Good morning,

We have a 4th grade student receiving SPED services who is currently on the waiting list for partial hospitalization due to
his mental health at PrarieCare in Chaska. Depending on the availability, he might be hospitalized during the school year
or in the summer. MDE looks at hospitalization as the care and treatment placement, therefore the resident school district
is responsible for transportation during the school year. According to the county worker, mom and grandma are aware
that they would be responsible for transportation in the summer.

I just wanted to let you know about this case.  Usually the district reimburses parents for milage expenses during the
school year. We would have to figure it out. 

Michelle, your case manager would have to review his IEP when he comes to your building in the fall and have an IEP
meeting for him to make changes if needed.

Here is what Minnesota Statute 125A.15 says about resident district transportation responsibilities if the
student is placed for care and treatment:
 
(c) When a child is temporarily placed for care and treatment in a day program located in another
district and the child continues to live within the district of residence during the care and treatment, the
district of residence is responsible for providing transportation to and from the care and treatment
program and an appropriate educational program for the child. The resident district may establish
reasonable restrictions on transportation, except if a Minnesota court or agency orders the child placed
at a day care and treatment program and the resident district receives a copy of the order, then the
resident district must provide transportation to and from the program unless the court or agency orders
otherwise. Transportation shall only be provided by the resident district during regular operating
hours of the resident district. The resident district may provide the educational program at a school
within the district of residence, at the child's residence, or in the district in which the day treatment
center is located by paying tuition to that district.
 
In our case, the student's parent requested the placement, the student doesn't have SPED
transportation or ESY services on his IEP, and his hospitalization might happen during summer. If we
end up responsible for transportation, we can claim those expenditures for special transportation aid. I'll
keep you posted.
