OPERATIONAL GUIDELINES
EXEMPTION OF ELECTRICITY DUTY
UNDER IPR -2007
1. Short Title: - Operational guidelines for Exemption of Electricity Duty under
provisions of clause 20.1 & 20.2 of Industrial Policy Resolution –2007.
2. Extent: - It shall extend to the whole of the State of Orissa.
3. Commencement: - It shall come into force from the “Effective Date" of Industrial
Policy Resolution –2007 i. e. 2nd March 2007.
4. Terms and Expressions: -Terms and expressions used in this operational
guideline, but not specifically defined here, shall have the same meaning as in
Industrial Policy Resolution –2007.
5. Eligibility: -
5.1 New industrial unit other than Thrust sector industries shall be exempted from
the payment of electricity duty up to a contract demand of 110 KVA for a period of
five (5) years from the date of availing power supply for commercial production.
5.2 New industrial unit in Thrust sector shall be entitled to 100% exemption of
electricity duty up to a contract demand of 5 M W (Five Megawatt) for a period of five
(5) years from the date of availing power supply for commercial production.
5.3 Non-mineral based new industrial units located in the Revenue districts of
Kalahandi, Nuapada, Bolangir, Subarnpur, Koraput, Malkangiri, Rayagada,
Nawrangpur, Khandamal, Gajapati and Mayurbhanj with minimum investment of five
crore rupees in plant & machinery and providing direct employment to minimum
hundred persons shall be treated as deemed thrust sector unit under clause 15 of
IPR-2007 and be eligible for this incentive as prescribed for the thrust sector (Special
incentives for KBK Region, Kandhamal, Gajapati & Mayurbhanj).
5.4 Deemed thrust sector status granted to industrial unit by High Level Clearance
Authority (HLCA) subject to concurrence of Finance Department and Cabinet
approval under clause 15 of IPR-2007 and be eligible for this incentive as prescribed
for the thrust sector.
5.5 New industrial unit setting up captive power plant shall be exempted from the
payment of 50% of electricity duty for captive power plant for a period of five (5)
years for self- consumption only from the date of its commissioning.

5.6 Pioneer Unit in each Thrust sector shall be eligible for extension of period of
incentives for an additional two years over and above the limit specified, provided
the unit has been in continuous commercial production during the normal period of
incentive.
5.7 Units listed at point 3 of SCHEDULE of Annexure - II of IPR-2007 shall not be
eligible for fiscal incentives as industrial units
6. Time frame for filing application: - Eligible Industrial unit shall file its claim
complete in all respect, within six months from the date of starting commercial
production / within six months from the date of notification of this operational
guidelines, which ever is latter.
Incase of Captive Power Plant, the claim shall be filed within six months
from the date of commission of CPP for full production of power / within six months
from the date of notification of this operational guidelines, which ever is latter.
Pioneer Units in each Thrust sector shall file its claim in two stages. It shall be
within six months from the date of starting commercial production / commissioning
of CPP for full production of power, as the case may be / within six months from
the date of notification of this operational guidelines, which ever is latter for normal
period of incentives and for extension of period of incentives for an additional two
years over and above the limit specified, it shall be within next six months of
completion of normal period of incentive.
Application in the prescribed form received after the due date / incomplete in
any respect shall be liable to be summarily rejected. There shall be no consideration
for condonation of delay in filing application.
7. Procedure: -
7.1 Eligible industrial unit claiming exemption from the payment of Electricity Duty on
Distribution Company's power supply & on Captive Power Plant shall submit
application in the prescribed form appended to this operational guideline at Annexure
-'A- I' & 'A- II' respectively, along with copies of all relevant documents as mentioned
in the Checklist at Annexure -'B'. Application shall be submitted to the concerned
General Manager (GM) / Project Manager (PM), District Industries Centres (DIC) in
duplicate for Micro, Small, Medium units up to a contract demand of 110 KVA /
Captive Power Plant of above category and in triplicate for the Large Units up to 110
KVA, Thrust sector, Deemed Thrust sector, Pioneer Unit and Captive Power Plant
for Large Industries. Copies of the documents as indicated in the checklist shall be

self - attested by Proprietor / Managing Partner / Managing Director / Authorized
Signatory of the unit.
7.2 On receipt of application with copies of relevant documents, the
acknowledgement as prescribed at Annexure- 'C' shall be dispatched to the
applicant duly signed by the authorized officer / G.M / P.M, DIC on the day of receipt.
G.M / P.M, DIC may authorize any of his officers for the purpose.
7.3 The application shall be examined and scrutinized by the concerned General
Manager / Project Manager, DIC and where necessary spot verification shall be
made. After scrutiny and examination, correction, if any required on the application
form, shall be made under the signature of General Manager / Project Manager, DIC.

