JOINT AFFIDAVIT OF ARREST

We, SPO1 RYE DOMINGO AND PO2 ALLEN SOLIMAN,

bonafide members of the Philippines National Police and presently assigned
at the Quezon City Police District – ANTI CARNAPING INVESTIGATION
SECTION, CIDU located at Camp Karingal Sikatuna Village Quezon City,
after having been duly sworn to an oath in accordance with law, hereby depose
and state:

THAT, on or about 5:30 in the afternoon of August 7, 2017, while we

are on actual tour of duty, rendering police services as Tactical Motorcycle
Rider (TMR), conducting anti-criminality and anti-carnapping patrol along
Congressional Avenue corner Luzon Avenue, this City;

We, (SPO1 Rye Domingo and PO2 Allen Soliman), chance upon
spotted and flagged down the street the suspect for initial violation of driving
motorcycle without wearing safety crash helmet. That, upon coming closer to
the suspect, I, SPO1 Rye Domingo, actually saw in plain view the handle of a
pistol Evidence No. 4 came out in the right waistline of the suspect Maong
short pants.

We, (SPO1 Rye Domingo and PO2 Allen Soliman), knowing that
suspect was in possession and carrying a firearm on a public place and wearing
a civilian clothes, I SPO1 Rye Domingo, checked and frisked the suspect and
managed to seized from the suspect (Mar) and managed to seize from the
suspect Evidence No.4 [One (1) cal. 9mm pistol without serial no.] tucked in
his right waistline and when asked of any pertinent documents authorizing the
respondent to carry firearm such as License and Permit to Carry Firearms, the
respondent failed to present any, which prompted the undersigned to
immediately place him under arrest while being informed of the nature and
cause of his arrest and his constitutional rights in tagalog dialect.

That I, SPO1 Rye Domingo, recovered from the possession of suspect

one (1) cal. 9 mm hand gun loaded with six (6) live ammunitions.

Further, We, (SPO1 Rye Domingo and PO2 Allen Soliman), asked the
suspects of the registration documents of the driven motorcycle. However, he
failed to present the MC’s pertinent documents.

That recovered pieces of evidence as well as the apprehended suspect

was brought to this office for investigation and proper disposition.

That, suspect identified himself as:

ELLI MAR y BUENDIA, 24 yrs. Old, single, jobless, residing at

no. 54, Area 5, Luzon Avenue, Quezon City (UNDER CUSTODY)

That, during his arrest, the suspect was informed of the nature and cause
of his arrest and his right to remain silent, he was also apprised of his
Constitutional Rights in the language known to and understood by him.
However, he opted to remain silent in the absence of his chosen counsel;

That, WE hereunto affixed our signature on this day 8th day of August,
2017 at Quezon City, Metro Manila, Philippines, to attest to the truth and
veracity of all foregoing averments for whatever legal purpose it may serve;
