 IDENTIFICATION PARADE

1. Identification parade is held before the Magistrate to identify the accused by a

person who has seen him for the first time in the occurrence of offence.

2. The persons among whom the accused is mixed must be wearing the same apparel,

must be of the same size and bearing.

3. No policemen shall be present at the identification parade.

4. Persons standing in the parade shall not be permitted to indicate signs or words to

suggest the person to be identified.

5. The court still requires adequate corroborative evidence to establish that the person

identified is the real accused.

6. Evidence of an identification parade held by the police cannot be given because the

identification amounts to statements made under sec. 162 of CrPC.

7. In Jessica Lal case, Ram Jethmalani argued that, ‘identification in the court is useless

unless the capacity to identify and actual identification is corroborated by properly

held identification parade (TIP)’.
