REGIONAL, PROVINCIAL AND STATION COMMANDERS, DILG REGIONAL DIRECTORS, AND OTHERS CONCERNED SUBJECT: IMPLEMENTATION OF THE SMOKING BAN IN PUBLIC PLACES Section 5 of Republic Act No. 9211, otherwise known as the Tobacco Regulatory Act absolutely prohibits smoking in public places specified in the Said provision of the law and its Implementing Rules and Regulations (IRR). Section 2, Rule Ii of the IRR of RA 9211 provides for the effective implementation of the provisions of the Act and the said IRR, which include the smoking ban. This particular provision gives authority to the concerned city mayors, municipal mayors, building officials and members of the Philippine National Police to take the necessary steps to ensure compliance with the provisions of the said law. Towards this end, all concerned local chief executives and local officials are enjoined to cause the immediate enactment of ordinances to Feguiate smoking in public places, in accordance with the provisions of RA 9211 and its IRR. A model Ordinance is hereto attached as reference. ‘The said local authorities in coordination with concemed police officials and law enforcers are, likewise, enjoined to take appropriate actions against violators of the said provision of the Act.
