Dawn,

It looks like we would need to get a variance for Danielle Deopere after all.
Katie Gag, our RB Assistance SPED Director, and I looked at Danielle's license and checked the state requirements.
Since she has K-12 DD license, she would need somebody ASD licensed at all of her meetings.
Does she work with any preschoolers? She would need an ECSE teacher for her meetings about the ECSE students if that's
the case.
She has to be on a variance to do those meetings without the licensed teacher.

Irina,

Are you saying she does need the variance, or can we work without it if we have the specific licensed teacher at the
meetings?  Danielle stated she did not have to have a variance for the 5 years she worked at Lake Crystal.

Danielle does not work with the preschoolers, but she does have kindergarteners on the DD label under ECSE.

Dawn,

It's recommended to do a variance so you will not have to have a licensed teacher doing assessments and going to all of her
meetings, but if you can work around it it's fine.

What about the ECSE, DD labels?  Do we need an ECSE sped teacher at those meetings until they are on their "big kid"
label?

Good question. If she works with Kindergarteners receiving SPED services under the DD category, it's covered by her k-12
Developmental Delay license. 

Here is MDE's clarification for this case:


Minnesota Rule adds the requirement for a team member licensed in the child’s area of disability, if someone on the team does not
already meet that requirement. 
 
In other words, we need to have a person licensed in the area of student's disability on the team.
