refened to his defense counsel of record and

then said,

26) On May 5, 2017, Derek B. Tumer, also known as Fats, used a telephone at D.C. Jail to

contact the cellphone of Marshay Hazelwood, also known as Shay, and in a call that

commenced at 12:11 p.m. had an exchange which included Duan Hill, also known as

Smiley, also known as Smile-Dog, and in which the following was said, among other

things, with Derek B. Tumer, also known as Fats, referred to here as "DT," Marshay

Hazelwood, also known as Shay, refened to here as "MH," and Duan Hill, also known

as Smiley, also known as Smile-Dog, referred to here as "DH":

DT: "Everything went cool?"

MH: "Yeah, he j ust said I gotta wdte what I said, so then I told him I got

subpoenaed and stuff. And he really don't know what I say - he [ike, it'll help you

but he don't know that it'Il help me because, he don't know. But he like, he can't

give me no advice 'cause he represents you, he don't represent me."

DT: "Oh yeah, yeah, yeah. Yeah. Yeah."

MH: "That was it. Ard I paid him."

DT: "Hey, Smile-Dog."

MH: "He can hear you now."

DT: "Yeah, just explain, Iike, the same way Heavy did."

commenced at 1:05 p'm. had an exchange which included MPD civilian employee

Ronnika M. J also known as Nik, also known as S and in which the

following was said, among other things, with Derek B' Tumer, also known as Fats'

28) On May 13,2017, Derek B. Tumer, also known as Fats, used a telephone at D.C. Jail

to contact the cellphone of Marshay Hazelwood, also known as Shay, and in a call that

commenced at 2:15 p.m. said the following, among other things: "You gotta be

calling Nik ... Let her know I say to give you the rundown on everything, man. You

hear me? On everything ... On everylhing or everybody ... Call her and see where

she's at, and see ifyou can talk to her first. Because I don't want you to talk to her over

the joint. You hear me? ... Talk to her in person, tell her what I need."

29) On May 27,2017, Derek B. Tumer, also known as Fats, used a telephone at D.C. Jail

to contact the cellphone of Marshay Hazelwood, also known as Shay, and in a call that

commenced at 10:33 a.m. said to her, among other things, "Did you ever go holler at

Nik," and when Marshay Hazelwood, also known as Shay, said that she hadn't, Derek

B. Turner, also known as Fats, said, "It's important."

30) On May 2'7,2017, Derek B. Tumer, also known as Fats, used a telephone at D.C. Jail

to contact the cellphone of Marshay Hazelwood, also known as Shay, and in a call that

commenced at 8:03 p.m. said to her, among other things, "Did you holler at Nik," and

Marshay Hazelwood, also known as Shay, said that she had tried to call her twice,

unsuccessfully.

31) On May 29,2017, Derek B. Tumer, also known as Fats, used a telephone at D.C. Jail

to contact the cellphone of Marshay Hazelwood, also known as Shay, and in a call that

commenced at 10;24 a.m. said, among other things, that she should call or text Nik'

32) On May 30,2017, Derek B. Turner, also known as Fats, used a telephone at D'C' Jail

to contact the cellphone of Marshay Hazelwood, also known as Shay, and in a call that

comrnenced at 7:41 p.m. asked, among other things, if she had called or texted "Nik,"

and Marshay Hazelwood, also known as Shay, said, "I thbk she's at work or
something."

33) On May 30,2017, Marshay Hazelwood, also known as Shay, used a cellphone to

contact MPD civiliu, emPloYee

as Sis, and the following text message exchange occurred between 7:57 p'm' and 9:31

p.m., with Marshay Hazelwood, also known as Shay, referred to here as "MH," and

Ronnika M. Jennings, also known as Nik, also known as Sis, referred to here as "RI":

MH: "Hey, this Shay Fatz Girlfriend Is You Busy Tomar Can I Meet You"'

RI: "Yeah you can meet I'm home in The moming I go to work at 2 "

among other things, with Derek B' Turner, also known as Fats, refened to here as

"DT," and Marshay Hazelwood, also known as Shay, referred to here as "MH':

35) On May 31,2017, Derek B. Turner, also known as Fats, used a telephone at D.C. Jail

to contact the cellphone of Marshay Hazelwood, also known as Shay, and in a call that

commenc€d at l:28 p.m. the two had an exchange in which the following was said,

among other things, with Derek B. Tumer, also known as Fats, refened to here as

"DT," and Marshay Hazelwood, also known as Shay, refened to here as "MlI':

MH: "Yeah."

DT: "She said it?"

MH: "Yeah."

DT: "What, they fishin'?"

contact MPD civilian employee Ronnika M. Jennings , also known as Nik, also known

as Sis. and at l:34 p.m., during the telephone call that constitutes Overt Act No. 35

above, the following text message exchange occurred, with Marshay Hazelwood, also

known as Shay, referred to here as *MH," and Ronnika M. Jennings, also known as

Nik, also known as Sis, referred to here as "RJ":

MH: "He said he send his love"

RI: "Me too"

37) On June 1, 2017, Derek B. Tumer, also known as Fats, used a telephone at D.C. Jail to

contact the cellphone ofa person whose identity is known to the Grand Jury, and in a

call that commenced at7:20 p.m. the two had an exchange in which the following was

said, among other things, with Derek B. Tumer, also known as Fats, referred to here

as "DT," and the other person referred to here as "OP":

DT: "l sent Shay to holler at Nik the other day."

OP: "Holler at who?"

DT: "Nik. Nik. Broad that lives down the Farms. She's sayin' like it's over and

done with, but I don't know, I don't know."

38) On July 9, 2017 ,Marshay Haznlwood, also known as Shay, used a cellphone to contact

MPD civilian empl oyee Ronnika M. J known as Nik, also known as Sis

and the following text message exchange occurred between 3:12 p'm. and 3:16 p.m.,

with Marshay Hazelwoo{ also known as Shay, refened to here as "MH," and Romika

M. Jennings, also known as Nik, also known as Sis, refened to here as "RI":

MH: "Hey This Shay Fatz Girlfriend You at Work?"

RJ: "No I work at 5am to 3."

MH: "Did Yu hear anything? Everything is Everything?"

RJ: 'Nope, everything is everlthing"

39) On Septembq 6,2017 - the same day that Derek B. Tumer, also known as Fats, was

transported from D.C. Jail to MPD Headquarters at 8:01 a.m. to be served with an

arrest warrant for First Degree Murder while Armed in the homicide of Andrew

McPhatter - MPD civilian employee Ronnika M. Jennings , also known as Nik, also

known as Sis accessed her secure and password-restricted Cobalt account at 8:42 a.m.,

8:48 a.m.,8:53 a.m., 8:57 a.m., and 10:39 a.m. and viewed the offense and arrest

reports related to the shooting of Andrew McPhatter.

as Shay, and the following text message exchange occurred between 8:58.a.m. and

9:51 a.m., with Ronnika M. Jennings, also known as Nik, also known as Sis, referred

to here as *RI," and Manhay Hazelwood, aiso known as Shay, refened to here as

"MH":

M}[: "Ok??2'?'!???'

MH: "Can you keep me updated With anything Else"

41) On September 9, 2017, Marshay Hazelwood, also known as Shay, used a cellphone to

contact MPD civilian employee Ronnika M. Jennings, also known as Nik, also known

as Sis. and sent the following text message at 9:50 p.m.: "He Said He Send His Love"
