Abstract

This case study is conducted to determine the factors affecting repeated crime offending.

This is the case of Delson Abanador, one of the detainee in Bureau of Jail Management

and Penology in Batangas City and considered as a recidivist that was being jailed two

times. The needs to determine the factors are to be considered to construct a study and

an answer to be able to know the reasons behind why he committed an offense; why did

he tend to do wrong acts that was against the law and the society and how the

environment, the family, schools, and neighbours affect his personality and his behaviour.
I. Introduction

Recidivism is one of the most fundamental concepts in criminal justice. It refers to a

person's relapse into criminal behaviour, often after the person receives sanctions or

undergoes intervention for a previous crime. Recidivism is measured by criminal acts that

resulted in re arrest, reconviction or return to prison with or without a new sentence and

tendency toward chronic criminal behaviour leading to numerous arrests and re-

imprisonment. Recidivist is a person who repeatedly commits crimes. Recidivist is a

person who repeats an unwanted behaviour even after experiencing its negative

consequences. The term 'recidivist' is related to habitual crimes such as sexual offences

and substance abuses. People who return to abuse of alcohol after successful treatment

are considered to be alcohol recidivists.

Nowadays people accept that poverty, parental neglect, low self-esteem, alcohol and

drug abuse are all connected in explaining why people commit crimes. Some people are

simply at greater risk of becoming offenders because of the circumstances into which

they are born. From misdemeanours to violent felonies, some individuals step in to the

criminal justice system and learn their lesson to never commit a crime again. Others

unfortunately become repeat offenders with a never ending rap sheet. Environment

obviously plays a huge role but it is only one of many factors. The study of crime and

why some people can’t get away from it while others never have even a speeding ticket

has been dissected for decades. Particularly, the study of criminology, targets why

individuals commit crimes and why they behave in certain situations. By understanding

why a person commits a crime, one can develop ways to control crime or rehabilitate

the criminal. There are many theories in criminology. Some attribute crime to the
individual; they believe that an individual weighs the pros and cons and makes a

conscious choice whether or not to commit a crime. Others believe it is the community’s

responsibility to ensure that their citizens do not commit crime by offering them a safe

and secure place in which to live. Some argue that some individuals have specific traits

that will determine how they will react when put in certain negative conditions. Although

varied in thought, everyone can agree that justice needs to be secured in a civilized

society.

This is the case of Delson Abanador, one of the detainee in Bureau of Jail Management

and Penology in Batangas City and considered as a recidivist that was being jailed two

Based on the information gathered Delson Abanador’s was caught on 2014 by committing

the crime of robbery, he paid a bail amounting Php.100,000 for him to be free. After 2

years, on 2016 he was caught again through a buy bust operation and found a little sachet

of shabu and an amount of Php.80,000 to his pocket and as of now his case is ongoing.

This case study’s main objective is to be able to know the reasons behind why he

committed an offense, why did he tend to do wrong acts that was against the law and the

society. How the environment, the family, schools, and neighbours became and

considered as the factors affecting him to be a repeated crime offender.


II.Body

Delson Abanador has a simple yet big family, his father is Danilo Abanador, a carpenter

and his mother is Maria Neneth Concepcion Abanador working at barangay as a

barangay justice. In the family he has 11 siblings and he was the fourth one. They lived

in Ferry, Kumintang Ibaba, Batangas City. As I interviewed him, asking questions about

his family relationship he said that he is in good terms with her mother and even with his

siblings. He told me that his siblings was the one who visit him in jail and giving him aid

and financial for his everyday life in prison, all of his siblings were closed to him that for

sometimes we all know that in times, we all experienced misunderstanding like others but

they make sure that they not making it too long and fix things quickly. We talked about

his father, he said that his father is dead, but as he reminisce things about his father he

added that his dad was the one who gave rules to the family, he remembered when he

was a child when he was too hard-headed and became so irresponsible as a student his

father was the one who first get mad at him, there were times when he experienced to

tied and hanged up. As a response he did sorry for every wrong things he did and made

sure and promised that he will never do it again. As his story continue I asked him about

his relationship with his mother, he said that he was more of closed with his mom as of

now because his father was dead and only his mom was left. His mother never put a hand

to him and even in his siblings. When he did wrong, his mother did talked to him correcting

him and always made an advice for him to learn. Despite all the bad things he did, he

said that he is very thankful that his family never leaved him and still there to help him.

He said that he had a live in partner before named Darlyn Aloria also live in Ferry they

are not married because of lack of money. They had three children named Danica Lesly,
13 ; Carl Jerome 11 and Allysa Mae 6 years old. He told me that he had a good

relationship to his children, they usually visit him in prison, sending him food and asking

his life inside the jail. I asked him about his connection with the mother of his children, he

said that they were 2 years separated and everything was done between him and her.

They catch up for the sake of their children. Before when they are still together he said

that for sometimes they had a misunderstanding about certain things, they never had a

big fight, he was the one who always fix things and also his oldest daughter will be

sometimes the guide for them to be in good terms. Delson is a 39 year old, a tricycle

driver. He found his job as decent as it is because he told me that his job was the only

thing that he knows to be able to sustain the needs of his family. His life is simple but he

got the power to work as he can to bring his family a good living.

Back at his young age, Delson had no capacity at attending his school days. He studied

elementary at Batangas East Elementary school and at Batangas National High school

but not finishing it and stopped as a first year student. I asked him why and what were

the reasons behind his education he said that he was too lazy to attend, he is not

interested in school and that for sometimes he and his friends had a cutting class but he

never had a trouble in school. One of basic reasons of not attending in class is because

of his friends who were bad influence to him before. Peer pressure could be the lead and

factors that affect his schooling. He was being guidance at school for the reasons of so

many absences he did that his teachers got in point from where his parents were being

called to go in school and talked about his wrong doings. He told me that his mother

always talked to him and asked him what he wanted in his life, his mother pushed him to

go to school but he, himself
