The Tahasildar functions as the Drawing and Disbursing Officer and is responsible for drawal of salary of the
staffs of the Tahasil.
(vii) Establishment:
The Tahasildar is the appointing authority of Group D employees working under his control. The detailed
Service Books of the employees are maintained by him. The disciplinary proceedings as per the Conduct
and C.C.A. Rules are initiated by the Tahasildar.
The Tahasildar functions as the Appellate Authority as per the provisions contained in the RTI Act, 2005.
The Tahasildar is declared as the Land Acquisition Officer within his jurisdiction and acquires land for
public purpose as per the Land Acquisition Act, 1894.
Tahasildar issues various certificate as per the Misc. Certificate and Caste Certificate Rules and performs
other miscellaneous functions as per the direction of Higher Authorities.
6. List of Services being provided by the public authority with a brief write up on them:
This includes Resident/ Nativity, Income, Caste (SC & ST), SEBC, OBC, Identity, Solvency (limited upto one lakh
rupees) and Legal Heir Certificates as per The Odisha Miscellaneous Certificate Rules, 1984 and The Odisha
Caste Certificate (for SCs and STs) Rules, 1980.
For issue of Certificates as mentioned above the application shall be in Form No-1 addressed to the
Tahasildar. Immediately after receipt of every application a unique number is assigned to it and forwarded to
the concerned R.I. to conduct field enquiry. On receipt of report and after due perusal of the documents
submitted by the applicant, if the Tahasildar is satisfied then the Certificate in the prescribed format is issued
after realization of requisite court fees. The Certificate to be provided to the applicant within a period of one
month from the date of institution of the case.
Mutation means substitution of the name of a person by the name of another in relation to property in the
record showing right and title to the property in case of Sale, Gift, Inheritance or due to the Decree of the Civil
Court. The mutation proceeding is governed by the provisions of Odisha Survey & Settlement Act, 1958, Odisha
Survey & Settlement Rules, 1962 and Odisha Mutation Manual, 1962.
The Mutation Case is instituted either upon receipt of Form No-3 sent from the Sub Registrar's Office or on an
application submitted to the Tahasildar with certified copy of necessary documents and affixing requisite
court fees. After institution of the Case, the land particulars are verified from the Record Room. The Cases
which are simple in nature are sent to concerned R.I. for disposal after conducting necessary hearing. Other
cases arte kept by the Tahasildar for disposal at his level. However summary enquiry by the field level official
are conducted with regard to title and possession of the case. After the statutory objection period is over and
after conducting necessary hearing the case is disposed of and after the appeal period is over sent to the
Record Room for correction of ROR. After necessary correction is made in the ROR maintained at the R.I. level
the copy of ROR is supplied to the applicant after realization of the user fee. The entire process takes nearly
two to three months for completion.
As per the provision of The Odisha Government Land Settlement Act, 1962 and The Odisha Government
Land Settlement Rules, 1983 homestead land up to 10 decimals and agriculture land up to one standard acre is
settled in favour of homestead less and landless persons. Lands are also settled in favour of Jawans, Ex
Servicemen, Police personnel died due to Naxal attack, orphans and different departments, institutions, public
undertakings of the State and Central Govt.
For settlement of lands as mentioned above application is received in Form No-1 of the OGLS Act. After
receipt of application the land schedule is verified from the Record Room and necessary enquiry is conducted
at the field level. If it is found that the applicant is eligible and land leasable and after conducting the
necessary hearing an objection is invited from the locality. After the statutory objection period is over the land
is settled in favour of the applicant if the person found to be homestead less and landless or Ex Serviceman,
Jawan or Police personnel died due to Naxal attack and the Case Record sent to Sub Collector for its
confirmation. After receipt of Case Record from Sub Collector, necessary correction of ROR is made both at the
Tahasil and RI level and ROR issued to the applicant. The entire process takes nearly three months from start
up to the end. In case of lease of land in favour of departments or institutions of the Govt. the Case Record is
initiated at the Tahasil level and follows the same procedure as delineated above and sent to the authority
concerned through proper channel for sanction of lease as per the power given under Schedule-II of the OGLS
Rule, 1983.
