MOTION TO RESET

COMES NOW, the undersigned counsel for the Accused and

unto this Honorable Court, most respectfully states:

1. That the hearing of this case was set on January 26, 2017
at 1:30 o’clock in the afternoon;

2. That however, during the last hearing of this case, the

undersigned requested that a subpoena be issued to the Accused
and to his named witnesses to appear before the office of the
undersigned on November 28, 2016 at 10:00 o’clock in the morning
for the preparation and execution of their respective judicial
affidavits. However, on the said date, no one attended the same,
hence, no judicial affidavit was taken;

3. That the Accused went to the office of the undersigned on

November 26, 2016 instead, but that was a Saturday and the
undersigned has other commitments to do, so that the Accused was
instructed to come back on November 28, 2016, Monday, when the
undersign will resume her office hours. However, Accused did not
come back since then.

3. That up to this date, the Accused as well as his witnesses

failed to come to the undersigned counsel’s office and that the latter
has no means of contacting or communicating with the Accused. By
this reason and considering that the next hearing will be the initial
presentation of defense’s evidence, the undersigned is constrained
to ask for a postponement;

4. This motion is not intended to delay the proceedings of this

case but purely for the reasons adverted to above.
 WHEREFORE, premises considered and in the interest of
justice and fair play, it is most respectfully prayed that the hearing
of this case set on January 26, 2017 at 1:30 o’clock in the
afternoon be cancelled and the same be reset to March 9, 2017 at
1:30 o’clock in the afternoon. The undersigned most respectfully
asks for a March resetting to give time for the preparation of the
judicial affidavits of the Accused and his witnesses.

Other reliefs and remedies just under the circumstances are

likewise prayed for.
