(a) Where the employer is a company to which regulation 3(2) of the Regulations applies, the certificate shall state in a
prominent place, either that the policy covers the holding company and all its subsidiaries, or that the policy covers the
holding company and all its subsidiaries except any specifically excluded by name, or that the policy covers the holding
company and only the named subsidiaries.
(b) Specify applicable law as provided for in regulation 4(6) of the Regulations.
(c) See regulation 3(1) of the Regulations and delete whichever of paragraphs 2(a) or 2(b) does not apply. Where 2(b) is
applicable, specify the amount of cover provided by the relevant policy.

"Facility" means the arrangements agreed between the Insurer and Willis under which
the Insured’s Policy has been placed.
"Cover In Force" means that part of the cover available under the Insured’s Policy in
respect of which an additional premium charge has not been levied by the Insurer.
If the Insurer replaces the Cover In Force available under the Facility with broader
cover, without requiring any additional premium charge (the "Replacement Cover"),
from the date that this Replacement Cover becomes effective under the Facility the
Insurer agrees that the Replacement Cover will apply to the Insured’s Policy, to the
extent that it differs and is broader from the Cover in Force, and any and all claims
arising under the Insured’s Policy on or after such date shall be determined in
accordance with the Replacement Cover.
Wherever the term the Insured appears in this clause it can also mean the Assured
and/
or Policyholder (as appropriate)
IMPORTANT INFORMATION
1. Complaints
The FOS will only consider your complaint if you have given us the opportunity to resolve it
and you are a private policyholder, a business with a group annual turnover of less than £1
million, a charity with an annual income of less than £1 million or a trustee of a trust with a net
asset value of less than £1 million. If, however, we do not resolve your complaint within 40
working days, the FOS will accept a direct referral.

entitled to compensation from this scheme if we cannot meet our obligations, depending on the
type of insurance and the circumstances of your claim.

This Notice forms part of your Policy and should be attached to it.

SUBJECTIVITY ENDORSEMENT
In accordance with the provisions of Policy Condition (AVSUB1) – Subjectivity, the Cover provided
by this policy is subject to the following:
A) Allow us to survey the premises within 90 days of inception (Site and Liability survey)
Applicable Sections
Contractors All Risks
The Insurer will allow a Return Premium to The Insured on the Renewal Date stated in The Schedule,
to be calculated at the Renewal Date (or other agreed date stated in The Schedule,) provided that Loss
Ratio under the Applicable Sections does not exceed the percentage amounts stated below.

Any Return Premium allowed is subject to The Insured offering renewal of the insurance under this
policy for a further Period of Insurance.
Claims Incurred
The total of claims paid and outstanding reserves under the Applicable Sections, as recorded by The
Insurer, which are shown as paid and/or outstanding one month after the renewal date of this policy.
Premiums Paid
The total premiums paid or payable under the Applicable Sections for the previous year’s Period of
Insurance (renewal premium and any mid-term or end of year adjustments relating to that year,) but
excluding any taxes.
Loss Ratio
The Claims Incurred expressed as a percentage of the Premiums Paid (to the nearest 1%).
Return Premium
A rebate from the Premiums Paid.
If, for whatever reason, construction work at the Contract Site is suspended or stopped, You must
notify Us within 30 days of the suspension or stoppage.
If, in the event of any claim for Damage, You have failed to advise us that construction work at the
Contract Site has been suspended or stopped, and the suspension or stoppage has been in excess of 30
days, We may at our option, avoid the claim.

