This Contract is for the provision of
all M&E building services within
this building and as indicated in
the drawings and specifications
including but not limited to: -

  The provision of all specified
mechanical ventilation and air
conditioning services.
 The provision of all M. V and L.
V electrical services (includes
all lighting, power requirements
and auxiliary systems).
 The provision of all Hydraulic
Services (includes domestic
water and sanitary drainage).

Services (includes Fire
Detection and Fire Fighting).
2.1. Additional Works

This contract shall also include the

 Temporary toilet and drinking
water supplies for M&E
Contractor’s site staff for the
duration of the project.
 Regular tidying of the work site
as directed by the Construction
Manager.
 Temporary fire fighting
equipment where ever hot work
is carried out.
 Barricades, warning signs and
lights for the duration of the
Contract.
 Provision of adequate (as
determined by the Construction
Manager) lighting on the work
site to enable night time work
to proceed safely.
 Provision of a security lock up
for M&E equipment off site and
also on site.

The Contractor shall supply and
maintain a site office and
furnishings for use by this
Contractor for the duration of the
Contract.

It is the Contractors responsibility
to visit the site and make himself
fully acquainted by his own
independent observation and
enquiries as to the nature, extent
and practicability of the works,
level of subsoil, the character of
the soil or strata in or on which the
works are to be constructed and
all other points which can in any
way affect the prices inserted in
this tender.
Any monetary or other claim made
by the Contractor on the ground of
want of knowledge of any or all
the aforesaid matters or things will
not be entertained by the Owner.

theå hoï laø caùc thaàu phuï.
Traùch nhieäm
Nhaø thaàu khoâng chòu traùch
nhieäm veà khoái löôïng coâng
taùc, vaät lieäu hay caùc thieät haïi
do thaàu ñoäc laäp cung caáp, hay
gaây ra. Nhaø thaàu chæ phaûi
chòu traùch nhieäm veà caùc
thieät haïi do chính hoï hay thaàu
phuï cuûa hoï gaây ra.

3.4 CONTRACT INSTRUCTION
3.4. General

No Contract Instruction issued by
the Owner or his Project Manager
shall be considered as an
authorisation for additional
payment.
Where the Contractor considers
that in his opinion such an
instruction involves additional
costs to the contract, he shall
apply in writing to the Owner
within 10 working days of the
issue of such an instruction for a
Variation Price Request for this
work.
3.5 REQUESTS FOR INFORMATION
(RFI’s)
3.5. Procedure
1
Immediately upon discovery of the
need for interpretation of the
Contract Documents prepare and
submit an RFI in the form
specified.
RFI’s shall originate with the
Contractor. RFI’s submitted by
entities other than Contractor will
be returned with no response.
Coordinate and submit RFI’s in a
prompt manner so as to avoid
delays in the Contractor’s work or
work of subcontractors.
The Project Manager will review
each RFI. Determine the action
required and respond. Allow seven
days for Project Manager’s
response to each RFI. RFI’s
received after 1.00pm shall be
considered as having been
received the following day.

noùi treân) ñeà nghò Chuû ñaàu tö
duyeät giaù phaùt sinh hôïp ñoàng.
YEÂU CAÀU THOÂNG TIN
Quy trình
Khi caàn ñöôïc giaûi thích theâm
veà hoà sô hôïp ñoàng, Nhaø thaàu
caàn soaïn vaø göûi vaên baûn
yeâu caàu thoâng tin theo maãu
quy ñònh.
Vaên baûn yeâu caàu thoâng tin
phaûi do Nhaø thaàu phaùt haønh.
Neáu khoâng, yeâu caàu naøy seõ
ñöôïc hoaøn traû vaø khoâng coù
phuùc ñaùp.
Nhaø thaàu caàn göûi yeâu caàu
naøy moät caùch nhanh choùng
ñeå traùnh gaây chaäm treã cho
coâng taùc cuûa Nhaø thaàu hoaëc
cuûa Thaàu phuï.
Quaûn lyù döï aùn seõ xem xeùt
yeâu caàu, xaùc ñònh bieän phaùp
caàn thieát vaø göûi phuùc ñaùp.
Quaûn lyù döï aùn coù 7 ngaøy ñeå
traû lôøi moãi yeâu caàu thoâng
tin. Yeâu caàu naøo ñöôïc göûi sau
13 giôø trong ngaøy seõ ñöôïc xeùt
laø ñöôïc göûi vaøo ngaøy keá
tieáp.

The Project Manager’s action may

information, in which case the
Project Manager’s time for

The Project Manager’s action on

On receipt of Project Manager’s
action, the Contractor shall update
the RFI log and immediately
distribute the RFI to affected
parties. The Contractor shall
review the response and if he
disagrees with the response notify
the Project Manager within 7 days.

