CONSENT AGENDA
RECOMMENDATION:
Authorizing the City Administrator to execute an agreement with Fasulo Investigations for code compliance
services in an amount not to exceed $22,000 for the term of June 6, 2018 through August 31, 2018.
BACKGROUND/SUMMARY:
Over the past several years the City has used an outside professional service (Fasulo Investigations) to provide
code compliance support as an alternative to in-house staffing. The fiscal year 2018-19 budget recommends
staffing of a full-time code compliance officer. The City is actively recruiting to fill this position with full-time staff
and anticipates that it will be filled within the next few months.
On June 11, 2017, the City Council authorized the City Administrator to execute a service agreement with
Fasulo Investigations for an amount not to exceed $63,440; to cover the period of July 12, 2017 through June
30, 2018. While the service agreement is valid through the June 2018, Fasulo Investigations has reached its 'do
not exceed' financial amount. It is recommended that the City enter into a new agreement with Fasulo
Investigations for the period of June 6, 2018 through August 31, 2018 in an amount not to exceed $22,000;
which assumes an average of 20-25 hours per week over the 3-month period. This will allow the City to continue
to provide part-time code compliance services during the recruitment and hiring process, and provide training
and augmentation of services once the full-time position is filled. Should Council adopt this resolution, staff will
execute this agreement with services to commence on June 6, 2018.
FISCAL IMPACT:
Within the proposed Fiscal Year 2018-19 budget, the Community Planning and Building Department has
included funding for contractual code compliance services and there will also be salary savings available from
the unfilled code compliance position.
PRIOR CITY COUNCIL ACTION:
In fiscal year 2017-18, the City Council authorized a total contract amount of $63,440 for code compliance
services from Fasulo Investigations.

AUTHORIZING THE CITY ADMINISTRATOR TO EXECUTE AN AGREEMENT WITH FASULO
INVESTIGATIONS FOR CODE COMPLIANCE SERVICES IN AN AMOUNT NOT TO EXCEED
$22,000 FOR THE PERIOD OF JUNE 6, 2018 - AUGUST 31, 2018
WHEREAS, the City’s Community Planning and Building Department’s utilizes contracted
code compliance services to help ensure compliance with land use, zoning, and public health and
safety codes and regulations as an effort to preserve the Village’s character and aesthetics; and
WHEREAS, the Department has included funding for contractual code compliance services
within the proposed Fiscal Year 2018-19 budget; and
WHEREAS, the City issued a Request for Proposals on April 25, 2016 and published a notice
soliciting proposals in the Carmel Pine Cone on April 29 and May 6, 2016; and
WHEREAS, Carmel Municipal Code §3.12.160 allows for competitive negotiation and the City
to accept the best offer as judged against proposal criteria; and
WHEREAS, the City received three proposals on May 13, 2016 and reviewed the proposals
for responsiveness, experience in providing services in similar communities, hourly rate and approach
to code compliance and selected Fasulo Investigations based on these criteria; and
WHEREAS, per Municipal Code §3.12.160, any offer of $25,000 or more shall require
approval by resolution of the City Council.
