DEED OF EXTRAJUDICIAL SETTLEMENT OF ESTATE

WITH WAIVER OF RIGHTS

KNOW ALL MEN BY THESE PRESENT:

This Deed of Extrajudicial Settlement of Estate with Waiver of Rights


is executed by and between:

VALENTINA BAYSA, of legal age, single, Filipino citizen and a


resident of Barangay Linao, Gerona, Tarlac;

BONIFACIO BAYSA, of legal age, married, Filipino citizen and a


resident of Barangay Linao, Gerona, Tarlac;

ADELAIDA BAYSA, of legal age, single, Filipino citizen and also a


resident of Barangay Linao, Gerona, Tarlac;

TIRSO BAYSA, of legal age, married, Filipino citizen and also a


resident of Barangay Linao, Gerona, Tarlac; and

SIRKYO BAYSA, of legal age, married, Filipino citizen and also a


resident of Barangay Linao, Gerona, Tarlac;

WITNESSETH:

That the above-named parties are the heirs of the late LUCIA
SALAZAR who died as spinster, copy of her Certificate of Death is hereto-
attached and marked as ANNEX “A”;

That the late LUCIA SALAZAR had two siblings namely: MAXIMA
SALAZAR and ELEUTERIA SALAZAR, both whom are already deceased;

That ELEUTERIA SALAZAR has no more surviving heirs, a copy of


her Certificate of Death is hereto attached as ANNEX “B”;

That her other sibling MAXIMA SALAZAR had six (6) children namely:
BENITA BAYSA (deceased), VALENTINA BAYSA, BONIFACIO BAYSA,
ADELAIDA BAYSA, TIRSO BAYSA and SIRKYO BAYSA;

That deceased BENITA BAYSA died without an heir, consequently,


VALENTINA BAYSA, BONIFACIO BAYSA, ADELAIDA BAYSA, TIRSO
BAYSA and SIRKYO BAYSA become the only heirs of deceased LUCIA
SALAZAR;

That deceased LUCIA SALAZAR, at the time of her death, left a parcel
of land situated in Singat, Gerona, Tarlac, covered by Transfer Certificate of
Title (TCT) No. 413367 with an area of TWO THOUSAND THREE
HUNDRED SEVENTEEN (2,317) square meters, an electronic copy of which
is hereto-attached and marked as ANNEX “C”;

That to the best knowledge and information of the parties hereto, the
said deceased LUCIA SALAZAR left no will or debts;

That we, the parties hereto, being of legal age and with full civil
capacity to contract pursuant to Section 1 of Rules 74 of the Rules of Court
of the Philippines, hereby by these presents agree to divide and adjudicate
unto ourselves the estate of deceased LUCIA SALAZAR in equal shares;

WAIVER OF RIGHTS

That, VALENTINA BAYSA, BONIFACIO BAYSA, ADELAIDA BAYSA


and SIRKYO BAYSA, having no interest to occupy the subject lot property
and as expression of their love, care and concern for their sibling, TIRSO
BAYSA, hereby waive their respective shares, rights and interests over the
subject parcel land.

CONSEQUENTLY, the foregoing premises considered, TIRSO


BAYSA becomes the sole owner of the subject parcel of land.

IN WITNESS WHEREOF, the parties have hereunto set our hands on


this ____ day ___________ in the City of Tarlac, Philippines.

BEFORE ME, a Notary Public for and in the City above-stated, this
_____ day of February 2018 appeared the following persons with their

and claim to me that they are the very same persons who executed the
foregoing instrument and acknowledge to before me that the same are their

I HEREBY CERTIFY that this instrument, which pertains to a Deed of


Extra-Judicial Settlement of Estate with Waiver of Rights, consisting of three
(3) pages including this page on which this Acknowledgment is written, has
been signed by the parties and their two (2) instrumental witnesses on the
left margin of each of the first and third pages and on the top of each of their
typewritten names of the second page.
