EDU 210 Portfolio Artifact #1, Governance

Part 1

The state of Nevada belongs to the Ninth Federal Circuit Court of Appeals.

The court case I researched was SAFFORD UNIFIED SCHOOL DISTRICT #1 v. APRIL

REDDING. Redding (13 years old) was a student at a school in Safford, Arizona, was searched

for prescription pills. She allowed Romero (school principle), and Wilson (asst. principle) to

search her backpack and nothing was found inside. Romero then asked Redding to go to the

nurse’s office to continue the search. She was asked by Romero and nurse to remove all of her

outer clothing, then asked to pull out her bra and shake it, and pull the elastic on her underwear,

which exposed her breasts and pelvic area. The issue brought to the Supreme Court was whether

Redding’s Fourth Amendment (“right of the people to be secured in their persons…against

unreasonable searches and seizures”) was violated when she was subjected to a strip search by

school officials. It was determined that the search was done under “reasonable suspicion” but

because there was no reason for them to suspect that the drugs were in her bra/underwear, the

search did in fact violate her Fourth Amendment Right. The school official who asked for the

unconstitutional search was covered and entitled to a qualified immunity from liability.

Part 2

In the Constitution of the state of Nevada there are a total of 19 articles, and article 11 is

titled Education. In article 11 (Education) there are 10 sections. I was not aware that teachers

required to be under oath. Article 11, section 5 states:

“…Professors in said University, or Teachers in said Schools of whatever grade, shall be

required to take and subscribe to the oath as prescribed in Article Fifteenth of this Constitution.

No Professor or Teacher who fails to comply with the provisions of any law framed in

accordance with the provisions of this Section, shall be entitled to receive any portion of the

public monies set apart for school purposes.”

The oath is in article 15, section 2 and I would say: “I, Yesenia Lara, do solemly

[solemnly] swear (or affirm) that I will support, protect and defend the constitution and

government of the United States, and the constitution and government of the State of Nevada,

against all enemies, whether domestic or foreign, and that I will bear true faith, allegiance and

loyalty to the same, any ordinance, resolution or law of any state notwithstanding, and that I will

well and faithfully perform all the duties of the office of Education, on which I am about to

enter; (if an oath) so help me God; (if an affirmation) under the pains and penalties of perjury.”

This will come in handy when all my pre-requisites are taken care of and I am ready to accept a

job as a teacher here in the state of Nevada. I knew being an educator was something important

and now I recognize how official and respected it really means to be one. The role of an educator

is as important as a member of legislature, we too share a respective office.
