SENATE AMENDMENT NO. 1

TO
SENATE BILL NO. 242

1 AMEND Senate Bill No. 242 by deleting line 31 in its entirety and inserting in lieu thereof the following:

2 “b. Public education, including early childhood education.”.

3 FURTHER AMEND Senate Bill No. 242 between lines 35 and 36 by inserting the following:

4 “(3) A Pay for Success contract for education must comply with the specific procedures for Pay for Success

5 contracts for public education. The procedures for Pay for Success contracts for public education must be consistent with

6 the recommendations from a working group.”.

7 FURTHER AMEND Senate Bill No. 242 after line 86 by inserting the following:

8 “Section 3. The Office of Management and Budget shall form a working group for the purpose of advising the

9 Office on the content of the procedures for Pay for Success contracts for public education. The working group shall include

10 all of the following members or a designee appointed by a member serving by virtue of position:

11 (1) A State Senator from the majority caucus, appointed the President Pro Tem of the Senate.

12 (2) A State Representative from the majority caucus, appointed by the Speaker of the House.

13 (3) A State Senator from the minority caucus, appointed the President Pro Tem.

14 (4) A State Representative from the minority caucus, appointed by the Speaker of the House.

15 (5) The Secretary of the Department of Education.

16 (6) The Chair of the Delaware Early Childhood Council.

17 (7) The President of the Delaware State Education Association.

18 (8) The Executive Director of the Delaware Association of School Administrators.

19 (9) The Executive Director of the Delaware School Board Association.

20 (10) The Executive Director of the Delaware Charter Schools Network.”.

SYNOPSIS
This Amendment requires that specific procedures be established for Pay for Success contracts that involve early
childhood education or public education. This Amendment also creates a working group that will make recommendations
to the Office of Management and Budget regarding these procedures.