As per the provision contained under Section 19 (1)(C) of Odisha Land Reforms Act, 1960 partition amongst
co-sharers is made upon mutual consent. For mutual partition, the co-sharers are required to apply in the
format as provided in Odisha Land Reforms Rule, 1965 to the Tahasildar expressing there in the consent for
mutual partition of their joint landed property as per the possession and oral separation already made
between them. In support the petitioners are required to give in writing their consent for such partition with a
detailed Kachha farad showing there in their respective shares. After receipt of the application a case is
instituted and the land particulars are verified from the Record Room. Then the R.I. is directed to conduct field
enquiry. After receipt of the field enquiry report necessary hearing is conducted by the Tahasildar and if there
is no objection from any of the co-sharer then the landed properties are partitioned amongst them and after
the appeal period is over the detailed partition particulars sent to the Sub Registrar for registration. After
registration necessary correction in the ROR is made both at the Tahasil and R.I. level and separate ROR issued
to the them on payment of requisite user fee. The entire process takes nearly two to three months for its
completion.
As per the provision contained in Section 8 (A) of Odisha Land Reforms Act, 1960 a raiyat has to apply in the
Form No-25 of the OLR Rules, 1965 to the Tahasildar for conversion of his agricultural land to non agricultural
purpose. On receipt of application a Case is instituted and ROR verified from the Record Room. The R.I. is
directed to conduct enquiry and report whether the land schedule as applied can be allowed for conversion
and letter issued to the Sub Registrar to supply valuation of the land for realization of premium. After receipt
of report from the R.I. and after conducting necessary hearing if it is found that the suit land can be allowed
for conversion, then necessary order is passed for correction of ROR after realization of premium as per the
rate provided in clause I to V under Section 8 (A) of OLR Act, 1960. Conversion Cases are also booked as per the
report of field staffs under Section 8 (1)(c) of OLR Act, 1960 and demand issued as per the rate specified and
premium realized from the raiyat and necessary correction made in the ROR.
(vi) Certified copies of ROR, Case Records, and Sabik Hal comparison of land particulars:
In order to get the certified copies of ROR and other Case Records applications are made to the Tahasildar
affixing the requisite court fees and certified copies are issued after realization of the requisite user fee. For
Sabik Hal comparison after receipt of application necessary comparison made by the Amin Record Room and
supplied to the applicant.
In order to settle boundary dispute or to exactly know the boundary of landed properties application is filed
before the Tahasildar affixing the requisite court fee. After necessary hearing the petition is forwarded to the
R.I. for demarcation of the land after realization of the demarcation fee and giving prior notice to the
boundary tenants.
At the time of natural calamity except fire accident, in case of house damage it is the duty of the Tahasildar
to conduct field enquiry and prepare a list of affected houses and get it approved by the District Collector for
disbursement of house building assistance. In case of fire accident, the Tahasildar is competent to sanction
assistance to the damaged houses. For loss of lives of human beings or domestic animals during natural
calamity, for accord of ex-gratia assistance the case record is initiated at the Taghasil level and after its
sanction by the District Collector the ex-gratia amount is given to the NOKs in case of death of humans beings
and owner in case of domestic animals. In case of sand cast of agricultural land or loss of crops, input subsidy
is given to the affected farmers after necessary enquiry.
(ix) Continuous updation of Land Records and its uploading in Bhulekh is made by the Tahasildar for general
information of the public.
(x) Tenant certificate is given as per the provisions of Tenancy laws and OLR Act, 1960.
(xi) The Tahasildar acts as the custodian of the Govt land and protects it from the illegal land grabbers. In
case of illegal occupation of Govt land, case instituted as per the provision of The Odisha Prevention of Land
Encroachment Act, 1972 and The Odisha Prevention of Land Encroachment Rules, 1985 and eviction made
after summary hearing.
(xii) As per the provision of the OLR Act, 1960 the ceiling surplus lands are taken away from the land lord and
given to the landless persons.
(xiii) As per the provision of the Odisha Estate Abolition Act, 1981 any bebandobasta land is settled in rayati
status after due enquiry and subject to realization of back rent and cess.