For Contracts having an original contract price of £2,500,000 or above the Insured undertakes to
comply with the Joint Code of Practice on the Protection from Fire of Construction Sites and Buildings
Undergoing Renovation (The Joint Code) dated January 2000 or any subsequent amendment or
revised edition current at the inception or subsequent renewal of this policy.
For the purpose of paragraph 6.3 of the January 2000 edition of The Joint Code any Contract having
an original contract price in excess of £20,000,000 shall be deemed to be a Large Project.
An appointed representative of the Insurer shall have the right at all reasonable times to enter and
inspect the Contract site for the purpose of checking whether the conditions in all respects comply with
The Joint Code.
In the event of the Insurer becoming aware of a breach of The Joint Code the Insurer may inform the
Main or Management Contractor’s Construction Site management of the nature of the breach
specifying the remedial measures required by the Insurer and the period within which these must be
completed.
Where the Insurer considers such a breach is of sufficient importance the Insurer may confirm the
same by notice in writing to the Employer and the Main/Management Contractor and the first named
party from the Insured when this is not the Employer or the Main/Management Contractor at their
respective addresses nominated by the Insured at the inception of the cover or as subsequently
amended.
Under the terms of this or any subsequent notice the Insurer may suspend or cancel all cover under the
Contractors All Risk Cover from the date named in the notice not being a date earlier than the date
named for completion under the Remedial Measures it being understood that upon suspension such
cover shall be reinstated when the Insurer is satisfied that the Remedial Measures have been
completed. Such notice shall be given by registered post, recorded delivery, facsimile transmission or
by hand.
The reference to suspension or cancellation of all cover shall apply only to the Contract specified in
the notice.
In the event of cancellation only, the Insurer agrees to return to the Insured a pro rata proportion of the
relevant part of the Contractors All Risks Cover premium.

We will not provide indemnity in respect of Damage resulting from the overtopping of coffer dams.

constructions or into casings.
3 Any abandoned piling work unless such abandonment is a direct consequence of Damage which is
the subject of indemnity under the Contract Works Section.
4 Piles which have failed to pass a load test, or to reach the required bearing load, unless such failure is
a direct consequence of Damage.
5 Any dependence on known substandard work unless the design has been appropriately reworked to
suit.

If in relation to any claim the Insured has failed to fulfil any of the following
conditions, they will lose their right to indemnity or payment for that claim.
The Insured must ensure that in connection with any work undertaken by any bona-fide
sub-contractors the Insured obtains evidence the bona-fide sub-contractors have current policies
providing indemnity for Public and Products Liabilities that
and that the Insured keeps a written record of their insurer and policy number.

If in relation to any claim the Insured has failed to fulfil any of the
following conditions, the Insured will lose their right to indemnity or payment
for that claim.
The Insured must ensure that the following precautions are taken each time any
(3) blow lamp, blow torch, hot air gun or hot air stripper
is used away from premises which the Insured owns, hires or rents.
(a) Where the Insured and any other person(s) for whom they are responsible
are working at a site, a responsible person must be appointed
for fire safety to ensure the following precautions are taken.

(c) At the point of application of heat, including, if there is a
risk of ignition directly or by conduction, combustible
materials including
and/or
(d) All gaps or holes through which sparks or flames could pass must
be covered by non-combustible material.

(a) Hot waste materials and welding rods must be removed and
safely disposed of.
(b) A final fire safety check must be carried out between 30 and 60
minutes after work has finished and immediate steps taken to
extinguish smouldering or flames detected.
5 a The Insured shall give written notice to the Insurer of any Personal Injury or
claim or proceeding as soon as possible after the same shall have come to the knowledge of the
Insured or his representative
b the Insured shall not admit liability for or negotiate the settlement of any claim
without the written consent of the Insurer who shall be entitled to conduct in the name of the Insured
the defence or settlement of any claim or to prosecute for its own benefit any claim for indemnity or
damages or otherwise and shall have full discretion in the conduct of any proceedings and the
settlement of any claim and the Insured shall give all such information and assistance as the Insurer
may require
(1) If in relation to any claim The Insured has failed to fulfil any of
the following conditions, they will lose their right to indemnity
or payment for that claim.

