CONTRACT FOR GUARDING SERVICES

BETWEEN SAFARI SECURITY SERVICES


B-6 LAKHI RAM PARK OPP. SEC-22
ROHINI, NEW DELHI- 86 (SAFARI)

Where by it is agreed as follows:-

1. Client has contracted Safari, # 358, 4th Floor, Shiva market, Pitampura, Delhi-34
to provide guarding services at “--------------------------------------------------------”

2. The initial contract period shall be for twelve calendar months commence
w. e. f. ---------------------- and shall be valid up to -----------------.

3. The client agrees to pay for the security services round the clock at the monthly
rate of Rs.3500.00 for security Services.

4. Safari shall raise an invoice for the services each month and the client shall pay
the same by the 7th day of each month.

5. Safari shall provide uniformed and trained personnel with photo Identity Card,
whistle , torch, baton etc. and ensure to operate the services to the satisfaction of
the client. Safari shall also ensure that all guards have working knowledge of
Hindi and English language.

6. The security personnel shall be employees of safari and all statutory liabilities
such as ESI, EPF, Relieving Charges & service charges etc. shall be paid in full
by safari. Safari Security services shall be fully responsible for above dues. The
photocopy of payment Challan in respect of all Govt. dues shall be handed over
by safari to the client regularly.

07 Safari shall cover its security personnel for personnel accidents and death whilst
performing the duty.
08 Adequate supervision will be provided be safari to ensure correct performance of
the said security services in accordance with the conditions agreed upon between
the two parties.

09 All necessary reports and other information will be supplied regularly as


desired by the client.

10 The security staff shall not accept any gratitude or reward in any shape or form
the client.

11 Under the terms of their employment agreement with safari the security staff will
not do any professional or other work for reward or remuneration both directly or
indirectly except for and on behalf of Safari under instructions from the
authorized staff of the client.

12 The client shall have the right, to have any person of safari removed who is
considered to be undesirable otherwise and similarly Safari reserves the right to
change the guard with prior intimation of the client, emergencies exempted.
Client can also ask for additional security guards for immediate placement at short
notice.

13 Physical standard of guards shall not be below the standard of physical fitness laid
down for Army. No local guard shall be deployed.

14 Safari shall not be held responsible for the damages/sabotage caused to the
property of the client due to the hostile act of trade union of due to force majored.

15 The client shall pay separately for any additional services required by the client
which are over and above the ones contained in this contract.

16 No security services stipulated in the contract are for the exclusive use of the
client and shall not be subcontracted or used by third party without the prior
consent of Safari.

17 The security personnel employed under this contract shall carry out functions
stipulated her in or assigned by the competent authority. Changes, if any, shall be
effected with mutual consent of both the parties.

18 The Client shall immediately communicate to Safari of any known development


that may jeopardize the security of the premises or that necessitates the changes in
the assignment instruction/directions.

19 Safari shall make sure that their staff shall not at anytime or stage divulge or make
known to any one any trust, account, matters or transactions undertaken or
handled by the client and shall not divulge to any person any formation relating to
the affair of the client. Public knowledge aside.
20 Payment by the client for the services provided here under shall be a fundamental
obligation under the agreement. Any default of payment including any single
default of any installment shall entitle Safari to suspend or terminate this
agreement within 30 days after giving intimation to the client.

21 The mutual obligation of the client and Safari shall suspend when either party is
subject to force Majeure, which can be termed as tempest, earthquake, floods or
any other act of God.

22 This contract is valid for one year form the date of commencement of the contract
and a fresh agreement shall be made before the end of the current contract or the
same contract may be allowed to continue under written agreement by both the
parties.

23 The number of security guard can be varied at the discretion of the Client.

24 In between the period of contract if either party wants to discontinue the services
has to give one month prior notice before discontinuation of services to the other
party.

25 Any dispute and/or differences, except those covered under the aforesaid clause,
arising out of or relating to this contract, including interpretation of its terms shall
be resolved through mutual discussion between the authorized representatives of
both the parties. Should the disputes be not resolved by mutual discussion, the
matter shall be referred to Arbitration in accordance with Arbitration and
conciliation Act. As applicable.

26 It shall be the responsibility of the contractor M/s Safari security services, New
Delhi to get himself registered under Contract Labor (Regulation &* Abolition)
Act if applicable.