7.4 Exemption of Electricity Duty on Distribution Company's power supply

7.4.1 One set of application with supporting documents made by the new industrial
unit for Micro, Small, Medium category where contract demand is up to 110 KVA
shall be forwarded to the Electrical Inspector (T&D) of the concerned zone
recommending exemption to be allowed with particulars in the prescribed form
appended at Annexure- 'D' within 30 days from the date of receipt. Copies of said
recommendation letter should be forwarded to Director of Industries, Orissa,
applicant unit, and concerned Electrical Inspector (T&D). The other set of application
etc and copy of the said recommendation letter shall be retained in the office of
General Manager / Project Manager, DIC for record.
7.4.2 In case of Thrust sector, Deemed Thrust sector, Pioneer industries and Large
Industrial Unit with contract demand up to 110 KVA, the General Manager / Project
Manager, DIC shall transmit two sets of application with copies of all relevant
documents along with a certificate to Director of Industries, Orissa (DI) mentioning
date of first fixed capital investment, entitlement for ED exemption, quantum of
contract demand, date of availing power supply for commercial production, present
working status etc in the prescribed form appended at Annexure- 'E' within 30 days
from the date of receipt of application under intimation to the applicant unit. The third
set of application etc and copy of aforesaid certificate shall be retained in the office
of General Manager / Project Manager, DIC for record.
Directorate of Industries, Orissa (DI) on receipt application with supporting
documents from the concerned DIC, shall scrutinize & examine the same and where

necessary spot verification shall be made. Then, one set of application with
supporting documents shall be forwarded to the Electrical Inspector (T&D) of the
concerned zone recommending exemption to be allowed with particulars in the
prescribed form appended at Annexure- 'F' within 30 days from the date of receipt of
recommendation from the DIC, if found eligible and suitable. Copies of said
recommendation letter should be endorsed to applicant unit, Electrical Inspector
(T&D) & DIC concerned. The other set of application etc and the said
recommendation letter shall be retained in the office of Director of Industries, Orissa
for record.
7.4.3 On receipt of the recommendation from General Manager / Project Manager,
DIC or Director of Industries, Orissa, as the case may be, the Electrical Inspector
(T&D) of the concerned zone shall exempt the recommended Duty and intimate the
same to the Executive Engineer of concerned Electrical Division, Chief Electrical
Inspector (T&D), Orissa, Bhubaneswar, Director of Industries, Orissa, General
Manager / Project Manager, DIC concerned and applicant unit in the prescribed
format appended at Annexure- 'G' within 30 days from the date of receipt of
recommendation from the DIC / Director of Industries, Orissa.
7.4.4 In any case exemption is allowed after collection of electricity duty; the
Executive Engineer concerned shall take necessary steps to adjust the excess
collection against tariff payable by the industrial unit in near future after getting
refund order from concerned Electrical Inspector (T&D).
7.4.5 Electrical Inspector (T&D) / Executive Engineer concerned, shall keep
accounts of exemption and adjustment and intimate the same at the end of each
financial year to the Chief Electrical Inspector (T&D), Orissa / Director of Industries,
Orissa / District Industries Centre concerned so as to keep record of quantum of
benefit extended during the IPR-2007.
7.4.6 According to the provisions of the IPR-2007, the date of Power Supply to avail
of admissible exemption on Electricity Duty is the date of power supply by the
DISTICO for commercial production. Therefore, it is advisable that Industrial Units
should take construction power and production power separately and to execute
separate agreement for construction power and production power.
7.5 Exemption of Electricity Duty on Captive Power Plant
7.5.1 One set of application with supporting documents made by the new industrial
unit having C.P.P. for Micro, Small, Medium category shall be forwarded to the

