Present : Amarjit Singh Complainant with counsel.

ORDER :

1. Today, complainant has moved an application for the

amendment of the complaint. It is alleged in the application that the

present complaint has been filed against M/s Chadha Sugar Industries

Private Limited village Kiri Afgana, Tehsil Batala, District Gurdaspur, but

due to inadvertence and sheer slip complainant could not mention the

name of the person who is running the accused company and is

responsible for the day to day business and activities of the accused

company. It is alleged that Rattan Anmol Singh President (Works) M/s

Chadha Sugar Industries Private Limited Village Kiri Afghana was the

Incharge of accused Company at the time of occurrence. So, he is

required to be impleaded as an accused in the present complaint for the

proper and effectual adjudication of the complaint. It is further alleged

that day to day business activities of the company and other business

transactions are directly under the control of accused Rattan Anmol Singh

and due to his irresponsibility, insufficient act, the water has been

polluted and fishes and other wildlife and habitants have been damaged,

so prayer is made for allowing the application for the amendment of the

complaint to implead the said Rattan Anmol Singh as an accused in the

instant case.

2. Heard. Case file perused. Perusal of case file reveals that the

complainant has filed the present complaint against M/s Chadha Sugar

Industries Private Limited village Kiri Afghana, but it has not been

impleaded any person responsible in the day to day activities of the said

company which was actually required to be impleaded through the person

carrying on the work and activities and responsibility in the acts of the

said company. Now, the complainant is alleging that Rattan Anmol Singh

President ( works) of the Company and was Incharge at the time of

occurrence in question. So, he is required to be impleaded as accused in

the instant complaint. Moreover, complaint is at initial stage and

cognizance has not been taken by the court so far and even the

amendment sought by the complainant is very necessary for the just and

proper decision of the case. Accordingly, I find merits in the application,

so same stands allowed and complainant is allowed to make the

amendment of the complaint by impleading Rattan Anmol Singh as an

accused.

3. Amended title filed today itself.

4. The complainant has sought an adjournment for producing

the laboratory report and damage report etc. Request considered and

allowed. Let, case is adjourned to 7.6.2018 for producing the said

documents.
