The Complainant submits this complaint to the Court and states that there is probable cause to believe
Defendant committed the following offense(s):
COUNT I
Charge: Manslaughter in the Second Degree
Minnesota Statute: 609.205(1), with reference to:  609.205
Maximum Sentence: 10 years in prison, a $ 20,000 fine or both
Offense Level: Felony
Offense Date (on or about): 09/10/2017

Charge Description: FRANCISCO JAVIER RAMIREZ, on or about September 10, 2017, within the County
of Redwood, did cause the death of another by the person's culpable negligence whereby the person
creates an unreasonable risk, and consciously takes chances of causing death or great bodily harm to
another.

Charge: Criminal Neglect
Minnesota Statute: 609.233.1a(1), with reference to:  609.233.3(1)
Maximum Sentence: 10 years in prison, a $10,000 fine, or both

Charge Description: FRANCISCO JAVIER RAMIREZ, on or about September 10, 2017, within the County

the necessary provisions and the caregiver or operator knows or has reason to know the deprivation
could likely result in substantial bodily harm or great bodily harm to the vulnerable adult.

STATEMENT OF PROBABLE CAUSE 5/29/2018 01:57:02 PM

Your Complainant, Jason Cotner, is an officer employed by the Redwood Falls Police Department. In this
capacity your Complainant believes the following to be true and correct.

On September 10, 2017, officers received a report from the Minnesota Adult Abuse Reporting Center
advising Evelyn Augusta Schweim (DOB: 08/19/1917), Victim herein, was receiving a bath at the Sunwood
Good Samaritan Center (“Sunwood”), a licensed facility under Minn. Stat. 144A.02, within the City of
Redwood Falls when she slid out of a bathroom chair lift and broke her ankle. 

On September 13, 2017, Chief Cotner met with the Director of Sunwood, Marcus Bradley Parence (DOB
12/11/1987) and the Interim Director of Nursing, Jeanne Ann Schulz (DOB 10/30/1967). JAS stated
through their internal investigation they found FRANCISCO JAVIER RAMIREZ (DOB 02/15/1989),
Defendant herein, acted outside their protocols with regard to transferring Victim from the bath. He failed to
utilize the swing chair properly, failed to obtain assistance from a second person for transfer from her chair
to the shower chair as required under Victim’s care plan, and raised the chair to its highest level. While at
the highest level, approximately five feet in the air, he removed her seatbelt, and Victim fell from the chair. It
should be noted standard procedure is to lift no higher than one to two feet. After Victim fell, Defendant
continued to disregard protocol by first attempting to move Victim and then leaving Victim alone on the
floor to obtain assistance. 

On September 18, 2017, Chief Cotner learned Victim had passed away on September 17, 2017 due to
the injuries sustained from the fall on September 10, 2017. 

On October 30, 2017, Chief Cotner obtained the training records for Defendant from Sunwood. A review of
those records shows Defendant had been trained in the use of the pool (tub), restraints, resident care
plans, use of mechanical lifts, and Safe Resident Handling Program. The training records were signed and
initialed by Defendant. 

On April 23, 2018, Chief Cotner reviewed Defendant’s complete personnel file. The file shows Defendant
was trained on protocols for use of the mechanical chair lift and resident care plans twice once in July 2014
and again in August 2017. 

Chief Cotner has made multiple attempts to locate Defendant. However, has been unsuccessful. At this
time his whereabouts are unknown.
