AGREEMENT

WITH
NOTARY PUBLIC AND EMPLOYER

Herein EMPLOYER and Commissioned Notary Public does agree, to the following general
conditions of this Agreement:

GENERAL CONDITIONS:

1. This Agreement will commence upon the date signatures are affixed herein and will
continue until the expiration of the term of office of the Commissioned Notary Public.
2. Services to be performed by Notary Public shall be during normal working hours and
the ordinary course of employment only.
3. Compensation or payment for services rendered by Commissioned Notary Public in
addition to compensation or payment for services in the ordinary course of employment
shall be made in the following manner:

4. Relationship of the parties. It is understood that this Agreement with Employer is not
intended to, and shall not be construed to, create the relationship of agent, partnership, joint
venture or association with the Commissioned Notary Public. Further, it is understood by
Employer that this Agreement with Commissioned Notary Public shall not allow Employer to
modify, amend or revise any codified law or code set forth by the Secretary of State, Notary
Public Division. Further, Commissioned Notary Public shall abide with, and shall not modify,
amend or revise any codified laws set forth by the Secretary of State, Notary Public Division in
the performance of Commissioned Notary Public’s duties and obligations with Employer.
A. No Instructions. The Commissioned Notary Public shall not be required by Employer to
follow explicit instructions to accomplish this Agreement other than

B. No Training will be offered or required by Employer, in addition to the normal training


required all employees during the ordinary course of employment, to Commissioned Notary
Public for the purpose of carrying out the duties, responsibilities and obligations of a
Commissioned Notary Public. Commissioned Notary Public will be required to know and
understand all official duties set forth in Government Codes, Civil Codes, Code of Civil
Procedures, Election Codes, Uniform Commercial Codes and Penal Codes for the Commissioned
Notary Public set forth by the Secretary of State, Notary Public Division.

C. Government Code Section 8202.7 Private Employers; Agreement to pay premium on


bonds and costs of supplies; remission of fees to employer
“A private employer, pursuant to an Agreement with an employee who is a Notary Public, may
pay the premiums on any bond and the cost of any stamps, seals, or other supplies required in
connection with the appointment, commission, or performance of the duties of such Notary
Public. Such Agreement may also provide for the remission of fees collected by such Notary
Public to the Employer, in which case any fees collected or obtained by such Notary Public
while such Agreement is in effect shall be remitted by such Notary Public to the Employer which
shall deposit such funds to the credit of the fund from which the compensation of the Notary
Public is paid.”

D. Government Code Section 8202.8 Private Employers; Limitation on provision of


Notarial Services.
“Notwithstanding any other provision of law, a private Employer of a Notary Public who has
entered into an Agreement with his or her Employee pursuant to Section 8202.7 may limit,
during the Employee’s ordinary course of employment, the providing of notarial service by the
employee solely to transactions directly associated with the business purposes of the employer.”
Therefore;

E. Employer herein agrees to pay premium on:

[ ] Loose-Leaf Acknowledgment Certificates Computer Disk for $10.00 dollars.
F. Notary Public does herein agree to [ ] not demand [ ] demand fees allowed under
Government Code 8211. Fees., for notarizing or authenticating business generated documents in
the amount of $__________per document.

G. Commissioned Notary Public will be required by Employer to limit, during the Notary
Public’s ordinary course of employment, the providing of notarial services by the Notary Public
solely to transactions best described as;

H. Employer may pay the premiums on any bond and the cost of any stamps, seals, or other
supplies in connection with the appointment, commission or performance of the duties of such
Notary Public under Government Code Section 8202.7. However, Commissioned Notary Public
is solely responsible for the security and shall maintain possession of all official stamps, seals,
sequential journal and other supplies in connection with the appointment or commission.

5. Liability Insurance Coverage The duty of the Commissioned Notary Public outlined in
General Conditions section 4, subparagraph E, will require the Employer to cover Commissioned
Notary Public with Employer’s liability insurance policy covering all employees during the
ordinary course of employment.

6. Non-assign ability. Commissioned Notary Public shall not assign this Agreement or any
portion thereof to a third party without the prior written consent of Employer.
This agreement, including the attached exhibit if any exhibit is attached hereto and incorporated
by reference, constitutes the entire agreement by the parties and may be modified only by
subsequent written agreement executed by both parties only.

Therefore, Employer or officer acting in and for Employer and Commissioned Notary Public
does hereby, with signatures affixed herein, agree to all the general conditions of this Agreement