(a) The Insured maintains in force a system of work for controlling the
risks associated with digging, excavating, boring or
similar work and before starting such work they must have
and
and
(2) The Insurer will not provide indemnity for the first 10% or £1000, whichever is
the greater, of Compensation, Costs and Expenses, subject to a maximum
amount of £2,500, in respect of Damage to optical fibre cables.
The Insurer will not indemnify the Insured against liability under Sub Section - B Public and Products
Liability for any amount in respect of penalty clauses or punitive or exemplary damages or any
damages resulting from the multiplication of compensatory damages.
We will not provide indemnity in respect of work at a height where the drop exceeds the 20 metres.
The Depth Limit in relation to this policy is 15 metres and not as otherwise stated in the schedule.
AV086 WOODWORKING
This insurance does not apply to liability in respect of any claim arising in connection with the use by
Employees of the Insured of woodworking machinery driven by mechanical power. The expression
"Woodworking Machinery" does not include lathes fret-saws boring machines and mechanically
driven portable tools applied to the work by hand.
ERECTION OF BUILDINGS

We will only indemnify The Insured in respect of contracts, undertaken by The
Insured, for the erection of buildings not exceeding 10 metres in height including any

(a) of structures as part of a contract, undertaken by The Insured, for erection, reconstruction,
alteration, maintenance or repair.
If in relation to any claim You have failed to fulfil any of the following conditions, You will lose Your
right to indemnity or payment for that claim.
You must ensure that in connection with Damage to underground pipes, cables or other services You
maintain in force a system of work for controlling the risks associated with digging, excavating, boring
or similar work and before starting such work You must have
(i) taken (or caused to be taken) all reasonable steps, including contacting the appropriate authorities,
to find out whether any pipes, cables or other services, which could be at risk, are under the site
and

(ii) kept a written record of the steps taken
and
(iii) informed whoever is carrying out the digging, excavating or boring of the location pipes, cables or
other services.