Quaûn lyù döï aùn coù theå yeâu
caàu Nhaø thaàu boå sung chi
tieát. Trong tröôøng hôïp naøy,
thôøi gian quy ñònh Quaûn lyù döï
aùn phaûi phuùc ñaùp seõ ñöôïc
tính laïi töø ñaàu.
Phuùc ñaùp cuûa Quaûn lyù döï
aùn tröôùc yeâu caàu thoâng tin
coù theå daãn ñeán vieäc thay ñoåi
tieán ñoä hay giaù trò hôïp ñoàng
vaø coù theå daãn ñeán phaùt sinh.
Sau khi nhaän ñöôïc phuùc ñaùp
cuûa Quaûn lyù döï aùn, Nhaø
thaàu caàn caäp nhaät ngay yeâu
caàu naøy vaøo nhaät kyù coâng
trình, ñoàng thôøi göûi yeâu caàu
naøy cho caùc beân höõu quan.
Nhaø thaàu caàn xem xeùt phuùc
ñaùp cuûa Quaûn lyù döï aùn. Neáu
khoâng ñoàng yù vôùi phuùc ñaùp,
Nhaø thaàu caàn thoâng baùo cho

The Contractor shall prepare and
maintain a RFI log organized by
the RFI number. The RFI log shall
be updated weekly and submitted
to the Project Manager.
4 PERSONNEL AND
ACCOMMODATION
4.1 CONTRACTORS’ PROJECT
MANAGER
4.1. General
1
The Contractor shall for the
duration of the Contract appoint a
competent and suitable
experienced Project Manager in
addition to the normal provision of
a General Foreman.
The Contractor’s Project Manager
shall be responsible for the co-
ordination of all this Contractor’s
works and of all of his
Subcontractors on and off the site
with this Contractor's works and
with the Critical Path programme.
He shall act on the Contractor's
behalf in the giving and accepting
of all notices to or from the Owner.
4.2 GENERAL FOREMAN
4.2. Experience
1
The General Foreman shall be
competent and experienced in the
construction of works of the type
in this Contract.
The name of the General Foreman
proposed for this work shall be
given to the Owner with the
Tender, and he shall be made
available for interview by the
Owner before appointment.

phuø hôïp, ngoaøi vieäc cung caáp
moät chæ huy coâng tröôøng.
Quaûn lyù döï aùn chòu traùch
nhieäm phoái hôïp moïi coâng taùc
cuûa caùc thaàu phuï (taïi hay
ngoaøi coâng tröôøng) vôùi coâng
taùc cuûa Nhaø Thaàu theo toång
tieán ñoä theå hieän baèng ñöôøng
tôùi haïn.
Quaûn lyù döï aùn, thay maët cho
Nhaø thaàu, göûi vaø nhaän thoâng
baùo cuûa Chuû ñaàu tö.
CHÆ HUY TRÖÔÛNG COÂNG
TRÖÔØNG
Kinh nghieäm
Chæ huy tröôûng coâng tröôøng
caàn coù naêng löïc vaø kinh
nghieäm veà thi coâng loaïi coâng
trình ghi trong hôïp ñoàng.
Hoï Teân chæ huy tröôûng coâng
tröôøng döï kieán cho coâng trình
caàn ñöôïc neâu trong hoà sô döï
thaàu. Ngöôøi naøy seõ ñöôïc Chuû
ñaàu tö phoûng vaán tröôùc khi
boå nhieäm.

not be changed other than with
the Owner's concurrence.
4.3 LABOUR
4.3. Execution

The Contractor shall provide all
necessary labour required for the
completion and execution of the
work described in the Contract
Documents.
Include labour for all necessary
cartage of materials to and from
the site to enable the Contract to
be completed by the required
completion date.
4.3. Overtime, Travelling etc.

The Contractor shall include for
any overtime, nightwork,
travelling time, fare subsistence
allowances etc. necessary for the
completion of the work by the due
date.
All labour allowances and subtrade
agreements shall be provided for
in terms of the Common Law of
the Socialist Republic of Vietnam.
No claims in respect of labour
costs arising from a failure to
observe this provision will be
allowed under this contract.
4.4 ACCOMMODATION AND
STORAGE
4.4. Temporary Buildings
1
The Contractor shall provide all
temporary secure sheds, mess
rooms, and stores, for his own use,
if required.
Allow to remove on completion of
the contract.

5.1 WORK SHOWN AND INCLUDED

no warranty expressed or implied
that it describes each and every

included by the Tenderer.
Should any material or work
appear to be inadequately
described, yet necessary for the

Before proceeding with any work,
the Contractor shall inspect the
work of any trade against which
the work or material is to be
placed and report immediately to
the Project Manager any defects or
irregularities which would prevent
the satisfactory execution or
permanency of their work.