Superintending Engineer (P)-cum-E.I. (G) of the concerned zone recommending
exemption mentioning quantum of Electricity used for self consumption, E.D.
exemption to be allowed in the prescribed form appended in Annexure-‘H’ within 30
days from the date of receipt. Copies of said recommendation letter should be
forwarded to Director of Industries, Orissa, and applicant unit. The other set of
application etc. and copy of the said recommendation letter shall be retained in the
office of General Manager / Project Manager, DIC for record.
7.5.2 General Manager / Project Manager, DIC shall transmit two sets of application
with copies of all relevant documents of the C.P.Ps for Large Industrial Units / Thrust
Sector / Deemed Thrust Sector / Pioneer Industries along with a certificate to
Director of Industries, Orissa (DI) mentioning date of first fixed capital investment,
date of first fixed capital investment for CPP, date of commissioning of CPP, capacity
of CPP & entitlement for E D exemption, present working status etc in the prescribed
form appended in Annexure- 'I ' within 30 days from the date of receipt of application
under intimation to the applicant unit. The third set of application etc and copy of
aforesaid certificate shall be retained in the office of General Manager / Project
Manager, DIC for record.
Director of Industries, Orissa on receipt application with supporting documents from
the concerned DIC, shall scrutinize & examine the same and if necessary spot
verification shall be made. Then, one set of application with supporting documents
shall be forwarded to the S. E (P)- cum- EI (G) of the concerned area,
recommending exemption to be allowed with particulars in the prescribed form
appended at Annexure- 'J' within 30 days from the date of receipt of
recommendation from the DIC, if found eligible and suitable. Copies of said
recommendation letter should be endorsed to applicant unit, Chief. Engineer (P) –
cum- CEI (G), Orissa, Bhubaneswar & DIC concerned. The other set of application
etc and the said recommendation letter shall be retained in the office of Director of
Industries, Orissa for record.
7.5.3 On receipt of the recommendation from Director of Industries, Orissa, the S. E
(P)- cum- EI (G) of the area, shall exempt the electricity duty recommended, if any
and intimate the same to the Chief. Engineer (P) – cum- CEI (G), Director of
Industries, Orissa, General Manager / Project Manager, DIC concerned and
applicant unit in the prescribed format appended at Annexure- 'K' within 30 days
from the date of receipt of recommendation from the DIC / Director of Industries,

Orissa. The S E (P) – cum- EI (G) shall take steps for adjustment of excess amount
paid, if any, with intimation to all concerned.
7.5.4 S. E (P)- cum- EI (G) concerned, shall keep accounts of exemption and
adjustment and intimate the same at the end of each financial year to their
authorities / Director of Industries, Orissa / District Industries Centre concerned so as
to keep record of quantum of benefit extended during the IPR-2007.
7.5.5 Date of commissioning of the CPP is to be submitted by the applicant unit
along with the application form. Date of commissioning shall be mentioned on the
Commissioning Report with joint signature of the representatives of the applicant
unit, supplier / erector of the CPP, concerned Electrical Inspector and if applicable
representatives of Distribution Company and Orissa Power Transmission
Corporation Ltd.
8. In case of rejection of application at the level of G.M / P.M, DIC / D.I Orissa, /
Electrical Inspector (T&D) / S. E (P)- cum- EI (G) of the concerned zone, the reasons
of rejection shall be communicated to the applicant unit by the concerned authority
as early as possible or within a maximum period of 90 days of receipt of application
at DIC level in the format prescribed at Annexure – 'L'.
9. Industrial units covered under earlier Industrial policy shall continue to enjoy the
incentives if admissible under the said policy as per eligibility.
10. The receipt of claim filed by the industrial units and exemption of Electricity Duty
allowed etc shall be monitored both electronically & manually at DIC / Directorate of
Industries, Orissa / Electrical authorities’ level.
11. Miscellaneous :-
11.1 Electrical authority(s) / Directorate of Industries, Orissa & DIC jointly may
inspect the industrial unit, if felt necessary.
11.2 Industrial Unit shall furnish information, reports, periodical statements etc to the
DIC / Directorate of Industries, Orissa / Electrical authorities concerned as and
when required.
11.3 Industrial Unit availed incentives will not be allowed to shift location of the
industry without prior approval of DIC / Director of Industries, Orissa and concerned
E.I (T&D) or S E (P) – cum- EI (G) as the case may be.