In order to achieve a safe working environment and to minimise nuisance, it is essential that the
traffic management system be rigidly applied. All access to, on and around the delivery area within
Darnley Terrace / St James’s Gardens will be controlled by Cranbrook Basements at all times,
including their contracted works and in conjunction with other Trade Contractors. The Trade
Contractors shall co‐ordinate their access requirements with Cranbrook Basements so as to cause no
disruption to their own or others activities.
Cranbrook Basements will satisfy themselves of the suitability of this Site entrance including the
restrictions associated with this entrance. Cranbrook Basements will supply all necessary personnel
required to maintain the safe control of traffic and deliveries through and across the public highway
into the site, this will include a traffic marshal/banksman as required.
Cranbrook Basements will ensure that all deliveries and collections to and from the site are carried
out between the hours of 8.00 a.m. and 5.00 p.m. Large vehicles will deliver between 10am and 4pm
to avoid disruption.
The estimated number of vehicles per day is 3/15 per week. This number will reduce once
excavation phase of works is completed.
Vehicles to be used are mainly HGV and delivery vehicles during the excavation period, changing to
smaller sub contractor and delivery vehicles once excavation is complete. Dwell time to be between
5 minutes minimum to 15mins maximum.
Call to be made to site foreman with an expected time of arrival, to enable the site to be cleared
ready for delivery.
No double parking will be allowed.
It is intended that all excavated material and debris/waste will be removed by grab lorry via skips or
spoil boxes, which will be situated at the kerbside outside the front of the site. Local Authority
Highways permits/licences will be obtained for this purpose and any necessary fees paid. Hoarding
panels will be placed around the materials compound area to separate the skip/spoil box from the
general public and to provide a small holding area for materials while they are being distributed into
the site. The hoarding fenced area on the road will be approximately 2.5 x 4.5m in dimension.
Materials generally will not be stored on the open public highway.
Refer to drawing 2140‐260 for details of hoarding layout.
Note – Neighbours will be consulted regarding location of hoardings, and consent will be obtained
should the location of grab lorries when stationary affect their frontage.
It is estimated the amount of single yellow line space required directly outside the property will be
equivalent 2no. parking bays. An appropriate application to the Highways Department will be made
for permission to suspend required single yellow line zone in order to position grab lorry and store
site based materials securely.
Spoil to be removed from site by grab lorries only.
Grab lorry movement to be limited to between the hours of 10am & 4pm.
When the spoil removal is taking place and during unloading or loading operations, a banksman will
be positioned on the street to ensure that the manoeuvre is carried out safely and also to ensure
pedestrian safety and traffic flow is maintained
Public highway is to remain open at all times during construction.
Concrete will be mixed within the boundaries of the property. There will be no truck mounted
concrete deliveries.
Trade Contractors will be responsible for liaising with the Cranbrook Basements Site Manager
regarding all traffic management associated with their deliveries/works including relevant liaison
with Police, Local and Statutory Authorities. Demobilisations from site will require the same logistics
procedures.
Any vehicles removing loose rubbish or debris for the site must have the load fully sheeted.
Cranbrook Basements who’s lorry/delivery causes mess will be responsible for clearing the common
areas around the delivery point and will make due allowance with a water supply and hose available
to aid in cleaning away any mud if required. All drains will be covered by a filtering membrane to
prevent any ingress with any waste cleared.
All plant and materials not on site are to be kept within hoarding compound, to eliminate any
potential road issues. This will be approved by the local authority as part of our hoarding/suspension
application.
All vehicles (demolition/excavation and construction vehicles) can approach site from Princedale
Road via Holland Park Avenue turning into Darnley Terrace / St James’s Gardens. At the junction of
Darnley Terrace we will request the construction firm have a banks man to direct the traffic. Exit
from site will be right turn onto St. Alban’s Road and then onto Barnley road meaning turning
movements and potential impact on local residents being kept to a minimum. Copies of map
highlighting route will be issued to all contractors/delivery companies visiting site via email prior to
undertaking journey to site.
All vehicles delivering materials directly into the materials compound shall be required to place
crane mats for any outriggers to spread any loads and prevent and damage to the highway.
No Welfare facilities will be placed on the Public Highway.
There will be no private parking facility on site for cars, vans and pick‐ups. Drop off and pick‐up
parking will be restricted by prior arrangement and co‐ordinated with the Site Manager.
Cranbrook Basements shall not allow their staff and workmen or those of their Trade Contractors to
illegally park cars and other vehicles on Darnley Terrace.
There is Pay and Display parking available in surrounding roads during working hours on a pay at
meter basis. If utilised this cost will be borne by the contractor.
It is the responsibility of Cranbrook Basements to direct/bank and organise their deliveries in/around
and adjacent to the site, in order that delivery to site is carried out in a safe and controlled manner.
Cranbrook Basements will make suitable provisions in order to provide this function.
The main vehicular construction site approach is located within Darnley Terrace. This area will
occasionally have emplaced, during normal working hours only, as the contract requires.
