INFORMATION REGARDING APPROVAL building ON PLOT NO. 118/9-C II


AND III BY the CANTONMENT BOARD FAISAL

The Background of Land Survey is No. 118/9 A,B,C & D Block 18, Gulistan-e-Jauhar Karachi
is that the Kay Kay Builders (Pvt) Ltd. Land acquired title of land measuring 9 acres 30
guntas through through register sale deed dated 30-06-1998.copy enclosed and market
as annexe a, hereinafter referred as Land

The said land was sub-divided into 13 Plots duly approved by MEO. Copy of letter enclosed
and marked as annexe B

Then after acquiring title of land through registered sale deed 30-06-1998 and valid
approval of sub-division by the MEO Karachi, the building plan in the name of Munir Mega
Mall was approved by the Cantonment Board Faisal vide its letter No. 14/J, Plot No.
118/9C/II&III/BI-18 dated 23-04-1998. The project was delayed due to huddles and
unavoidable problems after one and the , which now have been resolved. It is worth to
mention thatThe letter from MEO and DML&C for seeking of NOC from Station Head
Quarters.

1. Since the Station Headquarter Vide its letter No. 347042118/R/Q-2 dated 6-05-
2015 informed Director Military LandS and Cantonments Karachi Region, Military
Estate Office Karachi Circle Karachi and CEO Cantonment Board Faisal Karachi and
information WAS also conveyed to the Garrison Head Quarters- 5 Corps Karachi
and GHQ, that Station Headquarter Karachi has NO OBJECTION for Continuation of
Construction, Renovation and Operation of Munir Mega Mall and other on Survey
No. 118/9 A,B,C&D and it has been further directed to Cantonment Board Faisal to
allow continue construction and its operation as per existing by laws.

2. That subsequently Station Headquarter vide letter No. PC/2118/179/Manzoor/Q-


2 dated 24 June 2015 informed director Military Land and Cantonments Karachi
Region, Military Estate Office Karachi Circle Karachi, CEO Cantonment Board Faisal
Karachi and GHQ that Station Headquarter Karachi and Mr. Munir Sultan, M/s. Kay
Kay Builders Gulistan-e-Jauhar Karachi that there is NO Objection for Re-
Classification of land from A-I to C Land for provision of road at Karachi Gulistan-
e-Jauhar Block 18, KDA Scheme 36, Karachi in accordance with Government of
Pakistan, Ministry of Defence, ML&C Department and GHQ approved SITE Plan
vide ML&C letter No. 42/76/Lands/ML&C/88/736/DS/ML&C/94 dated 27 Feb,
1995 from Military Point of view as required under rule 7 of the CLA rules – 1937,
Photocopy of letter enclose as annexure “C”.

3. Then thereafter GHQ QMG (Qtg & Lands Dte) has also issued NO OBJECTION for
4.9 Acres of A-1, Land Survey No. 118/9 Block No. 18, Gulistan-e-Jauhar Karachi
Under Road Network to be Re-Classified from A-1 to C as per sketch attached
photocopy of Letter GHQ/QMG’s Branch Qtg and Land Dte vide letter No.
5631/273/132/Land-1A-4FPL1U dated 10 Sept 2015 and sketch duly approved are
enclosed and marked as annexure “D”.

4. Then thereafter HQ 5 Corps vide letter No. 231/2/PC-1/Gar-7NJ1HU dated 14 Sep


2015 intimated to MEO Office Karachi, CEO, Cantonment Board Faisal, Karachi, Qtg
& Land-Coord, Qtg & Land-LDC, RPMT-Karachi Sta, HQ Kci-CR-Sec, ML&C, Mr.
Munir Sultan M/s. Kay Kay Builders Karachi. The point for raising construction by
Mr. Munir Sultan of M/s. Kay Kay Builders was taken into consideration raised by
the MEO that building plans cannot be passed till Re-Classification adjacent
approved road land from A1 to C Land. The case was processed with GHQ and NOC
for Re-Classification of 4.95 Acres Land from A1 to C for Roads has been issued by
GHQ and QMG’s Branch Qtg and Land Dte vide letter No. 5631/273/132/Land-1A-
4FPL1U dated 10 Sept 2015. In view of the approval / NOC, CEO Cantonment Board
Faisal was directed to process Building Plans as per by laws and applicant to be
allowed to resume their construction work photocopy of letter dated 14-09-2015
Letter is enclosed and marked as Annexure “E”.

5. After getting all NOC’s of Re-Classification of Land and approval of Building Plans
in year 2016 the false case by NAB was foisted which was by The Grace of Allah
dismissed Judgment in favour of Munir Sultan by the Accountability Court No. 1 ,
Sindh Karachi vide its Judgment dated 30-05-2018.

6. The Cantonment Authorities attempted to intervene the Lawfull construction of


Kay Kay developers therefore Const. Petition No. D1270/2017 was filed which was
allowed vide Judgment dated 25-04-2017.

In view of above Your Honour is brought into notice that entire through picture to keep
on record and perusal please.
