AFFIDAVIT

That We, ROSERNIE B. CUERDA, NESTOR SALAPAYNE SUMONDONG and ERNESTO

ABRANCILLIO BEJARASCO, both of legal age, Filipinos, married, and both residents of barangay
Liptong, Municipality of Santander, Cebu, under oath, do hereby depose and manifest:

That I, sometime in November 23, 2017 at around 11:00 oclock in the morning I, NESTOR
SALAPAYNE SUMONDONG saw Charito Bulawan at Lot 2724-B in barangay Liptong Santander,
Cebu; setting fire of the young coconut trees and bananas plants planted therein;

That after seeing the incident I, Nestor S. Sumolndong reported the incident to ERNESTO
BEJARASCO at abolut 4:00 olcl.ock in the afternoon of the same date;

That after the said report made by Nestor S. Sumondong, I Ernesto Bejarasco immediate verified
the said report and I discovered that the young coconuts and bananas planted in Lot Nol. 2724-B were
actually burned;

That after the verification made, I Ernesto Bejarasco informed my daughter Rosernie Bejarasco
Cuerda about the incident;

That after Ernesto Bejarasco informed me of the burning of the young coconuts and bananas
planted in Lot No. 2724-B, on November 24,2017, I, ROSERNIE B. CUERDA immediately went to the
place were the plants were burned and took pictures of the young coconuts and bananas burned in the
said place;

That this affidavit is executed freely and voluntarily just to attest the truthfulness and veracity of
my statements herein; and not to defraud any government agency or instrumentalities or anybody
whatsoever;

oath, do hereby depose and manifest:

That I am the vendor of one half (1/2) portion of Lot No. 3598, situated in barangay Looc, Sibulan,
Negros Oriental, Philippines, consisting of Five Thousand Twenty Two (5,022) Square meters, more or
less, as shown in a Deed of Absolute Sale known as Doc. No. 177; Page No. 37; Book No. 1; Series of
2013, Notarized by Atty. Samsodin T. Tahir, Notary Public;

That I acquired the aforementioned parcel of land by inheritance from my parents under a Deed of
Extrajudicial settlement, Partition, and Waiver of Rights and Quitclaim, known as doc. No. 166; Page No.
X; Book 101; Series of 2003; notarized by INOCENCIO E. OLISW, Notary Public;

That the aforementioned parcel of land sold to Petronila Cabajon-Amistoso belong to our retention
limit, including the real properties owned by my wife; and although we have real properties in the
Municipality of Sibulan, Negros Oriental and the Province of Negros Oriental, but it does not even reach
Five (5) Hectares;

That thisd affidavit is executed freely and voluntarily, just to attest the veracity and truthfulness of
my statements herein.