Note: Darnley Terrace is not within a sensitive location i.e. on a school route or high pedestrian
footpath area.
It is Cranbrook Basements responsibility to inform their management, operatives, Trade Contractors
and suppliers of the designated site access routes.
Cranbrook Basements will notify their suppliers that no waiting or queuing is permitted in and
around the site roads and deliveries are to be based on a strict just‐in‐time process (with phone call
5‐10 minutes prior or similar). Registrations of repeat offenders will be taken and these may be
refused access to site. No vehicles are to be left unattended. No stacking of vehicles or parking
within Parking Bays whilst waiting allowed. Vehicles allowed to site when Darnley Terrace is safe &
free from traffic.
Cranbrook Basements will liaise with Local Authorities regarding refuse/recycling collection dates
and times, in order to avoid deliveries to site during collection times.
Cranbrook Basements must ensure that their vehicles, and those of their operatives and suppliers do
not cause damage or nuisance to neighbouring properties and residents when approaching or
leaving the site, nor must they be parked in a manner that may cause obstruction or nuisance on
site. Any damage caused must be made good at the Trade Contractor’s cost.
Cranbrook Basements shall ensure that normal vehicular and pedestrian traffic over the existing
access roads and highways is not impeded.
All vehicle deliveries to the project must be pre‐arranged in advance via the main office and
monitored by site manager. All vehicles delivering to site are to have a pre‐arranged time. No
offloading will be permitted outside these times.
Due to the limited area available on site for the storage of materials it is imperative that a just‐in‐
time delivery regime be rigorously enforced, with components whenever possible being unloaded
and installed directly into the materials compound. This regime means it is not necessary to provide
a vehicle holding area.
Cranbrook Basements can confirm that highway will not be used for any construction or demolition
purposes. Works to be kept within the demise of the property.
Information leaflets to be supplied to all contractors making deliveries to site, to inform them of
agreed route onto site, and also any on site restrictions that may apply.
It is the responsibility of the Site Manager to provide and maintain segregation of the site
traffic/plant and pedestrian routes into the site. It is the responsibility of all Trade Contractors to
liaise/co‐ordinate this requirement with the Site Manager and other Trade Contractors where trade
contract works will affect the existing set up.
Deliveries not scheduled may be denied access to the site. If deliveries cannot be immediately
accepted on site (even if on the schedule) they will be directed away from site, as no load is
permitted to wait in and around the site.
Cranbrook Basements shall provide facilities for all on‐site materials received. This is to include
inspection, off‐loading, transportation and safe keeping of all construction materials and plant as
necessary for their works. Sufficient plant and materials should be made available to allow quick
loading and movements of materials. Trade Contractors should ensure that sufficient thought is
given to the method of unloading deliveries on site to ensure that vehicles can be offloaded
promptly.
All materials should be organised and palletised to suit lifting by either manual handling through the
compound gates or via lorry loader crane over the hoarding and should be suitably protected from
possible damage. A small holding area within the compound will be utilised for material while it is
being distributed into the storage areas on site.
All deliveries of abnormal/exceptional loads must be highlighted and booked in sufficient time for
the Site Manager to check that access routes and site location can be arranged.
Cranbrook Basements will ensure that vehicles, materials and plant cause no obstruction which may
inconvenience or endanger the safety of adjoining owners or the public. Cranbrook Basements will
comply with the requirements of the emergency services at all times.
Cranbrook Basements Trade Contractors must also note all access routes are to be kept clear for
emergency vehicle access.
Public Footpaths must remain open at all times.
Cranbrook Basements will ensure that live emergency fire exit and access routes exist on site. The
Trade Contractor will need to allow working in around these when executing their works.
All vehicles leaving the site carrying potentially dust‐generating demolition or construction waste are
to be completely sheeted using a tarpaulin or netting which is to be in good order.
Any Residents or public issues that may occur should be made known to Cranbrook Basements on
Tel: 020 8551 5555. The relevant person responsible for the Project will be able to provide
assistance.
Note: Site programme indicates an excavation phase of works of 30 weeks. The overall period for
construction works on site is 48 weeks.
Working hours are to be between 8am – 5pm Monday – Friday, and 8am – 1pm Saturday.
Cranbrook Basements to review CTMP at 8 week intervals to determine whether any alterations or
amendments are required. Cranbrook Basements will liaise with local authorities, Utilities companies
and relevant contractors to make sure no disturbance occurs from the proposed alterations.
Cranbrook Basements will co‐ordinate any arrangements if applicable with any other local
developments to minimise disruption to the immediate area. As mentioned above, a monitoring
procedure will be put in place, where a check to see if any local developments have commenced
after the proposed works have begun will be carried out on a periodic basis (8 weeks). Should any
additional works begin during works, Dan Vickerstaff of Cranbrook Basements shall liaise with the
developer of the new scheme and agree a strategy to avoid potential unnecessary site traffic, and
amend the CTMP to reflect.
Cranbrook Basements shall ensure that normal vehicular and pedestrian traffic over the existing
access road and highways is not impeded.