(xiv) As per the provisions of the Tahasil Accounts Manual and OMMC Rules, 2004 permanent sairat sources
are entered in the respective register and after approval of the upset price by higher authorities it is put to
public auction. The source gets settled in favour of the highest bidder and the highest bidder sells the minor
mineral to the public after realization of royalty and gives them R form as transit pass.
7. Expectation of the Public authority from the public for enhancing its Effectiveness and Efficiency:
(i) To cooperate the administration proactively and provide authentic information whenever required.
(ii) Not to approach the Public Authority if the information is already given or available in the public domain.
(iii) The information should be sought with an objective which shall serve the Larger interest of the Public
and not merely to harass the Public Authority.
(i) Names of the beneficiaries for settlement of agricultural and homestead land decided at the village level in
Palli Sabha.
(ii) Tahasildar and filed staffs participate in the Panchayat Samiti meeting and MIS meeting.
(iii) Tahasildar and filed staffs participate in the meeting called for selection of beneficiaries as per Forest
Right Act 2006.
(iv) There is Provision of general proclamation with beat of drums for information and feed back from the
people.
(v) There is provision of affixture in the notice boards of Tahasil Office, Sub-Collector Office, R.I. Office, Block
Office and G.P. Office and at conspicuous places for information and feedback from public.
(i) Court diaries and Case Registers are maintained, updated and checked at regular interval.
(ii) Public Grievances are heard on every Saturday and entered in the Grievance Register. Regular checking of
register is conducted to know that steps are taken on petitions and grievance is redressed.

On receipt of petition received either from the party concerned or received otherwise necessary verification
is done by the Bench Clerks and then from Record Room and then the petition is forwarded to the field
functionaries for necessary enquiry. On receipt of enquiry report if it is found that necessary action as prayed
in the petition can be taken, then individual notices and general notices are issued to invite objection.
Whenever necessary general proclamation is done by means of beat of drums and affixture of notice is made
at conspicuous places of the locality in presence of witnesses and notices sent to different offices for display in
their notice board. After the stipulated objection period is over, necessary hearing which is summary in
nature is done in the court and decisions taken as per the guidelines contained in various Acts and Rules. In
case of difficulties the advice of Sub-Collector, Deputy Collector, District Collector and of other higher
authorities are sought for to arrive at a decision.
2. What are the documented procedures/ laid down procedures/ defined criteria/ rules to arrive at a
particular decision for important matters? What are the different levels through which a decision
process moves?
Detailed procedure to arrive at a particular decision is enshrined in the respective Acts and Rules and
supplemented by executive instructions issued from time to time,
As mentioned above, the decision is taken at the level of Tahasildar. However necessary record verification
is done at the level of Bench Clerks and Record Keeper and field enquiry conducted by filed functionaries.
Whenever required the advice of Sub-Collector, Dy. Collector, Dist. Collector and higher authorities are sought
to arrive at a decision.
Decisions are communicated to the Public by affixture of notice in Notice Boards of Tahasil, R.I., Sub-
Collector, Block and G.P. Offices and at conspicuous places. Where even required it is communicated
individually through process server and by post and for wide publicity advertisement is published in the local
daily. After record Correction the Corrected record position is uploaded in Bhulekh for information of Public.

No policy is framed at the Tahasil level. The Public Authority (Tahasildar) is to implement the policies
framed at the Govt. level.
MANUAL-8
Statutorily no Boards, Councils, Committees and other bodies exist at the Tahasil level. However as per the
instruction of the Govt. a Committee consisting of the Tahasildar, Revenue Supervisor, concerned R.I., B.D.O. of
the Block and concerned I.I.C./ O.I.C. of the Police Station has been formed to find out the religious
constructions existing over public places and steps to be taken for its phased destruction. It is the duty of the
Committee to ensure that no such constructions start henceforth over the govt land. The Committee meets
quarterly and it is open to the public.
Another Committee consisting of the Tahasildar, Revenue Supervisor, concerned R.I., concerned I.I.C./ O.I.C.
of the Police Station has been formed as per the instruction of the Revenue and DM Dept. in order to stop the
theft of minor minerals and to augment the revenue collection by conducting surprise raid.
